for site development. The plan shows:
1 . Parking/use of land area inside the town right of way. Permission for use
of this land must be obtained. I believe the authorize entity for this is the
Board of Selectmen.
2. The grades indicate runoff flows toward Great pond road. Surface runoff
must be kept on sight
3. The driveway entrance must conform to the town's driveway policy with
regards to negative pitch off the roadway edge of pavement.
4. Will there be mitigation of runoff water?

Today 1 received a letter and Blau##2 of 4,dated ay 1,2014 from the Morin-Cameron Group
e.for Practice Facility&Parking Lot Expansion at the North Andover Country Club. The
request to widen Great Pond Road to create public parking in the right of way will not affect any
current plans that the DPW has for work in the area. 1 have not reviewed the engineering
designs for the project. I assume this design review been done by outside consultants during
either the Planning or Conservation approval process.

Dear Mr. Bellevance and Board Members:
Per your request, I have reviewed the May 1, 2014 Watershed Special Permit and Site
Plan Review Application packet for the above-referenced project. Included in the
materials I received and reviewed were the following:
■ Watershed Special Permit & Site Plan Review, North Andover Country Club
Parking Area & Practice Facility Expansion, prepared by The Morin-Cameron
Group and dated May 1, 2014.
■ Site Plans, Sheets 1 through 4 of 4, Practice Facility & Parking Lot Expansion,
prepared for North Andover Country Club by The Morin-Cameron Group, Inc.
and dated May 1, 2014.
My primary focus in this technical review is on the overall stormwater management
approach and design concepts used in the project, as well as its compliance with the
Town of North Andover's zoning requirements for Watershed Protection Districts and
Site Plan Review, the Massachusetts Department of Environmental Protection (DEP)
Stormwater Management Standards and Regulations, and the North Andover Wetlands
Bylaw. It is my understanding that a Notice of Intent(NOI) application for the project has
been or will be filed concurrently with the Conservation Commission. My review is
aimed at assisting both boards in their respective reviews of the project.
The project site is located on the Country Club property on the southeast side of Great
Pond Road, where an existing parking lot, putting green and paddle tennis courts are
located. Drainage in this area is in a generally northeasterly direction toward an onsite
wetland system that drains through an existing culvert under Great Pond Road toward
Lake Cochichewick. The proposed project calls for an expanded parking area, golf cart
parking and practice greens on the Country Club property and four new parking spaces
within the right-of-way of Great Pond Road. Proposed drainage facilities include a
relocated sediment forebay/detention basin, a CDS treatment unit, and a bioretention
basin. , c ` ;,

My initial comments on the application are outlined below:
1. The entire project site is located within the Watershed Protection District (WPD).
It is my understanding that the lot(s) was/were created prior to Oct. 24, 1994 and
is therefore not subject to the "Conservation Zone"requirements of the Watershed
Protection District regulations. However, the Non-Disturbance Zone should be
shown on the plan as extending 100 feet from the edge of all wetland resource
areas within the watershed district. Likewise, the Non-Discharge Zone should be
shown to include all of the area within 325 feet of the edge of all wetland resource
It,J, Avbl',wt - areas within the watershed district. I believe, therefore, that all of the proposed
�,n;� work falls within one of these two protection es.zon The propose uses are
15 7allowed by Special Permit within these zones, however the construction of a new
permanent structure within the Non-Disturbance Zone also requires a variance
(
A-C-11 k ��� ' t' from the Zoning Board of Appeals. It is unclear whether any of the proposed
facilities (parking lot, golf cart parking, practice greens or paddle tennis court)
would constitute a permanent structure under the Zoning Bylaw.
2. In accordance with the Special Permit Requirements of the Watershed Protection
District (Section 4.136 (4) of the Zoning Bylaw) the application must include
written certification by a Registered Professional Engineer or other qualified
scientist stating that there will not be any significant degradation of the quality or
quantity of water in or entering Lake Cochichewick as a result of the project, as
well as proof that there is no reasonable alternative location outside the Non-
Disturbance and/or Non-Discharge ones for any discharge, structure or activity
associated with the proposed use to occur. Neither of these items was included in
the materials I reviewed.
3. Data available from Mass GIS indicates that a significant portion of the project
site is also within the Zone A for the Lake Cochichewick public water supply; this
boundary should be shown on the plan as well. Zone A is defined by the
Massachusetts Drinking Water Regulations (310 CMR 22.02) as including:
(a) the land area between the surface water source and the upper boundary of
the bank;
(b) the land area within a 400 foot lateral distance from the upper boundary of
the bank of a Class A surface water source, as defined in 314 CMR
4.05(3)(a); and
(c) the land area within a 200 foot lateral distance from the upper boundary of
the bank of a tributary or associated surface water body.
The bordering vegetated wetland immediately northeast of the project area is a
tributary wetland; hence Zone A includes the land within 200 feet of that wetland.
4. It should be noted that Standard 6 of the Massachusetts Stormwater Standards
specifically prohibits the discharge of stormwater within Zone A, as is called for
on the proposed plan. I believe that some allowance can be made for this project
since the drainage from the existing parking lot currently discharges within Zone

A with minimal treatment, but only if it can be demonstrated that there will be a
net improvement in the water quality of the discharge as a result of the project.
For the reasons outlined herein I do not believe that has been accomplished with
the proposed plan. I also recommend against allowing the stormwater discharge(s)
to be moved closer to the tributary wetland.
5. While I understand that the detailed design of the proposed practice greens are to
be done by others the plan needs to show the approximate elevation of the greens
and the limits of side slope grading,particularly next to the wetland.
6. The plan should also include the limit of work or of vegetation clearing per the
Special Permit requirements.
7. Both the Site Plan Review requirements (Sections 8.3(5) and (6) of the Zoning
Bylaw) and the Massachusetts Stormwater Management Standards require that
the rate of runoff from the post-development site be mitigated to pre-development
rates. Stormwater management needs to be accomplished on the project site,
before the runoff leaves the property. Based on the proposed grading, all of the
runoff from the Phase 1 parking area and much of the Phase 2 parking area would
drain directly onto Great Pond Road,bypassing the detention(and treatment)Best
Management Practices (BMPs) on the site. This is both inconsistent with the
requirements/regulations and a potential public safety hazard.
8. Soils in the project area are mapped as being Hydrologic Soil Group B and C,
however the application states that the soils are more characteristic of HSG D
soils based on four soil test pits excavated to the northeast of the existing parking
area which indicated shallow depth to groundwater and bedrock. The proposed
design therefore provides minimal recharge of stormwater runoff from the site. It
is my opinion that shallow groundwater and ledge is not inconsistent with the
mapped soil types, and that the limited soil testing conducted does not meet the
parameters for soil reclassification outlined in Volume 3, Chapter 1 of the DEP
Stormwater Handbook. Absent such data, a waiver of the groundwater recharge
requirement under DEP Stormwater Standard#3 should not be granted.
9. On page 5 of the submittal letter the application also states that the Town's
Watershed Protection District regulations "do not promote groundwater recharge
in order to insure protection of the groundwater entering the lake." To the
contrary, Section 4.136(4)(g) of the Zoning Bylaw specifically stipulates that
within the Non-Disturbance Zone and Non-Discharge Zone any runoff from
impervious surfaces shall, to the extent possible, be recharged onsite. I would also
point out that the discharge of stormwater runoff to a surface water tributary of
the lake is significantly less protective of the water quality in the lake than
recharging the runoff to the groundwater would be, since the travel time through
the groundwater is considerably longer and provides additional filtration of the
runoff.

10. Based on the four soil test pits excavated on the site, the estimated seasonal high
groundwater(ESHGW) elevation is at approximately elevation 142 in the vicinity
of the proposed bioretention basin, or about a foot above the floor of the basin.
The hydrologic analysis should therefore include no storage below ESHGW and
should not include any exfiltration from the basin.
11. Since the water quality treatment in a bioretention basin is provided in large part
through filtration and pollutant uptake in the subsoil, the proximity to
groundwater would also render the proposed bioretention basin ineffective in
providing the required treatment of runoff flow to the basin. The DEP Stormwater
Handbook calls for two to four feet of soil media between the floor of the basin
and ESHGW to achieve the necessary treatment, and an additional two feet of
separation if the basin is also designed to exfiltrate. Given the shallow
groundwater on the site, I suggest that alternative BMPs such as construcWA-
stormwater-wetlands,may be more suitable measures to treat the runoff,

'Per the DEP Stormwater regulations, proprietary devices such as the proposed
CDS unit are to be used for pretreatment of stormwater runoff only, and then only
if they are placed in an off-line configuration and sized in accordance with the
recent DEP guidelines. In order to meet both Standard #4 (TSS removal) and
Standard #6 (Critical Areas) of the Massachusetts Stormwater Standards it must
be demonstrated that the first inch of runoff from all new pavement areas on the
project site will undergo treatment in one of the Treatment BMPs identified in
Table CA-2 of the Stormwater Handbook as being suitable for use in a Critical
Area. In order to demonstrate a net improvement in water quality, existing
pavement areas should also be treated.
13. The TSS removal calculations should include all proposed treatment trains for
pavement runoff and should account for any flow that bypasses the treatment
BMPs altogether. Unless it has been confirmed that the existing catchbasin on the
site is equipped with a deep sump and a hooded outlet it should not be included in
the TSS removal calculations.
14. I have the following additional comments on the hydrologic analysis submitted in
support of the application:
■ The hydrologic analysis should include the 1-year storm, as is required by the
North Andover Wetlands Bylaw.
■ The model should account for all drainage onto the project site, including that
to the south and east of the interior lot lines.
■ The model should include control points at all locations where runoff leaves
the project site, e.g. Great Pond Road.
■ All vegetative cover on the existing site should be assumed to be in "good"
condition, not"fair" or"poor".
■ In the post-development hydrologic model, Subcatchment P1B should be
routed to P3A, or the two combined. Based on the proposed grading it should
not be routed through the detention basin and bioretention basin.

15. As is indicated in the Stormwater Checklist and identified on the plans, the
proposed project entails more than an acre of land disturbance and is subject to
the requirements of EPA's Construction General Permit (CGP). It will require
filing for coverage under the CGP and the preparation and implementation of a
Stormwater Pollution Prevention Plan (S)APPP) prior to construction. The
SWPPP should be prepared in conjunction with the site contractor and should
include a construction sequence aimed at minimizing the duration of exposure of
unstabilized soils on the project site. It should also address stabilization/covering
of soil stockpiles and any anticipated dewatering measures. The SWPPP should
be reviewed and approved by the Planning Board and/or Conservation
Commission prior to any disturbance on the site, and the board(s) may want to
request documentation of coverage under the CGP and copies of the monitoring
reports.

Comments:
1. The Town experiences icing problems when the existing culvert in road
shoulder northeast of WF C9 gets cogged in winter. Can it be removed
and replaced with an open swale?
2. The volume and velocity of runoff from the eastern portion of
"PARKING PHASE 1" should be listed. There should be a defined
swale all along Great Pond Road frontage including at driveway
entrances. The design of the swale in the road shoulder should verify
its capacity to carry that flow. The grades of road shoulder swale
should be shown with 6" contours.
3. The driveway entrances, including cart path, must meet design
standards as posted on DPW website. There must be a negative pitch
off the existing Great Pond Road pavement — (culvert/swale across
driveway?)
4. There must be a crown created in the driveway leaving "PARKING
PHASE 2" with spot grades shown on plan. There must be a negative
pitch leaving "PARKING PHASE 2" so that the catch basins are a
minimum 6" below high point. 100% of runoff from PHASE 2 should be

Enclosed please find the draft response package addressing Lisa's and Gene's review comments. I think we are
there in concept and have done our best to document compliance with applicable regulations. We will look
forward to working out any other questions/comments from Lisa/Gene ahead of filing the hard copies of the
final plans (the board member's still remain to have some comment on the project so I'll reserve the potential
for another plan change).
Lisa/Gene: As far as schedule, we are hoping to attend the Planning Board meeting on the 17th under the
assumption that we have the plans and response to comments addressed (if not in writing than hopefully in
concept). The revised plans are due to be filed with the Conservation Commission on the 181h in order to make
the hearing on the 25th. That is our target date to file the final plans and documents with both Boards although
it would be great to have the plans on the 171h so the planning board can vote on them. Please advise if your
schedules are prohibitive to reviewing the attached package prior to the planning board on the 17th so we can
make provisions to continue the hearing. I am available by phone or email to answer any of your questions or
concerns if you want to forego the time involved with writing formal responses.

Lastly, if you haven't already heard,the Selectman endorsed the parking spaces with the street right of way at
last night's meeting.

I am in receipt of Draft plans dated 6/10/14 from the Morin-Cameron Group. I
offer the following comments.
1 . Plan 1 of 4 shows a sewer line and cleanout on north side of Great Pond
Road. Is this shown correctly or does the line tie into a sewer main? The

: club is rerouting sewer on private property. The installation of
,
rerouting work must be inspected by Town.
2. No water service to maintenance garage is shown on existing conditions
plan. This should be included on plan.
3. The rim elevation of the trench drain between phase 1 & 2 must be ,0.5'
lower than the pavement grade on the north side of the drain. Grades as
shown do not indicate this.
4. The previously proposed catch basin to the southwest of the connecting
drive between phase 1 & 2 has been removed. This should be placed
back in the drawing with the trench drain flowing to both catch basins.
5. Plans should have arrows through sections with references to detail sheet
location.
6. A detail for installation of trench drain must be included showing it
embedded in well drained soils.
7. A detail of the reconstructed road shoulder along Great Pond Road should
be provided. Unsuitable sub soil material must be removed and replaced
with well-draining soil and a 1' depth of dense graded stone. The
shoulder should extend as far as possible but a minimum 2' off the edge
of pavement.
8. A detail of the swale at the removed culvert location should be provided
including road shoulder.

We removed the trench drain from the plans in accordance with our conversation. We will keep the catch basins from
our original submittal and create a defined gutter to ensure we capture 100%of the runoff from the upper parking
area. The existing catch basin we can grade almost as a low point and the new catch basin will have a cascade style
grade with a high inflow capacity. We've added the cross section details requested along with references to their
locations on the plan. I've enclosed the interim plans incorporating your additional comments for review.
Once we receive the comments from Lisa,we will issue a formal response package.

Since we aren't quite sure how the hydrologic connection is going to function after the basins are constructed, our
position is that any detailed planting plan is a wasted effort as it is not likely we will be able to predict what can survive
the various wet zones of the basins. We don't want to be held to a planting plan;that is impossible to sustain and the
club doesn't want to be replacing expensive plants on a regular basis because construction conditions are different than
what we anticipate. So,instead of a detailed planting plan,we want to take a.simpler approach and seed the wet areas
of all 3 basins with:new England wetland seed mix. This will,ensure that we are getting a wide variety of plant types and
theoretically,the dominant plants suitable for the actual growing conditions of the constructed basins should take.. in
other words, let mother nature take care of the vegetation instead of trying to force something to grow. Here is the
note that Ross Forbes,the project golf course architect,recommended we add to the plan details:
Note: All areas below the normal high water mark of the upper detention basin, pocket wetland/bioretention area, and the
eater quality swale shall be seeded with New England Wetmix, prodded by New England Wetland Plants, Inc., at a rate
of 1 pound per 2,400 square feet. The Wetmix typically consists of the following species: Carex vuppinoidea (Fox Sedge),
Carex Lurid@ (Lurid Sedge), Carex scoparia (Blunt Broom Sedge), Verbena hastata (Blue Vervain), Scirpus atrovirens

• Likewise, the wet swate is not likely to have a permanent pool since the adjacent wetland
doesn't. It should be vegetated accordingly. I would suggest adding a permeable it mix (Like the
bioretention mix)at the bottom of the swaLe to support vegetative growth and promote
infiltration during tow groundwater conditions.
• The outlet from the pocket wetland should be pulled back as much as possible from the existing
wetland and some stone added to help disperse flow where it daylights.
• Well need a revised OaM plan to include the revised BMPs-

Just letting you know that I have reviewed the June 20th revisions on the North Andover Country Club project and
am satisfied that all of my previous comments have been addressed.
do want to stress that the stormwater treatment provided by both the pocket wetland/bioretention basin and
the wet swale requires that they be well vegetated. It is unclear at this time whether the specified seed mix will
accomplish this since the nature of the vegetation will be dependent on the actual hydrology of the basins once
they are built. I therefore recommend that several years of post-construction monitoring of the basins be
required to ensure that they are successfully vegetated, and that allowance be made for planting of the basins in
the event that the seeding does not take. I also recommend that on an ongoing basis the basins be mowed no
more frequently than once per year, and then only as needed to prevent woody vegetation.
As with similar projects permitted in the Watershed Protection District, new landscape areas
should be constructed in such a manner as to minimize the maintenance that is required, e.g. the
soil should be well aerated, it should have a minimum of 6-inches of topsoil and, where possible,
native vegetation should be planted to minimize the need for fertilizer and watering. The use of
fertilizers and other landscape chemicals on the site should be limited to organic, slow-release and
low-phosphorus products, and the use of sodium-based deicers should be prohibited within the
Watershed Protection District. Also consistent with recently permitted projects within the District,
these restrictions should be permanently recorded on the deed to the property.
Lastly, I recommend that the use of coal tar-based pavement sealants also be prohibited on the property, as they
have been determined to contribute high levels of polycyclic aromatic hydrocarbons (PAHs) to stormwater
runoff.

I would suggest a finding that basically says that while the regs do not allow new stormwater discharges within a
Zone A, there are existing stormwater discharges in the Zone A that currently discharge untreated pavement
runoff from the project area. The proposed project calls for a modification of those discharges, and the Applicant
has demonstrated that the proposed BMPs will provide a net benefit to the water supply by reducing the mass of
stormwater pollutants discharged within the Zone A and toward the wetland resource areas.
As far as the prohibition on coal tar sealants I believe that Judy was including it as a standard condition in the
WPD permits. That said, you may also want to consider using it as a standard condition in your OOCs; the science
is really quite compelling.

Per one of our earlier discussions, I would like to include a "finding"to explain why we are allowing a new discharge in
the Zone A. My understanding per Standard 6 is that a new discharge should not be allowed?
Stormwater discharges within the Zone II or Interim Wellhead Protection Area of a public water supply,and stormwater discharges
near or to any other critical area,require the use of the specific source control and pollution prevention measures and the specific
structural stormwater best management practices determined by the Department to be suitable for managing discharges to such
areas,as provided in the Massachusetts Stormwater Handbook.A discharge is near a critical area if there is a strong likelihood of a
significant impact occurring to said area,taking into account site-specific factors. Stormwater discharges to Outstanding Resource
Waters and Special Resource Waters shall be removed and set back from the receiving water or wetland and receive the highest and
best practical method of treatment. A"storm water discharge"as defined in 314 CMR 3.04(2)(a)1 or(b)to an Outstanding Resource
Water or Special Resource Water shall comply with 314 CMR 3.00 and 314 CMR 4.00. Stormwater discharges to a Zone I or Zone A
are prohibited unless essential to the operation of a public water supply.
Would you suggest language for that findings section?Also, I think the prohibition on the coal tar sealants should be in
the ZBA decision or is that something that would fall within the scope of the WPA and stormwater standards?

What section of the regulations should I reference in the following condition:
® The NACC finds that the intensive use of the upland areas and buffer zone proposed on this site will
cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland
resource areas a twenty five foot(25`) No-Disturbance Zone and a fifty foot(5(Y)No-Construction Zone
shall be established from the edge of the adjacent wetland resource area as shown on the herein
referenced plans.The Conservation Administrator and/or other agents of the NACC do not have the
authority to waive these setbacks as established under the local bylaw. No disturbance of existing
grade,soils or vegetation is permitted in the No-Disturbance zone. (See Section 3.4&Appendix F of the
local Regulations). It should be noted that the creation of the pocket wetland/bioretention area does
not create additional wetland resource area or associated buffer zone on the property in accordance
with M.G.L.c.131,§40
