RE: Renewal of Special Permit for an Existing Wireless Installation of
Bell Atlantic Mobile of Mass. Corp.Ltd. dib/a Verizon Wireless at
401 Andover Street, Map 24, Lot 33.
Dear Members of the Planning Board:
Since 2005 Bell Atlantic Mobile of Mass. Corp. Ltd. d/b/a/Verizon Wireless
("Applicant") has operated a Wireless Service Facility at 401 Andover Street,Assessor's
Map 24, Lot 33 ("Subject Property"). The installation consists of internal radio equipment
cabinets and twelve(12) panel-style antennas hidden behind a parapet wall on the roof of
the office building situated on the Subject Property, Because this site is integral to
Verizon Wireless basic network coverage in the area, the Applicant hereby respectfully
requests the renewal of its previously granted Special Permit so that the facility may
continue to operate as it has for the past several years.
Section 8.9(12) of the Town of North Andover Zoning Bylaw("Bylaw")provides a three
(3) year term for wireless Special Permits, which may be renewed as needed. Section
8.9(5)(b) of the Bylaw "strongly encourage[s]" pre-application discussions with the
Board prior to filing. And Section 8.9(5)(d)(ix) of the Bylaw allows the SPGA(Planning
Board)to waive various filing requirements if"such information is not neededfor a
thorough review of[the petition]".
The Board may recall that on March 15,2011 the Applicant appeared before the Board to
discuss its intention to "swap out" certain antennas. That p'ropose'd activity was deemed
minor and did not require any formal Planning Board filing, but at the end of that meeting
discussions ensued relative to what information, if any, the Board would require for the
Special Permit renewal applications that would be submitted later. A list was verbally
provided and the Applicant made note accordingly. It is the Applicant's position that the
March 15th meeting satisfied the "pre-application" requirement, and the list of required
information provided supports the Applicant's request for waivers from supplying
additional information "not needed for a thorough review" of this simple renewal.
