HISTORY AND BACKGROUND • On March 12, 2007, the Planning Board unanimously voted to grant the applicant, Amy Constantino, Trustee, Bonny Realty Trust, a Watershed Special Permit, so as to allow the construction of a 3,950 s.f single-family residence with attached garage, 110+ foot driveway, installation of underground utilities, and associated grading and landscaping 60' from a delineated wetland resource area within the Non-Disturbance buffer zone of the Watershed Protection District. The applicant and his attorney, D. Borenstein,appeared before the Planning Board on April 7, 2009, to request that a revised plan, dated March 17, 2009, named"Site Plan for Single Family Dwelling, Bonny Lane,North Andover, MA 01945, prepared for Bonny Realty Trust", replace the previous plan as the plan of record for the above mentioned approved Watershed Special Permit. The new plan shows a slightly smaller building footprint, with the total amount of impervious surface to be reduced by approximately 50 sq. ft. DECISION After a Planning Board meeting on the above date, and upon a motion by T. Seibert and 2nd by M. Walsh, a vote was taken with regard to a waiver of the Watershed Special Permit. The vote was unanimous in favor of the waiver. FINDING OF FACT The Planning Board has made its decision based on the following findings: • The building footprint differs slightly from the original and retains the same setbacks from the wetlands as the original. • The total impervious surface of the project is reduced by approximately 50 sq. ft. • The new plan allows the conservation of several large trees on the property. • The new plan has been approved by the Town of North Andover Conservation Commission.
