Lynch, Jr., John T. Mabon and Douglas W. Saal. Members Absent: Sean F. McDonough, Albert P. Manzi, Jr. Vice Chairman and Deborah A. Feltovic Staff Member Present: Jennifer A. Hughes, Conservation Administrator and Savannah McInvale Conservation Field Inspector. Meeting came to Order at: 7:05 pm Quorum Present. Pledge of Allegiance Acceptance of Minutes  Chairman Louis Napoli states that the minutes are not ready and will be presented at the July 11, 2018 meeting for approval. Request for Determination of Applicability 707 Turnpike Street (Caffrey) (Christiansen & Sergi)  The Administrator gives some background on the proposed project and the changes that have been made to the plan including additional dewatering control measures.  TJ Melvin (Christiansen and Sergi) speaks on behalf of the applicant; test pits and measurements on the monitoring well have been done and show the water table at approximately 6 ½ feet down.  Mr. Lynch questions the location and measurements of the water table on the opposite side of the street.  Mr. Melvin states that the dewatering pit has been increased by approximately 50% and the applicant would prefer not to drive the metal sheeting.  The administrator would like daily monitoring during construction of the project.  Mr. Lynch clarifies the amount of time needed to complete the driving of the dig, clarification on pre- and post-construction.  Mr. Melvin states that there is a swale on the opposite site of the street and water could be directed that way,  The Administrator asks if this would be in the right of way of the street.  Mr. Napoli has concerns regarding the dewatering of the project and would like clarification on the location of the test pit.  Mr. Melvin gives Mr. Napoli an explanation of the test pit location.  A motion to issue a Negative Determination #3 with pre and post construction with monitoring during dewatering is made by Mr. Lynch, seconded by Mr. Saal.  4-0 unanimous Documents  Sewer Repair Plan prepared by Philip Christiansen dated 04/16/2018, revs. 06/05/2018, 06/13/2018, 06/25/2018 29 Blue Berry Hill Lane (Givner)  The administrator reviews the project request with the Commissioners.  Mr. Givner, owner of the property, is here to discuss the proposed project, which consists of rebuilding the deck and an expansion of 30 square feet.  Mr. Mabon asks what is currently under the deck and if the deck framing is being replaced.  Mr. Givner states the there is a loose brick patio and the whole deck is being rebuilt. The patio will remain.  A motion to issue a Negative Determination #3 with post construction is made by Mr. Mabon seconded by Mr. Lynch. Documents  Typical Gas Main installation under Culvert Drawing  Dirt Bag Detail Drawing  Dirt Bag Data Sheets  Photo’s 1-3 Fuller Rd, Meadowview Rd, Woodcrest Dr. & Village Way (Verizon)  Savannah McInvale, reviews the proposed project with the Commissioners.  Joe Callahan with ES&M speaks on behalf of Verizon, states that this project is for the installation of FiOS cabling.  The Administrator states that with erosion controls and catch basin protection, it seems approvable.  Mr. Lynch asks if the proposed project is on the same side of the street as the current underground utilities.  Mr. Callahan states that this is new additional cabling and will be located on the same side of the street as current utilities.  Mr. Napoli asks how far down the cables will be installed.  Mr. Callahan states that cables will be 18 inches down.  Mr. Mabon asks if all work to be conducted within the paved areas.  Mr. Callahan states that yes all paved roadways except one portion of existing driveway.  Mr. Napoli would like to see a construction sequence for this project.  A motion to issue a Negative Determination #3 with a construction sequence, pre and post construction is made by Mr. Lynch seconded by Mr. Mabon.  Vote 4-0 unanimous. There is a brief summary on the drawings describing the changes that have been made; Mr. Greicci adds that a stonewall can be included in this plan.  Mr. Greicci states that the second alternative would require the applicant to go back to the ZBA for variance requests.  Mr. Greicci requests feedback from the Commissioners.  Mr. Lynch questions if the applicant is willing to build one of these three alternatives.  Mr. Greicci states that yes, the applicant is willing to build one of these alternatives if acceptable to the Commission.  Mr. Mabon states that both buildings are within the 75-foot no-build zone.  The Administrator reviews the proposed project with the Commissioners.  Mr. Napoli would like a wall to be at the 50 foot no-disturb line.  There is discussion about the locations of the driveways and the deck on lot two.  Mr. Greicci states that due to the elevations on the site, moving the driveway to the other side would be difficult.  The Administrator and the Commissioners discuss the locations of the septic system and the driveway concerning the ephemeral pools and buffers zones.  Mr. Lynch expresses concerns about the number of waivers requests and discusses the potential of having one building on three lots compared to two buildings on two lots.  Dan Wells, a Wetland Biologist, has been doing amphibian work in Massachusetts for almost 20 years. He is here on behalf of the applicant and speaks about the species on the property and their habitats. Mr. Wells states that two spotted salamander egg masses where found in Ephemeral Pool B.  Mr. Mabon asks if any wood frogs were found.  Mr. Wells states that no wood frogs were found in either pool. Mr. Wells attests that the pools are not certifiable under the state but under the Local bylaw they would be considered ephemeral pools.  Mr. Wells states that spotted salamanders tend to use forested areas, this location is on a busy street and species would tend to stay away from the road and the open grassy areas.  Mr. Wells states that natural heritage mapping does not include this property as priority habitat.  Mr. Napoli requests that the alternatives plan is revised.  The Administrator expresses concerns regarding the septic systems and the driveway locations.  Mr. Greicci states that the alternatives analysis plans can be redone.  Mr. Saal would like clarification of the breeding grounds and where the wall should be at the 25 or the 50?  Mr. Wells believes the mapped location for the wall is sufficient.  A motion to continue until the July 11, 2018 meeting is made by Mr. Mabon and seconded by Mr. Lynch.  Vote 4-0 unanimous. Documents  Alternatives Analysis 1-3 prepared by Dennis Greicci Andover Consultants dated 06/27/18 242-1735, 1429 Osgood Street (Oliver Enterprises) (Allen & Major)  The Administrator reviews the proposed project with the Commission.  Bridget Sousa, Allen & Major Associates, speaks on behalf of the owners Oliver Enterprises. She states that the plan and site layout have been redesigned.  Rain garden information has been submitted to the peer reviewer. Comments from the peer review state that applicant should change some of the existing catch basins. Another comment was to prepare a SWPPP. Normally this is done later in the process. A rain garden was added to the plans and a materials storage area was moved out of the No-Build zone. Sand and loam will be kept out of the buffer zone. Curbing has been added. A new O&M has also been submitted.  Mr. Lynch confirms that a final revision plan set would be needed. Mr. Lynch questions what was found today during the soil tests at the site?  Ms. Sousa states findings; that the soils in the area for the septic system were not ideal they were mostly silt.  Mr. Napoli would like to know the location of the snow stockpiling area? He asks if the slab at the back of the building will be removed.  Ms. Sousa states snow may need to be removed from the site. She states that issues will be discussed with the owner.  A motion to continue to the July 11, 2018 meeting made by Mr. Saal seconded by Mr. Mabon.  Vote 4-0 unanimous. The owner would like to defer the EO until next year.  The Administrator recommends April of 2019.  Mr. Napoli states that no action will be taken by this Commission on this violation before the hearing in April.  The Commission finds no issue with the request to continue.  A motion to continue to the July 11, 2018 meeting made by Mr. Lynch seconded by Mr. Mabon.  Vote 4-0 unanimous General Business 242-1045, COC Request 675 Chickering Road (430 Osgood Street) (NA High School) (DGT Associates)  The Administrator reviews the project with the Commissioners.  Jim Mealey introduces himself as the NA Public Schools Assistant Superintendent in Finance.  Fred King DGT (Scholfield) states that when this project was closing out the contractor was required to provide a surveyed as-built of the property; this was not completed in entirety.  Mr. King states that Savannah McInvale requested a copy of the plan drawings to original scale.  Mr. King states that two reports have been filed for this project.  There are three sheds and a gravel area to the South of the fields, which were not permitted under this project and are located within the wetland buffer.  The replication areas look good and thriving.  The marker posts, snow-stockpiling signs, and some of the bird feeders are missing from various locations.  Grass is being mowed inside the 25 foot no-disturb area near the tennis courts.  The construction fencing on the east side of the project was never removed.  The Administrator states that the contractor was looking to receive the bond money back a few years ago. She states that the catch basins need to be maintained and the sheds need to be permitted as a starting point.  Mr. Saal states that there is equipment in the woods that needs to be removed.  Mr. Lynch is concerned about the project and what is still incomplete. Would like to seize the bond to have the work done on the site and produce the final as-built. Mr. Lynch would like the Administrator to meet with the Superintendent to bring the site in to compliance.  Mr. Mabon does not believe the site is ready for a certificate of compliance and would like to see the site brought up to compliance. Mr. Mabon would like to know if the As-built provided would be able to be used to do a stamped as-built.  Mr. Mabon would like to see the sheds outside the 50 foot no-build zone.  A motion to continue to the August 22, 2018 meeting is made by Mr. Lynch, seconded by Mr. Mabon.  Vote 4-0 unanimous.
