Release of Tree Performance Guarantee
Dear Mr. Maylor:
In the late 1990's, Toll Brothers developed the "North Andover Estates" subdivision, which
included the streets of Rosemont Drive, Wild Rose Drive, Holly Ridge Road and Ridge Way.
The subdivision was completed to the Town's satisfaction, as evidenced by release of all
bond monies (except a Tree Performance Guarantee) and acceptance of the roads. The roads
were granted to the Town by deed, which were recorded at the North Essex Registry of Deeds
in 1999 (attached).
The Tree Performance Guarantee, in the amount of$6000, was to be held for two years to
guarantee survival of the street trees within the subdivision. The 2-year period ended in 2002
and the bond has still not been released.
Toll Brothers respectfully requests the release of this Tree Performance Guarantee.
