EXECUTIVE SESSION: The Executive Session convened at 5:05 p.m.
ATTENDANCE: The following were present: Rosemary Smedile, Chairman;Donald Stewart;James
Xenakis;William Duffy; Susan Haltmaier;Mark Rees, Town Manager; Ray Santilli, Assistant Town
Manager.
EXECUTIVE SESSION: James Xenakis made a MOTION,seconded by Donald Stewart,to move into
Executive Session to discuss collective bargaining and Beede Waste Oil;vote approved 5-0.
The Board of Selectmen was individually polled and each voted to move into Executive Session.
Vote: William Duffy yes;Donald Stewart yes; Susan Haltmaier yes;James Xenakis yes;Rosemary
Smedile yes.
Chairman Smedile stated the Board would be returning to Open Session after the Executive Session.
Collective Bareainine.
Bed Waste Oil. There is a company called TRC that has created a unique business that generates a profit
for them from the clean up for super fund sites.The assumption under this business plan is that a private
company can clean up a contaminated site at substantially less cost than a government agency. The TRC
solicits participation from parties being sued under the super fund law by charging less of a cost than the
EPA would charge for the clean up. Once they get sufficient participation to make it worth their while,
TRC goes to the EPA and enters into an agreement to clean up the superfund site. EPA does not care who
cleans it up,just as long as the work is done properly. In the agreement the Town would have insurance
and not be responsible. The positive thing about this settlement is the Town would be out of this for
approximately$94,090 and most of the cost associated with superfund cleanup is not with the actual
cleanup but the litigation associated with this issue.
Donald Stewart made a MOTION, seconded by James Xenakis,to authorize the Town Manager to sign
the preliminary paperwork for the Beede Waste Oil
ADJOURNMENT: Donald Stewart made a MOTION,seconded by James Xenakis,to move out of
executive session;vote approved 5 -0.
