Kellogg, L. Rudnicki 1 Absent: R. Rowen 2 Staff Present: J. Tymon, J. Enright 3 4 Meeting began at 7:02 pm. 5 6 ANR 7 Stone House Farm Trust #2 8 MOTION 9 A motion was made by D. Kellogg to direct the Town Planner to sign the Form A. The motion 10 was seconded by M. Colantoni. The vote was unanimous 5-0. 11 12 200 Sutton Street 13 MOTION 14 A motion was made by M. Colantoni to direct the Town Planner to sign the Form A. The motion 15 was seconded by D. Kellogg. The vote was unanimous 5-0. 16 17 PUBLIC HEARINGS 18 CONTINUED PUBLIC HEARING: 26 Main Street, Application for Special Permit-Site Plan 19 Review. Applicant proposes construction of an eight (8) unit residential condominium project 20 with two (2) parking spaces per unit on a lot with access to Main Street via existing easements on 21 two (2) existing lots fronting Main Street at 22-24 and 28-30 Main Street and an existing curb 22 cut at the noted lots. 23 J. Tymon: Updated plans that show the access and egress more definitively, existing parking, 24 and signage have been submitted. There have also been changes made related to stormwater 25 management. A set of elevations have been submitted as well as an updated landscaping plan. 26 A comment letter from Lisa Eggleston was received today. 27 T. Seibert: Read an email sent from John Cusack (28-30 Main Street) to the Planning 28 Department on May 1, 2012. 29 Dominic Scalise, Representing the applicant: The applicant has had meetings between Jeffco and 30 Mr. Cusack and many issues have been resolved. An agreement letter has been presented to Mr. 31 Cusack, however, he has not signed it yet. 32 Bill MacCleod, Andover Consultants: The concerns of the Civil Engineer peer review have been 33 addressed. Remaining are some minor issues from the stormwater peer review. All of the 34 revisions requested by the Town staff have been addressed. Displayed and reviewed four 35 renderings of the proposed building, site plan, and traffic patterns. 36 J. Tymon: The Fire Department has not commented on the plan yet. They wanted to see the 37 traffic pattern and parking on the plans prior to submitting their comments. J. Cusack will be 38 rd contacted and informed that the next Planning Board meeting will be held on May 23. 39 40 CONTINUED PUBLIC HEARING, 70 Elm Street: Application for a renewal of a Wireless 41 Special Permit for the operation of an existing wireless communication facility within the 42 1 PLANNING BOARD Meeting Minutes Tuesday, May 1, 2012 Town Hall, 120 Main Street 7:00 PM Residential-4 (R-4) Zoning District under Sections 8.9 and 10.3 of the North Andover Zoning 43 Bylaw. 44 T. Seibert: Recused himself. 45 J. Tymon: This is a renewal of a Special Permit that was granted in 2009, not a modification. 46 An opinion letter was received from Attorney Peter Morin, representing the applicant, regarding 47 the pending case with Regis College that was mentioned by a member of the public. The 48 attorney for the applicant contends that it is irrelevant to this application. 49 Peter Morin, Summarized the dispute between Regis College and the Weston Zoning Board of 50 Appeals and the appeal that was filed with the Supreme Judicial Court by Regis College. 51 MOTION 52 A motion was made by M. Colantoni to close the public hearing for 70 Elm Street. The motion 53 was seconded by D. Kellogg. The vote was unanimous 3-0. Voting in favor were D. Kellogg, 54 M. Colantoni, and J. Simons. 55 J. Tymon: L. Rudnicki can not vote on this application. The vote will have to wait until the next 56 meeting. 57 B. McQuade, agent for Metro PCS: Stated he would not be able to attend the next meeting. 58 J. Simons: No new comments will be heard at the next meeting and attendance will not be 59 necessary. 60 61 CONTINUED PUBLIC HEARING, 358 Dale Street: Application for a Watershed Special 62 Permit. Applicant seeks to construct a new single family residential dwelling along with 63 associated driveway, landscaping, utility and other improvements. 64 J. Tymon: A draft Decision has been prepared. L. Eggleston has requested a landscape plan be 65 submitted and that requirement has been conditioned in the Decision. 66 J. Simons: Requested a summary of the dimensions from wetlands. 67 J. Tymon: The proposed structure is within the non-discharge area because it is outside 100 feet 68 from the wetlands. The applicant has filed with the Conservation Commission and has made and 69 has made some changes in regard to the Limit of Work line. This will limit the lawn area and 70 landscape area. 71 J. Smolak: Showed the Limit of Work line on the site plan. 72 J. Tymon: The applicant has agreed to put permanent Town of North Andover wetland markers 73 along the Limit of Work. The only other recommendation L. Eggleston’s last report is for a 74 sequencing plan for installing the porous pavers. There will be a requirement for a performance 75 monitor to oversee that installation. 76 L. Rudnicki: Is maintenance required for the porous pavers? 77 J. Tymon: Yes, that requirement could be made part of a deed restriction along with the 78 requirement for fertilizer restrictions. This could be conditioned in the Decision. 79 J. Smolak: The Conservation Commission closed the hearing at their last meeting. 80 MOTION 81 A motion was made by D. Kellogg to close the public hearing for 70 Elm Street. The motion 82 was seconded by M. Colantoni. The vote was unanimous 4-0. D. Kellogg, T. Seibert, J. Simons, 83 and M. Smolak: Requested a reduction for the required bond amount stated in the draft Decision. 86 The Board denied this request. 87 MOTION 88 A motion was made by D. Kellogg to approve the Watershed Special Permit for 358 Dale Street, 89 as amended. The motion was seconded by T. Seibert. The vote was unanimous 4-0. D. 90 Kellogg, T. Seibert, J. Simons, and M. Colantoni voted in favor. 91 92 CONTINUED PUBLIC HEARING, 498 Chickering Road: Application for Special Permit-Site 93 Plan Review. Applicant proposes demolition of a Mobil gas station and construction of a 3,159 94 sq. ft. bank building, with three drive-through bays, twenty four (24) parking spaces, landscaping 95 and stormwater management in the General Business Zone (GB). 96 Applicant requested a postponement until May 23, 2012. 97 98 CONTINUED PUBLIC HEARING, 1320 Osgood Street: Application for Special Permit-Site 99 Plan Review. Applicant proposes to construct a parking lot. 100 Applicant requested a postponement until May 23, 2012. 101 102 CONTINUED PUBLIC HEARING, 0 Chestnut Street (a/k/a 300 Chestnut St): Application for 103 Modification of a Wireless Facility Special Permit. 104 J. Tymon: There has not been any additional information received. Reviewed the scope of the 105 modification requested. The last renewal was in granted December 4, 2007 and an appeal was 106 filed December 24, 2007. That appeal was dismissed in 2012. No additional information is 107 required. 108 J. Simons reviewed the minutes from the last meeting. 109 MOTION 110 A motion was made by T. Seibert to close the public hearing for 0 Chestnut Street (a/k/a 300 111 Chestnut Street) Sprint Spectrum renewal and modification. The motion was seconded by M. 112 Colantoni. The vote was unanimous 4-0. D. Kellogg, T. Seibert, J. Simons, and M. Colantoni 113 voted in favor. 114 115 MOTION 116 A motion was made by D. Kellogg to approve the Special Permit for 0 Chestnut Street (a/k/a 300 117 Chestnut Street), as written. The motion was seconded by M. Colantoni. The vote was 118 unanimous 4-0. D. Kellogg, T. Seibert, J. Simons, and M. Colantoni voted in favor. 119 120 DISCUSSION 121 134 Coachmans Lane: Request for waiver of a Watershed Special Permit. 122 J. Tymon: The applicant would like to construct a deck. There is a Conservation Commission 123 filing as well. 124 Stephen Cook, contractor for applicant: There was a deck on the house several years ago that 125 fell into disrepair. Reviewed pictures of the back of the house and a proposed framing plan with 126 the Board. The original deck was approximately 16’ x 20’. The proposed deck is 16’ by 44’. 127 The closest point to the wetland would be a distance of 50.7’. Reviewed the wetland delineation on the site plan. 129 The wetland line sits approximately halfway across the back yard. 130 J. Tymon: Reviewed three similar requests for Watershed Special Permit waivers that were 131 recently granted by the Board. This request is consistent with what has been granted in the past. 132 MOTION 133 A motion was made by D. Kellogg to waive the Watershed Special Permit for 134 Coachmans 134 Lane, to direct the Town Planner to write a short note for the file, and to condition anything 135 necessary. The motion was seconded by T. Seibert. The vote was unanimous 5-0. 136 137 MEETING MINUTES 138 MOTION 139 A motion was made by T. Seibert to approve the April 17, 2012 meeting minutes. The motion 140 was seconded by M.Colantoni. The vote was 4-0. John Simons abstained. 141 142 J. Tymon: Informed the Board that the Zoning Public Hearing will be held May 23, 2012. 143 Summarized five potential articles that will be discussed. 144 145 ADJOURNMENT 146 MOTION: 147 A motion was made by D. Kellogg to adjourn the meeting. The motion was seconded by T. 148 Seibert.
