EXECUTIVE SESSION: The Executive Session convened at 6:15 P.M.
ATTENDANCE: The following were present: Rosemary Connelly Smedile, Chairman; James Xenakis;
Donald Stewart; Thomas Licciardello, Mark Rees, Town Manager; Ray Santilli, Assistant Town Manager and
Town Counsel Thomas Urbelis.
James Xenakis made a MOTION, seconded by Donald Stewart, to move into Executive Session to discuss
pending litigation. Vote approved 4-0.
The Board of Selectmen was individually polled and each voted to move into Executive Session. Donald
Stewart yes; James Xenakis yes; Thomas Licciardello, yes, and Rosemary Smedile yes.
Vote approved 4-0.
Town Counsel Thomas Urbelis discussed the ZBA litigation regarding the Cellular Tower issue. Typically ask
for the court to remand issue back to appropriate board. Under federal telecommunications act, when boards
were to rescind decision, abutters could appeal. Judge can order approval and issue permit. Parties could
reach agreement of judgment.
Thomas Urbelis said the ZBA will meet on Wednesday, December 7, 2005, if they agree, Tom is asking to
sign agreement of judgment. He and Mark Caggiano would review and neither sees any chance of winning if
it goes to trial.
James Xenakis made a MOTION, seconded by Donald Stewart, to sign agreement of judgment contingent on
ZBA approval. Vote approved 4-0.
ADJOURNMENT:
Thomas Licciardello made a MOTION, seconded by Donald Stewart, to move out of Executive Session. Vote
approved 4-0.
