Re: Regency Place—request for waivers from PRD requirements
Dear Board Members:
The plan application we have developed for Regency Place includes two requests for
variances from the requirements of a PRD. Section 8.5.7.D. Dimensional Regulations:
Subdivisions limit building heights to 30 feet and require a 50 foot wide buffer strip
around the borders of the parcel.
The building height in all single family residential districts in North Andover is 35 feet
and two and one half stories. Restricting the height to 30 feet makes designing houses
difficult and designing to work with the natural grade of the land more difficult. For
instance a two and one half story house on a sloping lot with a drive under garage cannot
meet the 30 ft height restriction. We request that the Board approve a waiver to allow for
a building height of 35 feet.
We are requesting that the 50 ft buffer zone requirement be waived for lots 1,2 and 3.
The proposed lots 1,2, and 3 abut an 80 ft wide strip of land that was formerly a railroad
bed. The center of the rail line is raised and drops off 6 to 8 feet before rising in grade
towards the lots. There is a 20 ft wide sewer easement along the property line dividing
the lots from the railroad bed extending into the lots.
The residential property behind Lot 1 on the other side of the railroad bed is 50 Keyes
Way. Lot 1 is opposite the backyard of that lot and the proposed house on Lot 1 will be
over 200 ft from the existing house at 50 Keys Way.
The existing house is located on what will be Lot 2 and is about 100 ft from the house on
50 Keyes Way. The proposed house on Lot 2 will be over 160 ft from the house at 50
Keyes Way
Lot 3 is opposite the Keyes Way cul-de-sac and a portion of the property for 30 Keyes
Way. The proposed house on lot 3 will be 300 feet from the house at 30 Keyes Way. As
shown on the plan a berm with trees planted in it will be constructed 25 feet into the lot.
The distance from the center of the berm to the property line of the Keyes Way property
will be 105 feet.
The information presented above in support of the waiver shows that

1. There is an 80 ft wide property between Keyes Way and the proposed Regency
Place which acts as a natural buffer
2. The development of the property will increase the distance from the house at 50
Keyes Way to the nearest neighboring residence.
3. A berm and plantings will be constructed on Lot 3 Regency Place which will be
105 feet from the Keyes Way property line to provide additional privacy to the
residents at 30 Keyes Way.
