HISTORY AND BACKGROUND On August 28, 2018 the applicant requested a waiver of a Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.24, also known as section 4.136, as to allow the construction of a 384 sq. ft. deck. The deck will replace a smaller, pre- existing structure and will be located over an existing, impervious concrete patio with a stone overlay. The new deck will be constructed using helical piles. The new deck will be located within the 100-foot Non-Disturbance buffer zone of the Watershed Protection District. FINDINGS OF FACT The Planning Board has made its decision based on the following findings: • A plan was submitted entitled, Plan of Land in 209 Johnson Street, dated August 10, 2018 which details the structure's location,the distances from the wetland resource areas, and erosion control. • The proposed deck will add an egress from the property's second floor. This improves the existing safety conditions. • The deck will be constructed using helical piles, significantly limiting ground disturbance. • The structure will not disturb existing topography. • The proposed changes will not create a more detrimental impact on the wetlands than exist on the property and there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. DECISION After discussion at the September 6, 2018 Planning Board meeting, and upon a motion by J. Simons and seconded by A. Preston, the Planning Board Approves the Watershed Special Permit —Wavier with conditions. A vote of 5-0 was made in Favor of the waiver request. CONDITIONS
