The Health Department has previously documented chronic dampness issues in this building and as a result, the Health Department and Cornerstone Land Associates performed soil testing on lune 19, 2018 to determine the estimated seasonal high water table, the soil profile and any potential causes of the chromic dampness within this dwelling. I have reviewed and analyzed all the soil data from the test pits, soil logs and the USGS soil survey and determined that the source of the chronic dampness is groundwater infiltration and surface water penetration through the foundation of the building. The source of the chronic dampness within Unit 7-002, Unit 7-004 and possibly within other bottom floor units in this building is the infiltration of groundwater up into the subfloor and penetration of surface water through the foundation. According to the soil data obtained around Building hi 7� 7, the seasonal h water table ranges from 16"to 17" below grade. The g elevation of the fiiushed first floor in tl-is building is subterranean and within the range of the estimated seasonal high water table surrounding the building. Any other dwelling unit within Page 1 of 2 North Andover Health Depailment, 1600 Osgood Street, Suite 2035, North Andover, MA 01.845 Phone: 978.688.9540 Fax: 978.688.8476 this range will also be subject to groundwater infiltration, chronic dampness, poor indoor air quality and the proliferation of mold, mildew and fungi. The soil testing also revealed that the soil surrounding the subject building is extremely dense and very compact. This type of soil does not infiltrate surface runoff or rain water quickly enough and creates a perched water table and groundwater mounding around the subject building. Some of this water will infiltrate down through the less compact soil immediately adjacent to the foundation and will penetrate through foundation cracks and through holes created by the metal form ties that were left in place during construction. A comprehensive measure needs to be taken to alleviate the violation and be in compliance with the Order to Correct dated November 2, 2015 and March 6, 2018. One recommended option would be the installation of a perimeter drain to intercept rising groundwater and sealing the foundation walls to eliminate surface water penetration. The North Andover Board of Health hereby Orders that Royal Crest do the following: 1. Submit a Proposed Scope of Work and Signed Contract within Five (5) business days to the Board of Health for approval. The Proposed Scope of Work shall be to perform said work to alleviate the chronic dampness violation and must be approved in writing; 2. The work proposed is to be completed within Thirty (30) days of execution of said contract. Please accept this letter as the Owner's timely Appeal Petition and Request for Hearing pursuant to the MA Sanitary Code, 105 CMR 410.850(A), from the North Andover Board of Health's ("Board") Order to Correct dated July 5, 2018, served on July 9, 2018 ("Order"). The Board's Order alleges that a condition of"Chronic dampness" exists within Unit 7-002 and Unit 7-004 of the Property and orders that the Owner undertake a"comprehensive measure" including the installation of a perimeter drain and the sealing of the foundation to the entirety of Royal Crest Building No. 7. The Owner hereby objects to and appeals from the Order. The basis for the Owner's appeal of the Order includes, without limitation, the following: I. The moisture detected in Unit 7-004 several years ago was addressed by the Owner, and re-inspected by the Town, and a letter of compliance was issued on December 1,2015. The Owner is not aware of a further instance or observation of undue moisture in Unit 7-004 since that time. North Andover Board of Health July 16, 2018 Page 2 2. Following the observation of moisture in Unit 7-002, the tenant in residence at that time was voluntarily re-located and a substantial investigation of the moisture issue conducted. That investigation revealed that a ventilation duct had become disconnected in the living room ceiling causing an area of mold to form in that area. The apartment perimeter walls were opened to reveal the building foundation and to investigate for moisture behind the wallboard, as a possible source for other areas of surface mold in the unit. That extensive investigation, observed by Town inspectors, did not indicate that the foundation was the source of moisture or that any water intrusion or moisture existed behind the wallboard in the unit. This investigation strongly indicates that the disconnected vent(now repaired), insufficient use of the bathroom vent fan, insufficient use of the unit's air conditioning system, and/or other sources internal to the unit were likely the cause of the previously observed interior moisture in the unit. 3. The Town has thoroughly inspected Building 7, including all of the basement level units. Although the Order suggests that"chronic dampness" may exist "possibly within other bottom floor units", the Town's extensive inspection of the other bottom floor units has not revealed the presence of undue moisture in these other units. 4. The "comprehensive measure" demanded by the Order is excessive in the present circumstances, The only unit in which moisture has recently been detected, Unit 7-002, is presently unoccupied and readily available for further testing and inspection to confirm that moisture issues are no longer present. Would you please now schedule the Owner's appeal of the Order for hearing with the Board so that the Owner may more thoroughly present additional facts and information in support of its position and so that a more reasonable approach to the Board's concern for dampness of the bottom floor units of Building 7 may be discussed. (SWA)to perform a visual mold and moisture assessment in Unit 7-002 at the Royal Crest Estates apartment complex located at 50 Royal Crest Drive in North Andover,Massachusetts. The assessment was conducted hi response to suspected visible mold on various Building materials that had been reported by the tenant. Eric Hanson,SWA`s Certified Indoor Environmentalist,performed the assessment on March 14, 2018. Because elevated moisture is one of the leading causes of fungal amplification, contributes to the destruction of indoor building products,and can lead to the deterioration of buildings,SWA conducted testing of the gypsum wallboard, wooden baseboard, and ceilings in the living room and bedrooms using a Protimeter Surveymaster moisture meter. This conductance type meter'combines a conventional two-pin inspection mode with a non-invasive radio frequency device enabling the consultant to assess moisture conditions not only on a component surface,but also at depth quickly and non-destructively. The radio frequency search anode uses a color-coded LED scale to identify degrees of dampness below the surface, In this mode the instrument employs radio frequency emissions (RFE) to measure moisture through most wall and floor coverings, including ceramic tiles. Observations The space was clean and dry,and no musty odors or signs of active water intrusion were detected,however, several areas (bedrooms,living room, and hallway)exhibited potential visible mold on walls and ceilings. It is not always possible to verify that mold is present on a surface or in the air without testing; therefore, testing would be required to confirm or deny the presence of mold in Unit 7-002. Moisture readings were taken in both the two-pin and RFE modes. The living room ceilinp, and the second bedroom wall returned results in the damp range (see pictures in Appendix A), It is recommended that the gypsum wallboard be removed in these locations to determine the source of the moisture. The hallway ceiling should also be removed. Moisture readings in the hallway were in the dry and borderline ranges,but there is significant discoloration on that ceiling so that a further investigation is warranted. All other readings were in the "Dry" range, which indicates an air dry state and one not generally conducive to mold growth.
