May 23, 2018

Meeting came to Order at: 7:04 pm Quorum Present.

A motion to accept the minutes of May 9, 2018 as reviewed and amended is made by Ms. Feltovic,
seconded by Mr. Lynch.

Small Project
NACC #212, 63 Crossbow Lane (Duffy) Enforcement Order/Violation
Sean McDonough and Albert P Manzi Jr. arrive at the meeting 7:07pm
The Administrator reviews the project request for the proposed installation of a new shed. This
project would be done under a small project L request.
for the beach/sand
area on this property.
The Administrator is reviewing the Enforcement Order and Small Project timeline.
Mr. Manzi questions the Administrator if this project for the beach/sand area or this type of project
would ever be permit-able with regard to the Conservation Commission.
The Administrator states that the area is in flood zone and that this type of project would not be
allowed in the no-disturb zone.
Mr. Lynch is questioning the merits of having the shed as a small project and then having the beach
and the old shed under an enforcement order.
The Commissioners are discussing the order in which they would like the enforcement order and the
restoration to happen then have the applicant apply for a small project after the restoration is
complete.
A motion to amend and ratify the enforcement order and restoration plan for the site applicant to
appear at the June 13, 2018 meeting, made by Mr. Manzi seconded by Ms. Feltovic

The Administrator reviews the project request to install a fence to enclose the rear yard of the
property.
Mr. Gagne, owner states that the project is to have a vinyl fence facing the front of the house and a
rolled metal fence along the side and back.
Mr. Lynch questions if there will be any tree removal.
The Administrator states that no trees will be removed.
Mr. Napoli gives the owner a brief history on the home and its location.

The administrator states that 2 Wetland Flags needed to be adjusted and that the adjustment of the two
flags causes the addition to be within the 100 foot buffer zone
Mr. McDonough asks what disturbance will happen within the 100 foot buffer zone.
Ms. Favorat, the owner of the property states that the driveway will be utilized for storage and for the
dumpster area.
The Administrator discusses with the Commission the reasons for the project under the small project
category.

The Administrator reviews the project with the Commission regarding the filing for connection to
Town Sewer with an after the fact filing for the removal of the tank.
T.J Melvin, Christiansen & Sergi is here on behalf of the owner Cheryl Fitzpatrick, The existing oil
tank has been removed and the subsequent closure report has been submitted, monitoring is ongoing
with the latest report showing that none of the levels exceed the standards as required. The proposed
project is to connect to the Town sewer by directional drilling under route 114 and connect into a
manhole on the other side of route 114.
Mr. Melvin states that a pit/ramp will be dug approximately 6 feet deep which allow the drilling
machinery access under the roadway in order to facilitate the direct drilling for this project. There will
also be a section of forced main proposed along the front of the property tying into an environmental
lawn injector pump that will be used to pump the sewerage into the Town sewer system. The current
septic system is in the front of the home, parts of which may be encountered during this project and
will be removed and disposed of as required. The existing septic tank will have to be either removed
or pumped, ruptured and filled with sand as required by Title V. There is a siltation barrier prosed
along the up gradient side of the driveway. The soil stockpiling along with a dewatering area, and the

direction drilling pit/ramp area are all shown on the plan. All disturbed areas will be loamed and
seeded.
Mr. Lynch asks about the direction drilling proposal and how the site will be accessed in regard to the
utilities.
Mr. Melvin states that the project manager
Mr. Lynch has concerns about the need for this project to utilize the easement on another's
property.
Mr. Lynch would like more information on the proposal in regard to the proposed sewer tie in and the
methods that will be used as well as the erosions controls that are being proposed.
A motion to continue until the June 13, 2018 meeting is made by Mr. Manzi seconded by Mr. Lynch.

The Administrator reviews the proposed project history with the Commissioner's.
T.J Melvin, Christiansen and Sergi on behalf of the owners states that the waivers have been
approved at a prior meeting. Mr. Melvin discusses with the Commission the changes that have been
made to the project which includes reconfiguring the house to have a garage underneath and moved
the home slightly forward conform to zoning setbacks. The planting area and list have now been
added to the plan and the rock wall has also been added.
A motion close the public hearing and issue an Order of Conditions within 21 days is made by Mr.
Manzi, seconded by Ms. Feltovic

The Administrator gives a brief review of the proposed project.
Dennis Griecci, Andover Consultants; discusses the Vernal Pool Survey letter prepared by Dan Wells.
The Administrator reviews the Survey letter and the Ephemeral Pool setbacks with the
Mr. Manzi states that the analysis shows that there is one Ephemeral Pool and one that is not an
Ephemeral Pool.
There is discussion amongst the Commission regarding the Ephemeral Pool survey letter and waiver
requests.

Mr. Brian Vaughan, Smolak & Vaughan is here on behalf of the owners Mr. Donovan of the property
speaks to the reasons behind the request and the background on the proposed project.
The Commission and the Administrator are discussing the need for the waivers and the possibility of
redesigning the proposed project due to the Ephemeral Pool B setbacks and the not as stringent
setbacks for the Ephemeral Pool A with regard to the location of both homes and septic systems.
The Administrator clarifies that an A&R for the lot line changes has not been approved.
Attorney Vaughan states that they would like continue until the June 13, 2018 meeting to look at
making changes to the plan based on t
Elsie Pouliot owner 595 Boxford Street would like to know when the revised plans would be
available to review.
Chris Coulouras, owner 525 Boxford Street would like to know why an alternative analysis for one
home is not being submitted.
Mr. Napoli states that the applicant has applied for two homes and that is what the request is for.
Mr. Coulouras states that the Conservation Administrator mentioned at the March 28, 2018 meeting
about moving the driveway to the other side.
Mr. Griecci states that the applicant will look into putting the garages under the proposed homes and
the driveways to the other side.
Mr. Lynch states that an alternatives analysis can be done now that the Ephemeral Pool information
has been done.
Elsie Pouliot states that there are concerns about flooding and the maintenance of the culverts on the
sides of the street.

Mr. Manual states that the entire ground disturbance footprint would be 212 square feet.
Mr. Lynch and Mr. McDonough ask about encroachment into the Wetland.
The Administrator states that the fence is inside the Wetland and would like to see the fence moved
out of the Wetland.
The Commission and the Administrator discuss the potential need to move the fence.
Mr. Manual states that the owners would like the fence to remain.
