The BOARD 0?APPEALS held a regular monthly meeting on Monday evening, July 9,
~79 at 7:30 P.M. in the Selectmen's ~eeting Room. The following members were
present and voting: Prank Serio, Jr., Chairman; Alfred E. Frizelle, Esq., Vice
-Chairman; R. Louis DiFruscio, Clerk; James D. Noble, Jr.; Richard J. Trepanier;
and Assoc. ~ember, William J. Sullivan.
PUBLIC I~INGS:
1 - ANDREW CIRCLE .REALTY TRUST, EARTH RAA~_OVAL PERMIT: Scott Follansbee, Trustee,
representing the Trust pointed out the location of property on Town map. The pond
has been proposed for a couple of reasons, he stated - drainage problem on Salem
St. will be alleviated by water flowing our at a lesser rate, additional drainage
created from road mud house construction can also be lessened by the pond. The
road comes in off Ingalls and ties in off loop at Laconia Circle and out to Forest
St. The pond is shown on plan as lot 39, is about 6 acres, to be given to the Town.
There is a committee working on the proposal a~ud Follansbee is amenable to any
suggestions the Town develops. Benefits to the Town are the two drainage problems,
provides a location for a park in the area. He continued that it additionally will
be a source of gravel and fill material in his developments and a couple of roads
in the Town, There is no need to do any trucking other than in this area. Approxi-
mately 4200 cu. yds. went to the Town for Salem St. out to Berry St. and has an
agreement with Bud Cyr to continue on the same price for the next couple of years
as he needs it. This is not the first pond he has been involved in, previously
built one on Lacy St. Follansbee felt that it would be aesthetically pleasing to
the area. It would be possible to .have trucking go out the power lin roadway to
eliminate all trucking on Salem St.
Serio inquired if the pond would be spring fed or stagnant water - Follansbee: did
not know, basically ground water. The intent is to go down ~2 ft. and an Order of
Conditions has been issued by the Con. Com. Frizelle asked what he would do if the
permit was not granted - he would use all the material on the site.
The Highway Surveyor stated that he had objected to slot of earth removal operations
in the Town over the past few years and, if a pond is approved, would hope that the
Town would get a goodly amount of gravel from it. Good gravel is rare commodity.
The availability of the gravel from this operation made it possible to do what was
done on Salem St. this year. (Note: a prior Niscellaneous Permit had been granted)
If it is run according to the By-Law and in strict accord with my department ~ud the
Police Dept. he said he would not oppose it. Felt that a further restriction should
be to contain hauling to N. A. only. If the Con. Com. and the Committee determine
this advisable, he would like to see the BOARD work out a solution to grant a permit.
John Coogan, resident, stated that his daughter and son-in-law live across the street
from the locus and has a copy of a letter from Cyr before the Con. Com. gave Orders
in which he states that he did not think there was enough water to maintain a pond on
a year-round ~sis. Cyr stated that it is questionable whether retention is very
great year-round.
Robert Watson, Forest St., stated that this pond rises and falls practically the same
as those in his land near-by and that there are definitely springs in the area.
Letters from the Con. Com. and the Planning Board were read by the Chairman.

about trucking on Salem St. being l~azardous condition, no guarantee that a pond will
ever exist year-round, a park would be disastrous to the area, etc.
Peter Huber, 1809 Salem St., felt that the proposal was very nice and that it will
alleviate some of the drainage problems but that the roadway along the power line
would be the thing to do. He requested a private meeting with the abutters to go
over a detailed plan of all that is proposed.
Mrs. Dunn, Ingalls St., stated that she had not seen one spring when Boston Brook did
not go over %e road and Huber's house is right in the middle of it.
Vince Turano, Con. Com. member, told those present that they are requiring further
testing after August 1 to see if it will sustain a pond. ~4ary Lachapelle added that
great consideration should be given to this before it is granted re safety factor,
policing, etc.
Frizelle asked what the over all plan would be - Follansbee: would like a total of
two years from now and it would be totally landscaped, lot 39 would be deeded to the
Town if they want it and if not the abutting properties could take it for additional
land. He stated that he would be willing to give a deed to Town Counsel to hold in
escrow if the Town .so desires. Cyr said he would use approximately 18,000 cu. yds.
over the two year period. At this point Bonnie Dunn stated that he well is 25 ft.
deep and if he hits thespring will he rebuild the well? No answer~ available.
Joe Rudinski, Winter St., asked how someone can get ~%wa~~ with building ~ pond like that
and everyone else who puts in ~ swimming pool has to completely fence it in? Some
safeguards must be taken by the Town. ~%~rther discussion took place reg~rding restora-
tion and Trepanier inquired about ~l~gae growth from fertilizers o~ Turano - Turano:
it looks very likely that this will require another hearing.
No%ion by Noble to continue the hearing until Au~-ust meeting because of unanswered
questions and the fact that the Con. Com. is going to check the water table after
Aug. 1. Second by Trepanier. Request was made for fencing. ]~oll~nsbee felt that
it would be more dangerous because children would climb on it. The BO~LRD req~ested a
snow fence within a week. Unanimous vote on motion.
