RE: Request for Consent for the Petitioner to Re-Petition the Zoning Board of Appeals

Dear Ms. Enright:
On behalf of the applicant, we hereby request for consent for the petitioner to re-petition
the Zoning Board of Appeals in accordance with section 10.8 of the North Andover
Zoning Bylaw. A petition for Variances was denied by the Zoning Board of Appeals on
May 8, 2018. Specific and material changes have been made to the Variance Plan based
on comments received by the ZBA during the May 8, 2018 hearing. A Finding
application was filed with the ZBA to determine if specific and material changes have
been made. On August 14, 2018, the ZBA voted 5-0 in favor of the finding.
The changes made to the Variance plan that was denied by the ZBA are as follows:
1. The size of the proposed building has been reduced by 200 s.f (7.7%
reduction).
2. The proposed building was moved back 5' to increase the front
setback to 31 (100' required, 26' previously proposed)' and reduce the
rear setback to 3 F (50' required, 36' previously proposed).
3. The requested side setback variance has been revised to 22' (25'
required, 40' was previously stated as required, 18' was previously
provided). This is a 57.1%reduction in side setback relief.
4. The parking spaces have been relocated further from Turnpike Street.
5. An additional variance has been requested to allow for parking within
the first 15' of a setback abutting a residential,district.
6. The architectural style of the building has been revised. The denied
building architectural plan and the revised architectural plan are
attached.

A copy of the denied Variance plan, architectural plans, Revised Variance Plan used for
the ZBA Finding, and revised architectural plans have been submitted with this request
for your review.
We are requesting the Planning Board to determine whether specific and material
changes have been made to grant consent for the petitioner to re-petition the Zoning
Board of Appeals. We look forward to discussing this at the September 25, 2018 public
hearing.

Project Description
An application for variance was denied by the North Andover Zoning Board
of Appeals on May 8, 2018 for the above referenced property. As required
under section 10.8 of the North Andover Zoning Bylaw, we have made what
we believe are "specific and material changes"to the plan. The following
changes have been made to the plan:
