Ladies and Gentlemen:
As you may recall, I represent Bonny Realty Trust, owner of the above-referenced
residential lot. The following permits and approvals have been issued for the
development of a single-family home on the property:

Bonny Realty Trust now has the property under agreement to sell the lot to
Anthony Grasso Mr. Grasso lives nearby and intends to assist his son with the
construction of a home on the property for his son and his son's family.
In connection with his intended construction, Mr. Grasso is having final building
plans prepared. The building plans Mr. Grasso would like to proceed with differ
slightly from the plans approved by the Town boards in 2007. Specifically, the
house design has been finalized and changed slightly from the approved schematic
plans and, the location of the house has been moved slightly closer to Bonny Lane.
Although these changes do not require any further zoning variance and appear
consistent with the spirit and intent of the prior approvals, Mr. Grasso desires to
keep the boards fully informed of his proposed construction. Mr. Grasso would
also like to receive confirmation from each of the boards that these changes are
minor modifications, consistent with their original approvals, and do not require
any further public hearing or formal amendment. To assist the boards in this
regard, I have enclosed' an "Overlay Site Plan" prepared by the project
engineer/surveyor dated 3/1/7/09. The Overlay Site Plan compares Mr. Grasso's
proposed home(shown in red) to the original approval.
I have also enclosed a letter from the project engineer dated 3/18/09 confirming
that the area of disturbance in the 100' non-discharge buffer zone is not changed
by Mr. Grasso's minor modifications and that the total amount of impervious area
on the property is reduced slightly, by 30 s.f., by Mr. Grasso's modifications.
Finally, I have enclosed a 6 sheet house plan, prepared by R.C. Searles Associates,
reflecting the home Mr. Grasso proposes to build, and a revised "Site Plan"
prepared by the project engineer/surveyor showing the location of the home Mr.
Grasso proposes to build. These two plans would replace the previously approved

plans as the plans of record for the Project, if the boards agree and confirm that
Mr. Grasso's proposal constitutes a minor modification within the boards' original
approvals. ,
Would you be so kind as to place this request for confirmation of a minor
modification on your board's agenda as an information discussion item according
to the following schedule:

Zoning Board—April 14, 2009
Conservation Commission—April 8, 2009
In the meantime, Mr. Grasso also expects to submit building plans and a building
permit application to the Town's Building Inspector for his review and comment.

Dear Tony,
At your request, our office has modified the proposed site plan at 12 Bonny Lane to incorporate
the proposed house footprint you propose to build. With this modification we have checked the
areas of disturbance in the 100'non-discharge buffer zone and the non-discharge buffer zone.
These areas have not changed and remain the same as indicated on the site plan. We have also
checked the amount of impervious area on the total lot between the previously approved plan and
«,o proposed plan. the proposed plan provides a slight redduction,30 sf,of imper"l ous area from
3930 sf to 3900 sf.
