Devlin, and Arlene Curran, husband and wife, of 175 Salem Street North Andover, MA Grant the following RESTRICTIVE COVENANT to the Town of North Andover Upon the property located at 175 Salem Street, North Andover, MA bounded and described as follows: The site refers to the approximately one acre parcel of land on a portion of Assessors Map 37D, Parcel 19,also known as 175 Salem Street, North Andover, MA.,and referring to plans prepared by Sullivan Engineering Group, LLC and entitled "175 Salem Street Plot Plan of Land located in North Andover, MA(Essex County, Northern District)",dated February 13,2017 and revised to June 27,2017 regarding the construction of a 576 square foot garage and small extension of the existing paved driveway within the non-discharge zone. 1. Peter P. Devlin and Arlene Curran specifically state that fertilizers shall be limited to those which are either organic or slow-release nitrogen and phosphorus-free, non- organic pesticides and herbicides use are prohibited, and the use of coal tar-based pavement sealants are prohibited. 2. This restrictive covenant as used herein, applies to the above-referenced property conveyed by deed dated June 11, 1996 and recorded with the Essex North Registry of Deeds in Book 4520, page 151. 3. This restrictive covenant shall remain in effect for the maximum period permitted under Massachusetts law, unless sooner amended or terminated by consent of the appropriate entities of the town of North Andover, and shall run with the land and inure to the benefit of the inhabitants of the Town of North Andover and shall bind owner and its heirs, devisees, legal representatives and successors.
