HomeMy WebLinkAbout2004-04-05 Board of Selectmen Executive Minutes ^ BOARD OF SELECTMEN EXECUTIVE MINUTES APRIL 5, 2004 EXECUTIVE SESSION: The Executive Session convened at 7 :00 p.m. ATTENDANCE: The following were present: Wendy D. Wakeman, Chairman; Rosemary Smedile; James Xenakis; Donald Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager and Town Counsel Thomas Urbelis. The Board of Selectmen was individually polled and each voted unanimously to move into Executive Session. Vote approved 5-0. Threatened Litigation. About ten years ago Mr. Nassar who lived on 475 Great Pond Road had a verbal discussion with a DPW worker now deceased about the location for connection of a sewer pipeline to his home. Mr. Nassar says that because the DPW worker gave wrong information this resulted in a delay and extensive expenses on his part. Eventually a tie-in was completed by Watson Construction and was reimbursed by the Town of North Andover for work that was performed in error. Mr. Nassar is still seeking a reimbursement of$9,700, which was the cost of unnecessary work under the driveway. The Town Manager instructed Director of Public Works Bill Hmurciak to obtain from several local contractors a quote to install a 100-foot long sewer pipe. The average cost of their quotes is $30/foot for$3,000. The Town Manager then offered a settlement of 50% of the cost to run a 100-foot section of pipe in the amount of$1,500. Mr. Nasser has declined this offer. Town Counsel advised that the Town has no liability on the basis of a verbal conversation with a DPW worker. James Xenakis made a MOTION, seconded by Rosemary Smedile, to authorize the Town Manager to send a letter to Mr. Nassar reconfirming the offer of$1,500 in settlement of this matter. Vote approved 5-0. Other Matters. The Town has engaged the services of Melanson, Heath and Company, P.C. to conduct the audit of the police department grants. The Boston Globe has requested public records of all police department grants associated with Crest Associates. The Town intends to comply with this request as mandated under the state public record law. ADJOURNMENT: James Xenakis made a MOTION, seconded by Donald Stewart, to move out of Executive Session.
