LICENSING COMMISSION MINUTES May 15, 2018
CALL TO ORDER: Chairman Richard Vaillancourt called the meeting to order at 5:35PM in the Town
Hall Meeting Room.
ATTENDANCE: The following were present: Licensing Chairman, Richard Vaillancourt, Phil DeCologero,
Regina Kean, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor, Assistant Town Manager,
Ray Santilli and Executive Assistant, Laurie Burzlaff. One member of the public was in attendance.
PLEDGE OF ALLEGIANCE
COMMUNICATIONS AND ANNOUNCEMENTS:
Acceptance of revised Alcoholic Beverages Regulations to include Farmer-Winery Pouring Permit
Town Counsel added language to the Alcoholic Beverages Regulations to address Farmer-Winery
Pouring Permits, which are currently not mentioned the regulations.
Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting
as Licensing Commissioners, adopt the revised Alcoholic Beverages Regulations as presented.
Motion approved 5-0.
Establish fee for Farmer-Winery Pouring Permit
The Board must adopt a fee for the Farmer-Winery Pouring Permit. Town Counsel suggested that since
these are regulated in the same manner as the restaurant on premise licenses, it would make sense that
ant-Wine & Malt on premise license is $2,000.
Selectwoman Smedile suggested a fee of $1,000. Selectwoman Kean suggested a fee of $2,000.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting
as Licensing Commissioners, set the fee for Farmer-Winery Pouring Permits at $1,500. Motion
approved 3-2. Selectwomen Smedile and Kean opposed.
Request of Jager Enterprises Co., d/b/a The Wine Lab for a Farmer-Winery Pouring Permit, Common
Victualler and Entertainment licenses
Ry-Crow was present to explain his requests for licenses for The Wine Lab opening at the
mills on High Street.
Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen,
acting as Licensing Commissioners, approve the Farmer-Winery Pouring Permit, Common
Victualler and Entertainment license applications of Jager Enterprises Co., d/b/a The Wine Lab.
Motion approved 5-0.
Request of Nichols Rocco and Katelyn McCarthy for a one day all alcohol liquor license for a wedding
reception in the tent at Smolak Farm on June 9, 2018 from 4:00PM-10:00PM
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen, acting
as Licensing Commissioners, approve the one day all alcohol liquor license of Nichols Rocco and
Katelyn McCarthy for a wedding reception in the tent at Smolak Farm on June 9, 2018 from
4:000PM-10:00PM. Motion approved 5-0.
Request of Paul Gallant of Merrimack College for seven one day liquor licenses for the following events:
Community Engagement Conference Reception at the Rogers Center on May 29, 2018 from 5:00PM-
9:00PM (wine and malt)
Warrior Welcome Back Celebration at the Stadium Viewing Platform on June 1, 2018 from 6:00PM-
11:00PM (all alcohol)
Leadership Appreciation Reception at the Volpe Lobby on June 1, 2018 from 5:00PM-8:00PM (all
alcohol)
Class Dinner at the McQuade Library on June 2, 2018 from 6:00PM-10:00PM (all alcohol)
All Reunion Class Reception at the Crow Hall Patio Tent on June 2, 2018 from 5:00PM-11:00PM (all
alcohol)
Golden Grad Luncheon at the Rogers Center on June 2, 2018 from 11:00AM-3:00PM (all alcohol)
Warrior Family BBQ at the Sakowich Patio on June 2, 2018 from 11:00AM-3:00PM (wine and malt)

Phil DeCologero made a MOTION, seconded by Regina Kean that the Board of Selectmen, acting
as Licensing Commissioners, approve the seven one day liquor license requests for Merrimack
College as presented. Motion approved 5-0.
ADJOURNMENT:
Chris Nobile made a MOTION, seconded by Phil DeCologero to adjourn the meeting at 6:00p.m.

CALL TO ORDER: Chairman Phil DeCologero called the meeting to order at 6:15PM in Room #1064 at
the North Andover High School.
ATTENDANCE: The following were present: Chairman Phil DeCologero, Clerk Regina Kean, Licensing
Chairman, Richard Vaillancourt, Rosemary Smedile, Chris Nobile, Town Manager Andrew Maylor,
Assistant Town Manager, Ray Santilli and Executive Assistant, Laurie Burzlaff. One member of the public
was in attendance.
PLEDGE OF ALLEGIANCE
APPROVAL OF MINUTES:
Chris Nobile made a MOTION, seconded by Regina Kean, to approve the Open Session Minutes of
April 30, 2018 as presented. Motion approved 5-0.
COMMUNICATIONS AND ANNOUNCEMENTS:

Included in the packets was the schedule for the remainder of the year.

Chris Nobile announced that they are close to finding a sponsor for the 4 of July road race.
Richard Vaillancourt announced that sheep shearing is this weekend.
CONSENT ITEMS:
Approve Town Manager appointment of Daphnee Alva to the Board of Health
The Town Manager provided the Board with the resume for Daphee Alva who he will be appointing to the
Board of Health.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of

Request of Ashley Vaillancourt to use the Town Common for a free summer fitness series on June 7,
2018 from 6:00PM-7:00PM and June 9, 2018 from 8:00AM to 9:00AM
Ashley Vaillancourt explained her proposal to use the Town Common for a free summer fitness series on

Tuesdays, Thursdays and Saturday from June 7 through August 30th. All relevant departments have
reviewed and have no issues. The Board discussed having the series be a Town event.
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen make
the proposal of Ashley Vaillancourt to use the Town Common for a free summer fitness series as
a Town sponsored event. Motion approved 5-0.
Vote to approve Paid Volunteer Time Off Program
Included in the packets was a memorandum from Town Manager, Andrew Maylor, explaining the new
Paid Volunteer Time Off Program for exempt employees.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen
approve the Paid Volunteer Time Off Program for exempt employees, as presented. Motion
approved 5-0.
Request of Stephanie and Chris Sullivan to use the Town Common for a birthday party on June 1, 2018
from 5:30PM to 8:00PM

Stephanie and Chris Sullivan submitted a request to use the Town Common on June 1 from 5:30PM-

8:00PM for a 16 Birthday party. All relevant departments have reviewed the request and have no issues.
Rosemary Smedile made a MOTION, seconded by Chris Nobile that the Board of Selectmen
approve the request of Stephanie and Chris Sullivan to use the Town Common for a birthday party
on June 1, 2018 from 5:30PM-8:00PM. Motion approved 5-0.

Warrant Article votes (if necessary)
The Planning Board voted favorable recommendation on Article 29 (Solar energy bylaw) at their meeting
just prior to Town Meeting. The Board discussed whether they wanted to make a recommendation but
noted they were not provided the final version of the Article.
Chris Nobile made a MOTION, seconded by Regina Kean that the Board of Selectmen take no
action on Article 29. Motion approved 5-0.
Vote to recess and reconvene in auditorium for 2018 Annual Town Meeting
Regina Kean made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen
recess and reconvene in the auditorium for the 2018 Annual Town Meeting. Motion approve 5-0.
ADJOURNMENT:
Chris Nobile made a MOTION, seconded by Regina Kean to adjourn the meeting at 9:51p.m.
