HISTORY AND BACKGROUND On October 26, 2018 the applicant requested a waiver of a Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.24, also known as section 4.136, as to allow the construction of a 230 sq. ft. deck. The deck will be attached to the house on 2 sides and located over an existing, pea stone patio. The new deck will be constructed using sonotubes. The new deck will be located within the 100-foot Non-Disturbance buffer zone of the Watershed Protection District. FINDINGS OF FACT The Planning Board has made its decision based on the following fmdings: • A plan was submitted entitled,Plan of Land in 158 Coachmans Lane, dated May 29, 2018, revised to October 5, 2018 which details the structure's location and the distances from the wetland resource areas. • The deck will be constructed using Sonotubes. • The structure will not disturb existing topography. • The proposed changes will not create a more detrimental impact on the wetlands than exist on the property and there will not be any significant degradation of the quality or quantity of water in or entering Lake Cochichewick. DECISION After discussion at the November 13, 2018 Planning Board meeting, and upon a motion by A. Preston and seconded by J. Luz, the Planning Board Approves the Watershed Special Permit— Waiver with conditions. A vote of 5-0 was made in Favor of the waiver request. CONDITIONS 1. Proper erosion control will be constructed and will remain throughout the project, according to the conditions approved by the Planning Department staff. 2. The Planning Office will perform a minimum of two inspections during the construction process to ensure proper erosion control is established before and during the construction.
