Enright Meeting began at 7:00pm. ANR 411 & 421 Stevens Street: Change of lot lines. MOTION A motion to direct the Town Planner to sign the Form A was made by D. Kellogg. The motion was seconded by M. Colantoni. The vote was unanimous. PUBLIC HEARINGS CONTINUED PUBLIC HEARING, 1018 Osgood Street: Application for Site Plan Review-Special Permit for proposed construction of a 2,250 sq. ft. coffee shop with drive-thru and associated site amenities including drive-thru lane and twenty five (25) parking spaces. In addition, applicant has filed for a Request of Determination of Applicability of Watershed Protection District Requirements. J. Tymon: Applicant requested a continuance until March 19, 2013. J. Tymon: Applicant requested a continuance until March 19, 2013. CONTINUED PUBLIC HEARING, Appleton Street: Proposed six lot Planned Residential Development Special Permit and Definitive Subdivision Plan to be located at 464 Appleton Street in the Residential-1 (R-1) Zoning District. The project would combine three (3) lots and raze an existing dwelling with frontage on Appleton Street. J. Tymon: The applicant has provided responses to the civil, stormwater, and DPW comments. These responses have been sent to the peer reviewers. Reviewed a list of waiver requests that included the length of the cul-de-sac, center line radius, and the 50’ buffer zone requirement for a PRD. J. Simons: At some point in the future there may be a Rail Trail developed on the railroad ROW. If that were to happen we would not want the homeowner’s of these lots to then complain about the proximity of the Rail Trail. What is the reason for the waiver request of the 50’ buffer zone? Phillip Christiansen, Christiansen and Sergi: There is an 80’ wide easement there and the grading is very steep up to the railway ROW. Additionally there is a 20’ wide sewer easement that runs through there that also provides buffering. The disadvantage of the buffer zone is smaller backyards for the homeowners. There probably could be a 30’ buffer zone added. J. Simons: Requested that the Plans be re-visited to see where a buffer zone could be placed. L. McSherry: For these lots, could something be put in the deed that recognizes that the buffer zone has been limited and that there is potential for future development of the Rail Trail? P. Christiansen: Something like that could be put in the deed. J. Simons: They could voluntarily buffer it themselves. P. Christiansen: There is another waiver request related to the maximum height of the homes. The PRD regulations specify that the maximum height can not exceed 30’, all the other zoning in town is 35’. The applicant is requesting that this development have a 35’ maximum height. R. Rowen: Does this development preclude an extension of that road through to Appleton Street? P. Christiansen: No, it doesn’t. J. Simons: It would reserve the ROW. J. Tymon: Appleton Street is accepted from Salem Street to the end of the developed portion. The remainder has been abandoned and is a paper street. This development creates an access easement on Lot 4 and there is a utility easement as well on Lot 4. R. Rowen: Theoretically, if they were to extend the new road to connect to Appleton Street the new road would run across Lot 4. P. Christiansen: When a street is abandoned the ownership goes to the center line of the street. The people on either side own to the center line. Anybody that had access to that street has right to pass and re-pass. This means they have a right to build a road through there if they want to. The Open Space would be granted to the town. J. Simons: Is the assumption that because the property owner owns both sides of the paper street that the street is part of the parcel to be subdivided? P. Christiansen: Yes. Part of the abandoned ROW is off of this property and part is on the property. There is a property owner where all the trees are shown in the aerial photo that owns to the center line as well. L. McSherry: Will a Title issue be created for Lot 4 since there is potential for a road to be constructed through the lot? P. Christiansen: An attorney has reviewed it and does not believe there will be a Title issue. Board: Discussion around the possibility of precluding any future development of the paper street and/or the development of a foot path on the paper portion of the street. J. Simons: Requested that the Town Attorney review the plans and language of the access easement. P. Christiansen: Research is still being conducted to determine where the force main goes from the sewer pumping station on Blue Ridge Road. There is no as-built plan for it. It will be put on the plan once it is located. Gene Willis, Town Engineer, does not want the DPW to be responsible for maintenance of any stormwater structures. There will be a Homeowner’s Association that will be responsible for maintaining the stormwater systems that are not in the ROW; however, the DPW should take care of any system in the ROW. The systems in the ROW are catch basins and one stormceptor unit. G. Willis would also like to the new roadway entrance to have a negative pitch from Blue Ridge Road. The proposed design meets the Subdivision Regulations (6.8.9). Runoff from the new road will not flow onto Blue Ridge Road. J. Simons: We will continue until the March 19 meeting. DISCUSSIONS Town Meeting Articles: J. Simons: Requested that the Town Planner submit a Planning Board Article for a moratorium on wind turbines for the Annual Town Meeting Warrant. This will allow for time to study the topic and submit and Article the following year. J. Tymon: There will also be a citizen’ petition for an Article related to backyard chickens and possibly Articles for two street acceptances. J. Simons: Requested that the Town Planner determine if is makes sense to submit an Article related to a moratorium on medical marijuana as well. MEETING MINUTES: Approval of February 19, 2013 meeting minutes. MOTION A motion was made by L. Rudnicki to approve the February 5, 2013 meeting minutes. The motion was seconded by L. McSherry. The vote was unanimous. ADJOURNMENT MOTION: A motion was made by R. Rowen to adjourn the meeting. The motion was seconded by M. Colantoni. The vote was unanimous. The meeting adjourned at 7:40pm.
