To Whom It May Concern:
We,Corey and Christine Fritts,the homeowners of 209 Johnson Street, request from the Planning Board
a waiver from obtaining a Watershed Protection District Special Permit. We request this waiver in order
to build a deck on the back of our home. We believe that such a structure adds to the longevity and
value of our home. We recently removed an existing structure that had been there when we purchased
the home and was very unsafe. We understand that our project lies within the watershed 100 ft non-
disturbance zone.
The proposed structure consists of replacing the pre-existing deck which has been removed,along with
additional space,for a total of approximately 400 square feet. In addition,we wish to replace the
current patio pavers with standard concrete patio pavers. (Please see attached paperwork for exact
outline of the project.)
We believe this project will not only conserve, but add to the value of our property,as we are using
high-quality, long-lasting materials. There will not be any impact to the topography of the land,since we
are using helical piles,which do not require large holes to be dug. In addition,there will not be any
impact to the any wetland resource areas. As a plan for erosion control,we will place a filtration sock
along the Buffer Zone Resource Area. We agree to have the Town Planner perform a minimum of two
inspections during the construction process. Further,we agree that the Town Planner may stop
construction if the proper erosion control is not in place.
The construction for this project is scheduled to begin on,or around,September 24,2018, and is
expected to last no more than 4 weeks.

§ 195-4.24• Waiver of special permit.
A. When any construction proposed on an existing structure within the Watershed
Protection District will not expand the existing footprint of a structure, and will not
disturb existing topography,and is a proposal on Town sewer,the Planning Board may
determine, without a public hearing, that submission of a Watershed Protection
District special permit is not required. However, in order to obtain such a waiver, an
applicant must schedule and agree in writing for the Town Planner to perform a
minimum of two inspections during the construction process to ensure proper
erosion control is established during construction;the applicant must also agree in
writing that the Town Planner can stop construction if the proper erosion control is
not in place. For all proposals on septic,this section will not apply, and all applicants
should refer to§195-4..19A, B, C and D of this bylaw.

Mr. Fritts;
Norse Environmental Services flagged the resource areas at the above site on 7/26/18,
The resource areas on site include a Bordering Vegetated Wetland as defined in 310
CMR 10.55(2) and a pond with associated bank as defined in 310 CMR 10.54(2). The
wetland was flagged in the field with blue ribbon and metal tags labeled 1A-14A.
The Essex County Soil Suivey maps the site as a Ridgebury. These consist of nearly
level and gently sloping, deep(5+ ft.). They are a compact soil and often they have a
seasonal high water table at 18 to 24 inches.
The Bordering Vegetated Wetland primarily that area to the back of the yard behind the
fencing, it is a red maple swamp and the overstory consists of the following vegetation;
red maple (Acer rubrum), white pine (Pines strobes) and white ash (Fraxinus Americana).
The understory consists of glossy buckthorn (Rhamnus fiangula) and arrow-wood
(Viburnum dentatuin). The herbaceous layer consists of sheik cabbage (Syinplocarpus
foetidus), cinnamon fern (Osmunda cinnamomea) and sensitive fern (Onoclea sensibilis)
and a lot of jewelweed(Iris capensis).
The site is not located within Estimated/Priority Habitat Area as designated by the
Natural Heritage & Endangered Species Program. The USGS Topographic mapping
shows and area of riverfront(perennial stream) off the lot to the south with a small
section of river between the pond and a second pond to the west, this area of riverfront
would be off of the subject property. The proposed work will not have a detrimental
impact on the runoff to Lake Cochichiwek.
