EXECUTIVE SESSION: The Executive Session convened at 7:00 p.m.
ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman;Wendy Wakeman;
James Xenakis; Donald Stewart; Mark J.T. Caggiano; Mark Rees, Town Manager, and Ray Santilli, Assistant
Town Manager.
The Board of Selectmen was individually polled and each member voted to move into Executive Session.
Vote approved 5-0.
Real Estate-Oz v Properties
The Town Manager said that Chairman Rosemary Smedile met with Ont Goldstein from Ouy Properties.
The owner agrees that Ouy Properties shall have spent at least 5 million dollars in the first 5 years. The
owner shall provide the Town with annual reports on employment and on compliance according to state law.
Oz y Properties asked that the Town remove the words sole discretion and replace with reasonable
discretion.
There were several issues to be resolved between the Town and Ouy Properties before agreement could be
reached. Failure to make the investments into the building,failure to give the town the ten-year lease, failure
to report employment issues, and failure to allow the town use of athletic fields are among the concerns.
This is for informational purposes only and there is no need for a vote at this time.
Pending Litigation—Henry Nasser
As the Board requested, an independent contractor was asked to give the town an estimate cost breakdown
^ for the driveway at 475 Great Pond Road,former property of Henry Nasser. A driveway with ordinary asphalt
would cost$13,630. The same driveway with concrete and aggregate surface would cost$32,980.
The Board previously voted to offer$1,500 to settle this, but Mr. Nasser did not accept the Town's settlement.
Mark Caggiano said because this occurred in 1988, Mr. Nasser doesn't have a right to go after the town
because he sold the house two years ago, and the statue of limitations has passed. The$1,500 offer still
stands.
James Xenakis said that from a legal stand that is right but from an ethical stand the Town should offer him
more to settle this case. Mr. Nasser would continue to pursue a legal suit.
Mark Caggiano made a MOTION, seconded by Wendy Wakeman, to offer Mr. Nasser$1,500.
James Xenakis AMENDED the MOTION, seconded by Wendy Wakeman, to offer Mr. Nasser up to$4,000 to
settle. Vote approved 3-2. Mark Caggiano and Rosemary Smedile opposed.
ADJOURNMENT:
Wendy Wakeman made a MOTION, seconded by Donald Stewart, to move out of Executive Session. Vote
approved 5-0.
