HEARING: 26 Main Street, Application for Special Permit-Site Plan Review. Applicant proposes construction of an eight (8) unit residential condominium project with two (2) parking
spaces per unit on a lot with access to Main Street via existing easements on two (2) existing lots fronting Main Street at 22-24 and 28-30 Main Street and an existing curb cut at the
noted lots.
J. Tymon: Updated plans that show the access and egress more definitively, existing parking, and signage have been submitted. There have also been changes made related
to stormwater management. A set of elevations have been submitted as well as an updated landscaping plan. A comment letter from Lisa Eggleston was received today.
T. Seibert:
Read an email sent from John Cusack (28-30 Main Street) to the Planning Department on May 1, 2012.
Dominic Scalise, Representing the applicant: The applicant has had meetings between
Jeffco and Mr. Cusack and many issues have been resolved. An agreement letter has been presented to Mr. Cusack, however, he has not signed it yet.
Bill MacCleod, Andover Consultants:
The concerns of the Civil Engineer peer review have been addressed. Remaining are some minor issues from the stormwater peer review. All of the revisions requested by the Town staff
have been addressed. Displayed and reviewed four renderings of the proposed building, site plan, and traffic patterns.
J. Tymon: The Fire Department has not commented on the plan
yet. They wanted to see the traffic pattern and parking on the plans prior to submitting their comments. J. Cusack will be contacted and informed that the next Planning Board meeting
will be held on May 23rd.
CONTINUED PUBLIC HEARING, 70 Elm Street: Application for a renewal of a Wireless Special Permit for the operation of an existing wireless communication facility
within the
Residential-4 (R-4) Zoning District under Sections 8.9 and 10.3 of the North Andover Zoning Bylaw.
T. Seibert: Recused himself.
J. Tymon: This is a renewal of a Special Permit that
was granted in 2009, not a modification. An opinion letter was received from Attorney Peter Morin, representing the applicant, regarding the pending case with Regis College that was
mentioned by a member of the public. The attorney for the applicant contends that it is irrelevant to this application.
Peter Morin, Summarized the dispute between Regis College and
the Weston Zoning Board of Appeals and the appeal that was filed with the Supreme Judicial Court by Regis College.
MOTION
A motion was made by M. Colantoni to close the public hearing
for 70 Elm Street. The motion was seconded by D. Kellogg. The vote was unanimous 3-0. Voting in favor were D. Kellogg, M. Colantoni, and J. Simons.
J. Tymon: L. Rudnicki can not
vote on this application. The vote will have to wait until the next meeting.
B. McQuade, agent for Metro PCS: Stated he would not be able to attend the next meeting.
J. Simons: No
new comments will be heard at the next meeting and attendance will not be necessary.
CONTINUED PUBLIC HEARING, 358 Dale Street: Application for a Watershed Special Permit. Applicant
seeks to construct a new single family residential dwelling along with associated driveway, landscaping, utility and other improvements.
J. Tymon: A draft Decision has been prepared.
L. Eggleston has requested a landscape plan be submitted and that requirement has been conditioned in the Decision.
J. Simons: Requested a summary of the dimensions from wetlands.
J.
Tymon: The proposed structure is within the non-discharge area because it is outside 100 feet from the wetlands. The applicant has filed with the Conservation Commission and has made
and has made some changes in regard to the Limit of Work line. This will limit the lawn area and landscape area.
J. Smolak: Showed the Limit of Work line on the site plan.
J. Tymon:
The applicant has agreed to put permanent Town of North Andover wetland markers along the Limit of Work. The only other recommendation L. Eggleston’s last report is for a sequencing
plan for installing the porous pavers. There will be a requirement for a performance monitor to oversee that installation.
L. Rudnicki: Is maintenance required for the porous pavers?
J.
Tymon: Yes, that requirement could be made part of a deed restriction along with the requirement for fertilizer restrictions. This could be conditioned in the Decision.
J. Smolak:
The Conservation Commission closed the hearing at their last meeting.
MOTION
A motion was made by D. Kellogg to close the public hearing for 70 Elm Street. The motion was seconded
by M. Colantoni. The vote was unanimous 4-0. D. Kellogg, T. Seibert, J. Simons, and M. Colantoni voted in favor.
A draft Decision was reviewed.
J. Smolak: Requested a reduction for the required bond amount stated in the draft Decision.
The Board denied this request.

Special Permit for 358 Dale Street, as amended. The motion was seconded by T. Seibert. The vote was unanimous 4-0. D. Kellogg, T. Seibert, J. Simons, and M. Colantoni voted in favor.

PUBLIC HEARING, 498 Chickering Road: Application for Special Permit-Site Plan Review. Applicant proposes demolition of a Mobil gas station and construction of a 3,159 sq. ft. bank
building, with three drive-through bays, twenty four (24) parking spaces, landscaping and stormwater management in the General Business Zone (GB).
Applicant requested a postponement

J. Tymon:
There has not been any additional information received. Reviewed the scope of the modification requested. The last renewal was in granted December 4, 2007 and an appeal was filed
December 24, 2007. That appeal was dismissed in 2012. No additional information is required.
J. Simons reviewed the minutes from the last meeting.

DISCUSSION
134 Coachmans
Lane: Request for waiver of a Watershed Special Permit.
J. Tymon: The applicant would like to construct a deck. There is a Conservation Commission filing as well.
Stephen Cook, contractor
for applicant: There was a deck on the house several years ago that fell into disrepair. Reviewed pictures of the back of the house and a proposed framing plan with the Board. The
original deck was approximately 16’ x 20’. The proposed deck is 16’ by 44’. The closest point to the wetland would be a distance of 50.7’. There is a stone driveway and
there will be stone under the proposed deck. Reviewed the wetland delineation on the site plan. The wetland line sits approximately halfway across the back yard.
J. Tymon: Reviewed
three similar requests for Watershed Special Permit waivers that were recently granted by the Board. This request is consistent with what has been granted in the past.
MOTION
A motion
was made by D. Kellogg to waive the Watershed Special Permit for 134 Coachmans Lane, to direct the Town Planner to write a short note for the file, and to condition anything necessary.
The motion was seconded by T. Seibert. The vote was unanimous 5-0.
MEETING MINUTES

A motion was made by T. Seibert to approve the April 17, 2012 meeting minutes. The motion
was seconded by M.Colantoni. The vote was 4-0. John Simons abstained.
J. Tymon: Informed the Board that the Zoning Public Hearing will be held May 23, 2012. Summarized five potential
articles that will be discussed.
