NOTICE OF DECISION
Watershed Special Permit - Waiver
Date of Decision: April 7, 2009
Application of:

Premises Affected: 61 Johnson St., North Andover, MA 01845, Map 37D, Parcel 31,
within the R-3 zoning district.
HISTORY AND BACKGROUND
On March 25, 2009, the applicant requested a waiver of the Watershed Protection District
Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so as to
allow the construction of a 12 X 12 ft. three-season porch at the rear of the dwelling unit. The
porch is to be built using the footprint of an existing 12 X 12 ft. deck, to be located
approximately 22’ from a delineated wetland resource area within the Non-Disturbance buffer
zone of the Watershed Protection District.
The applicant applied for and received an Order of Conditions from the Conservation
Commission on March 12, 2009. The Commission also approved the wetlands delineation
performed by the applicant’s wetlands scientist, Richelle Denney.

After a Planning Board meeting on the above date, and upon a motion by T. Seibert and 2 by
M. Walsh, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote
unanimousin favor
was of the waiver.
FINDING OF FACT
The Planning Board has made its decision based on the following findings:
The porch will be located on the footprint of an existing deck, using a hand-dug concrete
sonotube foundation
An existing screen porch that is located closer to the wetlands will be demolished.
The new porch will be located further from the wetlands than the existing porch – 22 ft.
versus 7 ft.
The project includes the restoration of 44 sq. ft. of wetlands.
The plan has been approved by the Town of North Andover Conservation Commission.
CONDITIONS
The applicant has agreed to have the Town Planner perform a minimum of two inspections of the
site during the construction process
Proper erosion control will be constructed and will remain throughout the project.
