No evidence heard] 13 14 Town of North Andover Draft Master Plan: The Planning Board will discuss and comment on the Town of North 15 Andover Draft Master Plan. No evidence heard.] 17 18 CONTINUED PUBLIC HEARINGS: 19 31 Johnson Circle Denise l+avorat: Application for a Watershed Special Permit under Sections 44,136, 10.3 and 20 10.31 of the North Andover Zoning Bylaw. The Applicant proposes to construct a 14'X16',4-Season finished 21 sunroom and 10' 10' deck within the Non-Disturbance Zone. The project is located within the Residential 3 (R- 22 3)Zoning District. j 23 M. Gregoire: 'fhe revised plan has been reviewed by the Town.Engineer. He added one condition which stated an 24 inspection take place prior to backfill of the infiltration system. Confirmed the addition is 224 sf. 25 D. Favorat: Questioned special conditions for erosion control, deed restriction, need for construction monitoring, 26 pesticides and herbicides, composition of driveway sealant restriction,fencing, dust mitigation and location of 27 stockpiled materials and recording of the mylar at the registry of deeds. 28 M. Gregoire: Agreed to perform construction monitoring as this is a small project. 29 J. Simons:Noted best management practices are included in every watershed decision. 30 D. Favor at. Questioned the need for a signed as-built plan due to the project being reviewed by Conservation. 31 Board: Agreed the revised plan could hand note the location of all structures and materials signed by the engineer. 32 MOTION: J. Simons made a motion to close the public hearing for the Watershed Special Permit at 31 Johnson 33 Circle,North Andover,MA. P. Boynton seconded. The vote was 5-0, unanimous in favor. 34 MOTION: J. Simons made a motion to approve the Watershed Special Permit, subject to the discussed 35 amendments, for 31 Johnson.Circle,North Andover, MA. J. Luz seconded. The vote was 5-0, unanimous in favor. 36 37 DISCUSSION: 38 209 Johnston Street, Corey Fritts: Waiver Request 39 M. Gregoire: This is a waiver request for a Watershed Special Permit under Section 4.136, Sections 10.3 and 40 10.31 of the North Andover Zoning Bylaw. We were unaware we were in the watershed when Conservation visited the site to review the 45 siding project last fall. We are requesting the waiver; agree to put proper erosion in place and for the Town 46 Planner perform two site inspections. The original deck was 12x16 (192 sf),the new structure(384 sf)will have 47 helical piles, and a steel frame.No grading changes will be made to the site. Due to the existing concrete slab and 48 flagstone patio below the deck, we are proposing a special underdeck ceiling system to carry the water away fiom 49 the underdeck seating area. 50 M. Gregoire: The ceiling system triggers the Watershed Special Permit due to the diversion of stormwater runoff 51 on the site. 52 Board: Agreed to the waiver request provided that the underdeck ceiling system is eliminated.Applicant is going 53 through an RDA with Conservation. Extended footprint allows for a stair for safe egress. 54 MOTION: J. Simons motioned to approve the Waiver request for 209 Johnson Street,North Andover,MA 55 providing certain conditions are included in the decision, A. Preston seconded. Vote was 5-0, unanimous in favor. 56 57 Lake Shore Clean-Up Day: October 20, 2018 @a 9:30 a.m. Stevens Pond. P. Boynton extended invite to all 58 interested. 59 60 MEWTES APPROVAL 61 MOTION: P. Boynton motioned to approve the August 2, 2018 Site Visit Meeting minutes. E. Goldberg 62 seconded. The vote was 5-0,unanimous in favor. J. Luz motioned to approve the August 21, 2018 minutes,A. 63 Preston seconded. The vote was 5-0,unanimous in favor. 64 65 EXECUTIVE SESSION: (7:45)M.G.L. Chapter 30A, §21(a)-reason#3 to discuss strategy with respect to 66 litigation; Varsity Wireless v.North Andover Planning Board, 67 MOTION: Eitan Goldberg, Chairman: The Planning Board will go into Executive Session for confidential 68 communications to discuss litigation strategy within the case of Varsity Wireless v. North Andover Planning 69 Board. The Chair has declared an open meeting would be detrimental to the Town's litigation strategy. Open 70 Session will not reconvene at the conclusion of Executive Session.A. Preston motioned to go into Executive 71 Session. J. Luz seconded. 72 73 Doll Call Vote: John Simons voted to go into Executive Session. Jennifer Luz voted to go into Executive Session. 74 Aaron Preston voted to go into Executive Session.
