CALL TO ORDER: Chairman Rosemary Smedile called the meeting to order at 7:00 PM at Town Hall
Meeting Room,
ATTENDANCE: The following were present: Rosemary Smedile Chairman; Richard Vaillancourt, Clerk; Tracy

Richard Vaillancourt made a MOTION, seconded by Tracy Watson, to approve the Open Session Minutes of
March 10, 2014, as written. Vote approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Tracy,Watson, to approve that the Board of Selectmen

Firefighter Christopher W. Rowan has successfully completed his.one year probationary period and has

Certificate of Commendation Chris Vasilopoulos
A Certificate of Commendation was presented to Chris Vasilopoulos for performing the Heimlich maneuver on
a patron at his restaurant choking on food. Fire'Chief Melnikas and the Board of Selectmen presented the
Certificate. -
Sargent School 5th Grade Service Project—"Drop & Go" Saturday, April 5, 2014
The students will hold a collection event which allows people to donate items to local charitable organizations.
Drop off& Go will be held at the North Andover Middle School from 10:00 AM to 2:00 PM on Saturday, April 5,
2014.
North Andover Merchants Association "Annual Knight of Honor/Rising Star Gala
The Merchants Association will hold,th'e Annual Knight of Honor/Rising Star Gala at the North Andover
Country Club, 500 Great Pond Road, tickets are still available at$50 and this is to raise Scholarships for North
Andover students.
Utility Project at Old Center
The Utility Project at the Old Center has been completed as of last week.
Affordable Housing Trust& Bread & Roses Partnership
Bread & Roses Housing Community Land Trust in partnership with the North Andover Affordable Housing
Trust is opening its application process for an Affordable Home Ownership Opportunity at 91 Waverly Road,
North Andover, selling price of$175,000. There will be seminars in April and May at the Stevens Memorial
Library.

Citizen Petition Articles

The petitioners of the five citizen petition articles filed for Annual Town Meeting were invited to the meeting
and provided the Board with information regarding their submission. The Board will formally vote their
recommendation on these articles at their April 14, 2014 meeting.
Downtown Parking Committee
Curt Bellavance, Community Development Director, recommended that the Town Manager form a 'Downtown
Parking Committee' to review and submit recommendations regarding parking downtown.
North Andover Wildlife Team—James McCarthy
James McCarthy of the North Andover Wildlife Team presented a summary of the past and future activities of
the group. The main objective of the team is to raise the carrying capacity of the Town by planting as many
native plants and removing as many invasive plant species as possible. Plant 500 native plants in public
spaces; register with the National Wildlife Federation. In order to achieve Community Habitat status with the
NWF 150 homeowners need to certify that their properties have food, water and shelter for wildlife. If you are

Youth & Recreation Services Spring Carnival, April 24-27, 2014
The Joseph N. Herman Youth Center Inc. in conjunction with the Board of Directors of Youth & Recreation
Services, requested permission to hold their 23r Annual Spring Carnival at 1600 Osgood Street from April 24
—27, 2014. Hours of operation are as follows: Thursday, April 24, 1:00 p.m. to 10:00 p.m.; Friday, April 25,
1:00 p.m. to 10:00 p.m.; Saturday, April 26, 1:00 p.m. to 10:00 p.m. and Sunday, April 27, 1:00 p.m. to 6:00
p.m. Carrie Crouch requested starting at 12:00 noon on Sunday, April 27, 2014, a change from the original
request at 1:00 p.m.
William Gordon made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the
request to hold the Youth & Recreation Services 23rd Annual Spring Carnival at 1600 Osgood Street from April
24-27, 2014, to waive all permit fees and to extend the time on Sunday, April 27, 2014. Vote approved 5-0.
Acceptance of Donations from Youth Sports Groups for Town's Athletic Fields/Facilities-$49,250
The Youth Sports Groups have made their annual donation, based on their respective program registrations,
for the Town's Athletic Fields/Facilities. Donations over the past four years have totaled just over$200,000.
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen accepts the
donations from Youth Sports Groups for Town's Athletic Fields/Facilities in the amount of$49,250. Vote
approved 5-0.
Request by Festival Committee to use Town Common for Sheep Shearing Festival on May 18, 2014
The Festival Committee requested to use the Town Common for the Sheep Shearing Festival on Sunday, May
18, 2014 from 6:00 a.m. to 6:00 p.m. They are also requesting that Massachusetts Avenue from Osgood
Street to Academy Road to Academy Road to traffic from 7:00 a.m. to 6:00 p.m. and to allow for one handicap
parking spot on Osgood Street.
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approve the
request of the Festival Committee to use the Town Common for the Sheep Shearing Festival on May 18,
2014, from 6:00 a.m. to 6:00 p.m. and to close Massachusetts Avenue from Osgood Street to Academy Road

to Academy Road to traffic from 7:00 a.m. to 6:00 p.m. and to allow for one handicap parking spot on Osgood
Street. Vote approved 5-0.
Request by Tyler Bainbridge to close Woodcrest Drive for the 3rd Annual Longboard for Life to benefit the
American Cancer Society on Saturday, June 7, 2014 from 7:00 a.m. to 2:30 p.m.
Tyler Bainbridge requested approval to close Woodcrest Drive for the 3" Annual Longboard for Life for the
benefit of the American Cancer Society on Saturday, June 7, 2014 from 7:00 p.m. to 2:30 p.m. All relevant
Town Departments recommended approval.
There was a discussion about some of the neighbors complaining that Woodcrest Drive is being used every
weekend by Longboarders. In the future, maybe consider a larger venue for this event as it continues to grow.
Selectmen asked if Tyler would work out some differences with the neighbors on the street and come back at
a future meeting with a solution for this year.
Tyler said that he as posted on the Longboard website page and on Facebook that Longboarders should not
be on Woodcrest Drive except on the day of the event and if they are caught and or reported they could not
participate in the event.
He will return with more information in the future/
Request by Sonja Nathan to use Streets in North Andover for 4th Annual Coast to the Cure Bike Ride to benefit
Neurofibromatosis Northeast on September 6, 2014.
Sonja Nathan requested approval to use streets in North Andover for the 4th Annual Coast to the Cure Bike
Ride to benefit Neurofibromatosis Northeast on Saturday, September 6, 2014. The three routes (24, 66, 100
miles)will all start and finish at Stage Fort Park in Gloucester. The Event goes through North Andover and
eighteen (18) other communities. All relevant Town Departments recommended approval.
William Gordon made a MOTION, seconded by Donald Stewart, that the Board of Selectmen approves the
request of Sonja Nathan to use streets in North Andover for the 4th Annual Coast to the Cure Bike Ride to
benefit Neurofibromatosis Northeast on September 6, 2014. Vote approved 5-0.
Appointments
The Board's Sub-Committee and the Town Manager recommended the following people to serve on various
Boards and Commissions in North Andover; Phyllis Jones, Commission on Disability Issues; Suzanne
Fischer, Festival Committee; Nicholas Pelletier, Historical Commission; and Karen Kline, a Re-appointment as
the Poet Laureate.
Tracy Watson made a MOTION, seconded by Donald Stewart, that the Board of Selectmen appoints Phyllis
Jones to the Commission on Disability Issues for a term ending June 30, 2015. Vote approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen appoints
Suzanne Fischer to the Festival Committee for a term ending June 30, 2015. Vote approved 5-0.
William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen appoints Nicholas
Pelletier to the Historical Commission for a term ending June 30, 2016. Vote approved 5-0.
Donald Stewart made a MOTION, seconded by Tracy Watson, that the Board of Selectmen re-appoints Karen
Kline as North Andover's Poet Laureate for a term ending June 30, 2016. Vote approved 5-0.
Request by Police Department to install a stop sign on Hodges Street at May Street
A resident asked about installing a stop sign at the corner of Hodges Street at May Street. Traffic Safety
Officer Mark Wilson after an investigation of Hodges Street at May Street said that the area of May and
Hodges Streets is a shortcut from Main Street and an entry/exit area for senior housing. Chief Paul Gallagher
and Officer Wilson recommended the placement of the Stop sign and asked the Board's approval.
Tracy Watson made a MOTION, seconded by Richard Vaillancourt, that the Board of Selectmen approve the
request from the Police Department to install a stop sign at Hodges Street at May Street. Vote approved 5-0.

Request by Columbia Gas of MA to excavate Marbleridge Road for the purpose of extending and/or replacing
its gas main
In accordance with M.G.L. c164 §70, the Board must give consent to the gas company to 'dig up and open the
ground in any of the streets, lanes and highways of a town.' The Department of Public Works recommends
approval with no work starting prior to April 15, 2014. Erich Schlitt, representative of Columbia Gas said that
the particular project would last approximately 30 days for all of the house,connections on Marbleridge Road.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson that the Board of Selectmen approves the
request of Columbia Gas of MA to excavate Marbleridge Road for the purpose of extending and/or replacing
its gas main with no work starting prior to April 15, 2014. Vote approved 5-0.
Vote to reopen the 2014 annual Town Meeting Warrant
The Board was asked to reopen the 2014 annual Town Meeting Warrant to include two additional articles:
Amend General Bylaw—Chapter 88: Dogs.
Tracy Watson made a MOTION, seconded by William Gordon, that the Board of Selectmen reopens the 2014
Annual Town Meeting Warrant to include one additional article. Roll Call Vote approved; William Gordon yes,
Richard Vaillancourt yes, Tracy Watson yes, Donald Stewart, yes and Rosemary Smedile yes. Vote 5-0.
William Gordon made a MOTION, seconded by Tracy Watson, that the Board of Selectmen closes the 2014
Annual Town Meeting Warrant. Vote approved 5-0.
Ordering of 2014 Annual Town Meeting Warrant
The Town Manager and Selectmen Chair Rosemary Smedile reviewed the Warrant and recommended the
Ordering as presented. The Board is requested to approve the ordering of the Warrant.
Tracy Watson made a MOTION, seconded by Donald Stewart that the Board of Selectmen approves the
ordering of the 2014 Annual Town Meeting Warrant as presented. Vote approved 5-0.
Accept 'Determination of Surplus Land' from School Committee
The construction of the new fire station is planned for the parcel of land on Chickering Road at Prescott Street
at the far end of the high school property. As the land for construction of the original high school was obtained
in 1970 for school purposes, the School Committee was asked to vote that this particular parcel was no longer
needed for school purposes and thus is surplus. The Board was asked to accept this determination and vote
of the School Committee in accordance with MGL c40 §15A.
Donald Stewart made a MOTION, seconded by Tracy Watson that The North Andover Board of Selectmen
accepts, the"Determination of Surplus Land"from the School Committee for the parcel of land on Chickering
Road at Prescott Street. Vote approved 5-0.
OLD BUSINESS:
Update of Emerald Ash Borer— Ken Gooch, Department of Conservation and Recreation
Ken Gooch returned with a follow-up regarding the Emerald Ash Borer and the recent delineation work DCR
and the US Forest Service completed in North Andover. In early spring the DCR Forest Health staff will be
dropping 50-75 of the heavily infested ash trees along the Route 125 corridor. Girdling of 50-100 ash trees in
the general vicinity of the current known infested area to create"sinks" or areas where small levels of EAB
would be attracted to. Releasing two EAB biological control predators in the same infected area and the use
of pesticide contingent upon approval of the Conservation Commission,
The Board was asked to approve and accept the recommendations.
Richard Vaillancourt made a MOTION, seconded by Tracy Watson, that the Board of Selectmen approve of
dropping 50-75 heavily infested ash trees along Route 125; Girdling of 50-100 ash trees in the same area;
releasing two biological control predators in the same infected area; and pesticide use contingent upon
approval of the Conservation Commission. Vote approved 5-0.
PUBLIC COMMENT
Mr. Will Edwards of 90 Windsor Lane, a 20 year resident and a member of the Sustainability Committee is in
favor of Mr. Ercolini's citizen petition article for the Town to preserve the Berry Farm Site's open spaces and to

acquire 26 acres of land and buildings. Mr. Edwards suggested because of the lands southern exposure to do
a feasibility study to possibly use the land as a Solar Farm to defray the cost of the town purchasing the land
and to speak to Dan Leary, co-founder of Next Stamp Solar and a member of the Finance Committee.
NEW BUSINESS:
Town Meeting Warrant— Report of the Community Preservation Committee
John Simons, Chair of the Community Preservation Committee briefed the Board regarding the recommended
projects for CPA funding as follows: McEvoy Field (Phase 2), $290,000 Open Space Recreation; Stevens
Estate—Stained Glass Window Refurbishment, $25,120 Historical Preservation; Multi-Use Trail (Phase 1),
$176,000 Open Space Recreation; Sargent School Playground, $92,260 Open Space Recreation; Old Center
Preservation Project, $570,000 Open Space/Historical Preservation; Nan's Trail, $68,435 Open Space;
Reserve for Affordable Housing, $196,600 Affordable Housing; Administrative Expenses, $30,000
Administrative Expenses; for a total of$1,448,415.
The Board will formally vote their recommendations on this article at the April 14, 2014 meeting.
TOWN MANAGER'S REPORT:
Preliminary Design of New Fire Station
The Architect and the Owner's Project Manager have been working for the past few months with a Design
Advisory Group including representatives of the North Andover Fire Department. The Town Manager
presented a preliminary design of the new Fire Station.
Capital Project Status Report
The Town Manager provided a status summary of the on-going capital projects as well as a milestone timeline
through the end of June, 2014.
Police Department Report
Police Chief Paul Gallagher provided a summary of February 2014 crime statistics.

NORTH ANDOVER YOUTH & RECREATION SERVICES
STEVENS POND 2014
North Andover Youth&Recreation Services is preparing for its eleventh season operating
Stevens Pond. In 2013 we re-opened the pond after the blue-green algae infestation shut down
the season early in 2012. Thanks to the Town of North Andover under the leadership of the
Department of Public Works for addressing the issue.
Stevens Pond is presently staffed by one Director, one Assistant Director, eight lifeguards and
several parking lot attendants. The Director earns $16.00 per hour and the Assistant Director
earns $13.00 per hour. Our lifeguards earn between $10.00 per hour and$12.50 per hour
depending on length of employment.
The staffing is comparative to most communities and any reduction of staff would present safety
concerns. The parking lot attendants are paid between$8.00 and$9.00 per hour. They check
permits, sell daily passes and monitor the parking and concession areas.
The Pond contracts for weed removal and prevention. This work, which is done under the
direction of the Department of Public Works, must be done on a yearly basis and is scheduled to
be done in late spring this year.
Stevens Pond Renovations: Renovations that have been completed in recent years:
June 2008: Completion of brand new bath house, which includes guard shack, bathrooms,
outdoor showers, deck and storage area.
June 2008: Construction of new picnic tables
July 2008: Construction of brand new playground
August 2008: Installation of new flagpole
June 2009: Purchase of new docks, rafts and equipment
May 2010: New fencing along the main street, fencing fixed and painting on fire access road.
New trees were planted on the main street.New flower beds were installed by entrance and
around flag pole area.
May 2011: Cleaned area by playground
March 2012: Installation of two horse shoe pits and new benches
May 2012: Resurfacing of parking lot
Spring/Summer 2013: Addressed blue-green algae issue
Staffing: I will be recommending Director Kelly Wray to return for her third year as Pond
Director, and Tim D'Entremont will return as our Assistant Director. After a number of new
hires in 2013 I am expecting a strong returning group in 2014
Department of Public Works: It is recommended that DPW continue to offer services in the
following areas: prepare for opening by assisting with pond set-up (clean up, weed removal,
sweeping parking lot, raking sand, cutting grass, cutting bushes, adding sand, etc.) The trash also
needs to be picked up three times a week, along with normal cutting and maintenance throughout
the summer.
Selling of Permits and Swimming Lessons: Upon approval by the Board of Selectmen,the
Youth Center is prepared to sell permits and conduct sign-ups for swimming lessons and all
other programming. This will be done Monday through Friday 9:00am—7:00pm. Once the Pond
is open, residents will purchase the services directly at the pond during normal operating hours.
The Youth& Recreation Services will begin immediate marketing of the pond including flyers to
every school child and advertising in the Eagle Tribune,North Andover Citizen and North
Andover Patch. Information will also be put on the Town website, Youth Center website and
local cable channel.
Special Circumstances: As in the past, accommodations will be arranged for residents with
financial hardships. In 2013 we had 13 season passes and 4 swim lessons that were issued to
families that requested financial assistance. These families will be asked to provide minimal
documentation to support their request.
Hours of Operation: Stevens Pond will be open Monday, June 23rd through Friday, August
22nd Staying open until Sunday, August 24th will be explored depending if the lifeguards are
required to be back at college. Hours of operation will be 9:30am—7:00pm daily.
Stevens Pond Cleanup Day: We will be looking to have this community service project done in
late May 2014. This has been very successful in the past and another connection with the
business community.

Hello,
My name is Tyler Bainbridge, I am 18 years old, and ride longboards
professionally for Omen Longboards. I am hoping to host my charity longboard
competition on Woodcrest Dr. in June of 2014.
For the past few years I have planned and executed two
successful charity longboard competitions under the title "Longboard for Life". Both of
these events had a police barricaded road closed to all automobile traffic. My request
for you is to have the road closed to ensure the safety of the riders and to allow the
event to positively grow into the largest charity event in the entire country. Before I
continue, let me give you some background of my story.
A few days before Christmas in 2011 my good friend Ashley Cunningham was
diagnosed with Cancer. She fought Cancer for 5 months until early April and has since
beaten the disease and is now healthy today. This event was a shock to me and I
immediately joined her Relay for Life group. I decided that the best way to raise money
for our team was to combine longboarding and cancer fighting.
This was the birth of the annual event named Longboard for Life. The event has a
10$ entry fee(subject to change due to the popularity and growth of the event) which
has all profits going to the American Cancer Society. Since that day in 20111 have hosted
two very successful events in the Massachusetts area. Between the events, over$3,500
dollars was raised earning myself the top participant award at the Relay for Life
Topsfield event. The first event which was hosted in Boxford, MA rose over$1,500 and
attracted over 80 participants and another 100 spectators. From the $10 entry fee,the
selling of pizza, t-shirts, raffle tickets and refreshments the Second Annual Longboard
for Life rose $2,156(32.8% increase of the previous year) and brought in 200+
participants and spectators. The event featured professional riders from all over the
country and sponsors providing over$2,000 worth of boards, trucks, wheels, t-shirts, etc
to be awarded to the winners. I am incredibly happy to know all my hard work paid off

Thank you so much for allowing me to host my event on your street. It is one of
the best roads in Massachusetts and it's an honor to be able to use it. I know there may
be some concerns as to the return of the skaters throughout the year. I will make sure

video. The only address posted will be for Smolaks, where they will be required to park.
This will make it much harder for them to find the hill proceeding the event. I'm very
open to ideas as to handle this situation and would be glad to hear them.

CHAPA(Citizens' Housing and Planning Association), has notified the Town that the following affordable
unit is up for sale. CHAPA manages the resale of affordable units at the development.

The Board of Selectmen has to determine if they want to exercise their right of first refusal. Our office
would recommend that the Board of Selectmen should not exercise their right of first refusal for the
affordable housing units. If the Town chooses to exercise its right,then it would be the responsibility of
the Town to purchase the properties or locate an individual to purchase the properties.
CHAPA,which is the monitoring agent for the Town and several other communities, has better
resources to preserve the units as affordable and has recently hired new staff to manage the marketing
of the unit. The timeframe is 120 days to find an applicant that meets the affordable criteria.
Our office continues to work with the North Andover Housing Trust to ensure that the units stay
affordable.
The deadline to act is May 3, 2014 for the Oakridge Village/Maplewood Reserve unit. If the Board does
not act the right of first refusal is deemed authorized. It is recommended that the Board of Selectmen
not exercise their right of first refusal.

Attached please find a request for a One Day Wine &Malt License from Mr. Eli Bailin on
behalf of Green Strides, who plan to hold a road race on April 27, 2014—the First Annual Earth
Rock Run-between the hours of 8 a.m. to 2 p.m. The race route will be through the streets of
North Andover,beginning and ending at 1591 Osgood Street, the site of Jimmy's Famous
Pizza. The applicant is applying for a Wine &Malt License,but only malt will be served,

Tent and stage arrive and are set up at Jimmy's Pizza.
Sunday April 27th
6:00am-7:55am
Participants begin to arrive and park at 1600 Osgood Place. They will walk across the
street to Jimmy's Pizza and pick up their registration. Police details will be onsite to
help control traffic during this time.
Onsite vendors arrive and set up during this time and all vehicles will be off Jimmy's
property at 7:30am.
8:00am-2:00pm
Race starts at 8:00am and completely finished by 2:00pm. Start and finish is in front of
Jimmy's Pizza.
Half marathoners expected to finish between 9:00am and 11:00am
Full marathoners expected to finish between 10:30am and 2pm
With the majority of participants running the half marathon, most will be finished by
10:30am.
9:00am-12pm
Post race snacks are handed out in Jimmy's parking lot. Music begins in the mini-golf
area at 10:30am.
12pm-2pm
Beer is served in the secured mini golf area. Only guests who are 21 and over will be
.allowed inside the mini golf area.
2pm-3pm
Event concludes and clean-up both onsite and along course begin.

Re:One Day Liquor Ucense—Green Strides
On March.18,2014 the Police Department submitted a letter recommending favorable action on Eli
Baffin's request,on behalf of Green Strides,to hold a One Day Liquor License for an event to be held
at 1600 Osgood Street on April 27,2014.This letter contained numerous stipulations to which Mr.
Bailin agreed to abide by.
The Police Department became aware of a conflict between Green Strides'event and the North
Andover Youth Services Annual Carnival,also to be held at 1600 Osgood Street on April 27,2014. In
an effort to coordinate use of the venue with both parties,Jimmy's Famous Pizza,1591 Osgood
Street,was identified as a possible alternate location for Green Strides to stage their registration,
vendor and beer areas. 1600 Osgood Street will still be used for event parking,Mr. Bailin spoke with
the owner of Jimmy's Famous Pizza, Fotios Stamos,and they were in agreement that the site would
be appropriate pending Town approval.I visited the site on April 8;2014 and I am satisfied that 1591
Osgood Street has enough area to host the event. r
The Police Department recommends favorable action on Eli Bailin's request for the One Day Liquor
License to be moved from 1600 Osgood Street to 1591 Osgood Street,All of the stipulations
contained in the March 18,2014 letter from the Police Department remain in effect. In addition,
Jimmy's Famous Pizza will need to post signage inside the restaurant prohibiting alcoholic beverages
from leaving the premises and there will be no vehicles allowed on the property of 1591 Osgood
Street,other than emergency vehicles,from 7:30AM to 2:OOPM on April 27,2014, no exceptions.

Dear Board of Selectmen,
I, Frank Stamos and Nick Papantonakis are interested in
acquiring a wine and malt package license along with an
entertainment license from the town of North Andover to create a new
business at 1593 Osgood St.
We are in the process of purchasing the property at 1591-1595
Osgood St, that includes Jimmy's Famous Pizza (which we currently
own), an empty unit for retail space, and the mini-golf course. We are
planning to close on the property around May l st.
We would like to develop a package store in the empty unit next
door to Jimmy's Famous Pizza. This unit has its own entrance and is not
connected to Jimmy's Famous Pizza at all. We strongly feel that a
package store would be a great addition to our area. Our current
customer base has indicated that there is a need for such a business.
We would be supplying a demand and a convenience to a large
demographic in our area.
We strongly hope you consider us for a wine and malt package
store along with an entertainment license so that we can develop a
new business and provide additional products and services to the town
of North Andover.
