Goldberg Chairman: The Planning Board meeting for Tuesday, May 1, 2018 was called to order at 7 p.m. 7 8 EXECUTIVE SESSION: (7:02)M.G.L. Chapter 30A, §21(a)-reason#3 to discuss strategy with respect to f 9 litigation;Varsity Wireless v..North.Andover Planning Board. 10 MOTION: J. Simons made a motion that the Board go, into Executive Session for confidential communications to 11 discuss confidential litigation strategy within the case of Varsity Wireless v.North Andover and that the Chair f 12 declared an open meeting would be detrimental to the Town's litigation strategy. {open Session to reconvene at the 13 conclusion of the executive session. J. Luz seconded the motion. 14 Roll Call vote: J. Simons voted to go into Executive Session. J. Luz voted to go into Executive Session.A. 15 Preston voted to go into Executive Session. E. Goldberg voted to go into Executive Session, P.Boynton voted to 16 go into Executive Session. 17 18 (Open Session reconvened at 7:27 p.m) 19 NEW PUBLIC HEARING: Beechwood Drive-Modification to Definitive Subdivision.,(Parcels 031.0-005. 20 034.0-0051 & 034.0-0006)Albacado Ltd Partnership Application for a Modification to a 3-Lot Definitive 21 Subdivision Plan issued August 2, 1994. The Applicant proposes to modify the 3-Lot Definitive Subdivision 22 Notice of Decision to remove Condition 3A requiring Site Plan Review Approval for individual lots prior to any 23 lot release. 24 25 M. Gregoire: This was before the Board last July as a request for an Insubstantial change.The Board deemed this 26 was not Insubstantial change and thus this hearing was scheduled to modify the original decision notice from 27 1994; a three lot subdivision of land referred to as Beechwood Dill Estates. A form J releasing Lot 2 was recorded 1 28 in 1996. A Special permit/Site Plan Review was approved for the construction of a 30,000 SF building in 1996. 29 The roadway has been accepted; all bond monies were released several years ago. 30 MOTION: A. Preston moved to close the public hearing for the Modification to Definitive Subdivision to j 31 Beechwood Drive,North Andover MA,J. Luz seconded. The vote was 5-0,unanimous in favor. 32 MOTION: J. Simons made a motion to approve the Modification to Definitive Subdivision Modification for 33 Beechwood Drive, North Andover MA,as amended. P.Boynton seconded. The vote was 5-0, unanimous in favor. 34 35 NEW PUBLIC HEARING: 35 Dale Street: SP: Application for a Watershed Special Permit under Sections 36 4.136, 10.3 and 10.31 of the North Andover Zoning Bylaw.The Applicant proposes the installation of an above 37 ground pool with soil cutting and tree removal within the Non-Disturbance and.Non-Discharge Zones. The project 38 is located within the Residential 1 (R-1)Zoning District. 39 M. Gregoire: The application has been reviewed by Health,Police and Fire. They have no issues. Conservation. 40 has questions regarding tree removal and the type of back flow filter being used.Peer review asked similar 41 questions and is their review is ongoing. 42 Jay Henshall, Gibraltar Pools: The owner is aware of the environment and has selected the least disturbing pool 43 design which is substantially more expensive. Many of the trees are dead and a lot are unhealthy. There is no discharge to the filtration system;the pool holds 12,600 gallons. To drain to a level 45 of concern in an event, 14-1600 gallons would be involved. We are not touching anything outside the fence. 46 Bryan Parmenter,PLS,PFS Land Surveying Inc.: Explained siting of the pool based on minimizing general 47 disturbance. The structure is 55-58 feet from the wetland. 48 (Photos of the existing property were displayed showing existing fencing.) 49 J. Enright: The entire project is within the non-disturbance zone;the limit of work, grading piece is approx. 35 ft. 50 from the wetland. 51 M. Gregoire: This is going before the ZBA requiring a variance as a structure in the watershed, Conservation is 52 still open. Our peer review consultant presented another location for the structure on the site which would not 53 require tree removal. 54 J. Henshall: Disagreed with the proposed location due to more disturbance, cutting and filling. Will respond to the 55 peer review discussion regarding pool placement. 56 [Continued to the Jure 5, 2018 Planning Board rneetingl 57 58 DISCUSSION 59 Housing Production Plan, 60 J. Enright: Supplemental material includes MA.PC study as well as school enrollment data from the School 61 Department was included in the packet, Spoke with School Department and here is a greater concern that a lot of 62 development within one area that effects enrollment at a single school. Development is less of a concern when it. 63 is spread out. Housing units that have not yet been constructed are included in the projection modeling. The goals 64 stated in the document are in sync with the Master Plan. 65 The Board: Discussed community concern regarding school enrollment,clustering of development and having a 66 wide range of housing options in the downtown. 67 Angela Cleveland MVPC: This Plan should be reassessed after the 2020 census data is released. Senior and 68 disabled housing strategies are both reflected in the plan. There is not a lot of information on the needs of 69 homeless Veterans in this region. Veteran's needs will be addressed directly with the Veterans agent. Adopting 70 this plan will act as a guidepost, empowering the town in the future particularly with regard to the state in terims of 71 accepting and/or potentially denying a prospective project. 72 The Board: Discussed purpose of the document and that the strategies listen within can be used to identify 73 location of development or be used to deny a project if the town reaches ten percent. Board added goal of 74 identifying Veteran's needs. 75 MOTION: J. Simons moved to adopt the NA Housing Production Plan, as amended, and to make a 76 recommendation to the Board of Selectmen.P.Boynton seconded the motion. Goldberg: Presented edits to the draft solar by-law, Board discussed principal and small scale accessory use in 97 residential and business areas and the appropriateness of requiring Special Permit,omitting pole mounted solar; 15 98 ft, height ground mounted restriction was determined. Size of roof mounted solar,(small and large scale)was 99 discussed; confirmed 2 ft. rooftop height restriction-residential and commercial and changed"solar energy 100 system"to "solar energy collector." Clarification of waiver provision for submittal and design requirements. 101 Definitions not referenced to be omitted.; linalizcd definition of"surface area". Solar chart to be updated to omit 102 pole mounted. Revised purpose paragraph to omit word "restrict."Front yard installations to go before Zoning. 103 Setbacks were addressed.
