6 E. Goldberg, Chairman: The Planning Board meeting for Tuesday,November 13,2018 was called to order at 7
7 p.m.
9 CONTINUED PUBLIC HEARING
10 Rea St Subdivision Application for a Definitive Subdivision to subdivide Map 38,Lot 37 into seven(7)single-family
11 residential lots with municipal water under M.G.L.Chapter 41,81-0, 81-T, 81-U. The project is located within the Residential
12 2(R-2)Zoning District.
13 M. Gregoire: A draft decision has been prepared for the Board's review;new submissions include DPW comments
14 regarding the design of the pump station. Conservation has a hearing on this development tomorrow. They have
15 not discussed this plan since it became a thru-street this past summer; there may be related changes.The Board has
16 requested a landscaped island in the cul-de-sac; DPW and NAFD are not in favor of this. If the Planning Board
17 decides that an island is desired,a maintenance agreement with the Homeowners Association is required. A Swept
18 Path Analysis was requested by the NAFD which has not been submitted. I suggested the engineer contact the
19 NAFD to get clarification on this.DPW is concerned about snow removal involving the cul-de-sac.
20 Phil Christiansen, Engmcer: Does not see the need to supply NAPD with the measurements as the 100 ft. diameter
21 cul-de-sac meets the standards of the rules and regulations. Conservation does not close things until Planning
22 makes a decision. If Conservation requires changes,the Applicant will need to return to the Planning Board for a
23 modification. We can make the cul-de-sac.change prior to endorsement. We can provide a Homeowner's
24 Agreement. Is there a name for the subdivision yeti?
25 Board reiterated they prefer the island in the center of the cul-de-sac.
26 E. Goldber : The street name can be changed;, clarified that is a BOS issue. We will leave it as is for now and 1
27 suggested the neighbors bring concerns to the BOS.
28 Beth Williamson 356 Rea Street: (.questioned item#29 in the draft approval stating this couldbecome a through
29 street in the future with the approval of the Planning Board.
30 E. Goldberg: Clarified it would have to be a need based issue,requiring a public hearing.
31 MOTION: J. Simons moved to close the public hearing for Rea Street Definitive Subdivision.J.Luz seconded the
32 motion. The vote was 5-0, unanimous in favor.
33 MOTION: J. Simons moved to approve the draft decision for Rea Street Definitive Subdivision, as amended. A.
34 Preston seconded the motion. The vote was 5-0,unanimous in favor.

36 DISCUSSIONS
37 158 Cgachmans Lane: 'Waiver request: Waiver Request for a Watershed Special Permit under Sections 4.1.36
38 and of the North Andover Zoning Bylaw. The.?applicant proposes to construct a 230 Square Foot deck within the
39 Non-Disturbance Zone. The project is located within the Residential 1 (R-1)Zoning District.
40 Dean Boudreau 158 Coachmans Lane: Explained the residential project.
41 M. Gregoire: This is a straightforward deck project over a pea stone patio in the watershed.There is very minor
42 ground disturbance,the deck floor is open for stormwater drainage and there are no topography changes. The
43 applicant will file with.Conservation for a Small Project.

44 MOTION: A. Preston moved to approve the waiver Request for 158 Coachmans Lane. J.Luz seconded the
45 motion. The vote was 5-0, unanimous in .favor.

47 1661 Great Pond Road Plantings: Insubstantial Change:Request for Insubstantial changes to the plantings
48 approved as part of a Watershed Special Pen-nit dated July 2, 2013. The project is located within the Residential
49 1(R-1)Zoning District,
50 Northeast Landscaping&Nadine Levin: Described plantings that were recently cleared from the lot which
51 included mainly poison ivy and bittersweet, noted the four red pines to be removed are diseased and described
52 replacement plantings including ground covers and smaller flowering trees..
53 M. Gregoire: Showed photos of existing site conditions and large trees slated for removal.
54 Board: Replacement of the four red pines should be substantial native species, in addition to what is presented in
55 the replanting plan.
56 MOTION: P. Boynton moved to approve the Insubstantial Change for 1661 Great Pond Road. J.Luz seconded
57 the motion. The vote was 5-0, unanimous in favor.

59 4 High Street: Waiver Request for a Preliminary Master Plan under Section 18.8 of the Town of North Andover
60 Zoning Bylaw. The project is located within the Downtown Overlay District Sub-district A.
61 David Steinbergh: Explained the waiver request involving a minor ministerial change regarding a portion of the
62 site and provided a general update on the overall site development.
63 E. Goldberg,: Disagreed with this being a minor change.
64 J. Smolak,Attorney: The 2014 Master Plan has been reviewed by the Board as part of the prior Master Plan
65 process before the zoning changed. We are not changing anything from what was originally evaluated by the
66 Board. We are simply bringing the old Master Plan and applying to the new Sub District A section of the bylaw
67 which was discussed with the Board in 2015. For these reasons we feel it is minor in nature. We are consolidating
68 all the prior approvals as part of the definitive plan under the Sub District A bylaw. This Board will have a
69 definitive review.
70 MOTION: J. Luz moved to approve the Waiver Request for a.Preliminary Master Plan under Section 18.20 C.2
71 also known as section 18.8.10.3, of the Town of North Andover Zoning bylaw for 4 West Mill NA, LLC. J.
72 Simons seconded the motion. The vote was 4-1, in favor._(E. Goldberg voted xn7fcworably)

74 21 High Street: Request for Insubstantial Change to the Site Plan Special Permit,Planned Development District
75 Special Permit and Parking Special Permit dated January 16, 2018. The project is located within the I-S Zoning
76 District.
77 D. Steinbergh, RCG: This request involves an old railroad parcel which extends from East Mill to the west.
78 Applicant described they would like to divide the Right-of Way- Parcel that crosses the street between the two
79 parcels.
80 E. Goldberg: Prefers the conveyance occur within a certain period of time.
81 M. Gregoire: This appears logical to the planning Department.
82 Board: Agreed with applicant that a six month conveyance was realistic.
83 MOTION: J. Simons moved to approve the Request for Insubstantial Change to the Site Plan Review Special
84 Permit for 21 High Street with the condition that a 6 month conveyance be included in the decision.A. Preston
85 seconded the motion. The vote was 5-0,unanimous in favor.

87 Working Group,Cold Center Zoning Review. Update on the Old Center Zoning Review,
88 J. Simons and P.Boynton provided an update on behalf of the working group which has met since July to discuss
89 rezoning to a business use due to a desire to reuse the existing structure.P.Boynton discussed the process that the
90 group went through to gain public input. General agreement that something had to change and there were two
91 ideas brought forth(1)build 8 townhomes which would maintain the front portion of the textile museum building
92 and demolish the rear, storage portion in keeping with the character of the building, (2)remove the building;
93 preserving the space as an empty parcel reserved for a future early period historical home which could only be
94 preserved if relocated to this area. By the end of the meeting,this was seen as the more strategic approach for
95 preserving a structure which the town would risk losing. The group determined that they were not a decision
96 making body and all discussions are recorded in the minutes.
97 E. Goldberg: This Board can review the proposal(s)brought forth in a public hearing by the building owner
98 (Historical Society)however,the working group is not a decision malting committee. It is ultimately up to the
99 building owner as to what they want to do with this property.No actual proposal is in front of us. There would
100 need to be a zoning change if the townhomes were built.
101 J. Luz: Questioned why one of the proposals wasn't business related?
102 J. Simons. As we went through the process the focus was mainly on this building.It is evident that this building
103 poses an economic issue to a potential business,Residential made the most sense for the Historical Society.
104 Tom Zahoruiko: This is not a town owned or operated building. The owners have consent to what happens here.
105 Dialogue has come down to is the building important and to who? This building is important to the Historical
106 Society. History does not just begin at 100. The historical society gets to decide if the building stays.
107 Chris Allen on behalf of Stan Lim p ert-Historical Society,President; Several meetings occurred to discuss zoning
108 and what to do with the"Rogers Building" (aka Textile Museum). Stan's expressed a desire to preserve, the
109 building was built to represent to the heritage of the mills and the society wants to be good neighbors to everyone.
110 The"Rogers Building"was dedicated in 1960;the Common in 1959. The only solution addressing current zoning
Ill was the proposal put forward by Tom Zahoruiko;to construct(8)townhomes at the current site. The solution has
112 the lowest impact,would retain the appearance from the Common and would not impact traffic. Linder current
113 zoning, that building could be a daycare or a church. The building will now be out of the Society's hands;we are
114 not interested in maintaining a parking lot nor can it afford to demolish the building. The Historical Society has
115 voted formally to put forth this solution and we are taking this direction. No other proposals are being considered.
116 T. Zahoruiko: There are zoning considerations and multiple ways to approach this proposal, i.e. change in a
117 definition that would allow this without altering the zone. Either way,I believe this is still a Town Meeting issue.
118 I'd like to get in front of this Board next month with refinements.
119 Doug Evans 114 Academy Road. Has been a member of the historical society in the past. This Historical Society
120 strongly opposed a plan to convert the building into condos and apartments proposed by the developer who
121 purchased the building prior,to the Historical Society ten years ago. This is why he sought to purchase this
122 property. I am fiercely opposed to this proposal.The town has done an incredible job with this historical area
123 which is an asset to this town. This is not within the mission of a historical society's charter,There are alternate 1
14 proposals which have merit. Lilies the idea of preserving the land for a historical structure. There are proposals
125 which could use CPA funds.
126 Wendy Wakeman, 1.40 Academy Road. The Common was not created at the same time that the building was
17 constructed. It is uniquely surrounded by historic first period buildings older than the Textile Museum. This
128 building is not in keeping with the first period character.

129 Paul Craney, 80 Osgood Street: As a.member of the Historical Society and owner of an historic home on the
130 Common, am a millennial, and am very much opposed to this decision.
131 C. Allen: Clarified that the Historical Society never voted formally in 2006 to oppose condos in this area. There
132 were members of the Historical Society that were opposed to that plan. The President of the Historical Society
133 went through minutes and there is no record of a vote being taken. The common was dedicated as a common in
134 1959. The Rodgers building was constructed within a year of the Improvement,Society giving the common to the
135 town.
136 Michael Lenihan, 58 Osgood.Street,Old Center Historic District Commission: Was President of the North
137 Andover Historical Society in 2009 and wrote the letter to the town opposing the conversion of 114 Academy
138 Road into condominiums.

141 M. Gre oire: The MS4 public hearing was held on November 1, 2018 to review the Draft Stormwater Plan.A cWe
142 are currently working with the DPW as to whether the consultant will give that presentation again to this Board.
143 We have received a copy of the draft MS4 plan and it is federal law that this be submitted efficiently; the EPA
144 submits this under the MA DEP.
145 P. Boynton: The Planning Board serves as an enforcement agency of stormwater control;we refer to it in all our
146 decisions. A remarkable amount of work has been accomplished and this is a tremendous example of Best
147 Practices which desperately needs to be updated. It outlines the four watersheds of which the town is part of.
148 Would like to have DPW come to the Planning Board meeting to discuss the Plan. If they want to have to
149 consultant there,there more the better. Thinks that there should be two different meetings to discuss the plan and
150 the changes in water quality. It is more important to focus on this as it contains information on how sampling is
151 done.
152 E.E.Goldberg: Suggested the Board review the draft document and address this further at an upcoming meeting,
