CONSERVATION DEPARTMENT HopA 7 1/F� Community Development Division '°-*AING'9/V p 0 u1 MEMORANDUM Fko.a, DATE: April 17, 2007 TO: Eugene Willis, Town Engineer Lincoln Daley, Town Planner FROM: Alison McKay, Conservation Administratc &J SUBJECT: 12 Bonny Lane, Map 62 Parcel 41 At the April 11, 2007 Conservation Commission meeting, the Conservation Commission requested confirmation of the location of the utility easement on the parcel referenced above and whether drainage was properly completed within the Bonny Lane Subdivision (Hardt Court Estates). Utility Easement Plans submitted by Cammett Engineering dated 3/20/07 do not reference a utility easement on the property and the boundaries of such easement. However, the plans do indicate an overhead utility service, which traverses across the property behind the proposed single-family dwelling and associated work. A plan found in the Conservation file (242-057) entitled "Definitive Plan of Hardt Court Estates", dated January 10, 1979 depicts a large utility easement area located within the entire rear of the lot. This plan is also referenced in a recorded deed (attached). The Conservation Commission requests confirmation of the boundaries of said utility easement on the referenced lot. Drainage The Conservation file indicates several drainage deficiencies during and after construction of the original subdivision. While these drainage problems may have been resolved, no reference or evidence of final drainage approvals were found in the file. The project was denied by the Conservation Commission and a Superseding Order of Conditions was issued by DEQE (DEP). Partial Certificate of Compliances were issued for some of the lots, however a final Certificate of Compliance was not issued by the 1600 Osgood Street,North Andover,Massachusetts 01845 Phone 978.688.9530 fax 978.688.9542 Web www.townofnorthandover.com DEP or the Conservation Commission, respectively. Therefore, the Conservation Commission requests your opinion as to whether drainage was completed and functions properly for this subdivision. I have provided some pertinent information with this memorandum to further assist you with these matters. The Conservation Commission meets to discuss this matter further at their meeting of April 25,2007. Therefore, your comments would be appreciated by no later than Tuesday April 24th.
