1 Public Hearing
The BOARD OF APPEALS held a meeting on Monday evening, February 13, 1978 at
7:30 P.M. in the Town Office Building meeting room with the following members present
and voting: Alfred E. Frizelle, Vice Chairman; Frank Serio, Jr., Chairman; James
Noble, Atty. Ralph R. Joyce and Associate Member Sandra Monroe, and Daniel Leonard.

Ealph A. BarbaEallo - ~ecision:
The Board considered the petition of Ralph A. Barbagallo, for which the hearing had
been held on January 9, 1978. Members Frizelle, Noble, Joyce & Monroe sat on this
petition.
After discussion, Mr. Joyce made a motion to GRANT the variances with the condition
that in the event the buildings are razed or destroyed as defined by Section 8.3
of the Zoning Dy-Law , the variances will become null and void. Mr. Noble seconded
the motion and the vote was unanimous. A new plan will be submitted that will also
go before Land Court.
HEARING: DOROTHY L-, POWERS
Mr. Serio read the legal notice in the appeal of DOROTHY L. POWERS who requested a
variation of Sec. 6.3 & Table 2 of the Zoning By-Law so as to permit razing the
present one stall garage and erecting new structure to house two cars and store
yard equipment, located at 28 Cabot Rd.
The following members sat on this petition: Frank Serio, Joyce, ~oble, Monroe and
Assoc. member Leonard.
Mr. Choquette spoke for the petitioner. He explained that they have A cars, two
of which are trucks, and a small driveway. 5 people reside in the house - ~ adults.
Everything is as explained on the application.
No one else spoke in favor.
Speaking in opposotion were Walter Niziak, an immediate abutter. Several abutters
were present. A petition was presented to the Board signed by 24 people, all opposed
to the petition. They feel there is no hardship involved. The garage would detract
from the neighborhood having a large garage in the back yard; it would be overcrowding
a small lot. Mr. Niziak explained that the whole thing is unorthodox; he has lived
there 20 years and the neighborhood never had any problems until now. The people also
complained because they did not receive the notices until Saturday.
The petitioner is asking for a 12 foot variance. Bldg. Insp. Foster explained that
the setbacks required for a small lot are 12 feet on the sides and 20 ~-~ feet front
and rear.
Mr. Choquette explained that Dr. Bridges abuts the property to the rear and that he
has a small garage to the side of the rear lot line.
~ Joyce made a motion to continue the hearing to the March 13th meeting; Mr. Noble
s~'~onded the motion and the vote was unanimous. The Board will view the site on
March llth.
MISCELLANEOUS l~TTERS:
Mr. Serio read a letter from Town Counsel which outlined his duties to the town,
boards, committeest etc.
The meeting adjourned at 8:30 P.M.
