HISTORY AND BACKGROUND On January 2, 2019, the applicant attended a Technical Review Committee (TRC) meeting regarding the Billy Sweet Chimney Sweep's relocation of its business to 707 Turnpike Street. Based on the scope of work discussed at this meeting, the applicant requested a waiver of a Site Plan Review Special Permit on January 3, 2019, in accordance with the North Andover Zoning Bylaw section 195-9.11.c, as to allow for the operation of a Chimney Sweep business with associated parking in the General Business (GB)Zone. The Applicant has submitted the following information: • The prospective occupant's use of the approximately 3,816 sq.ft. space as office space is allowed as a matter of right within the General Business (GB) zoning district and such use is similar to the use by the previous occupant(Countryside Real Estate); • A plan was submitted entitled, "707 Turnpike Street Parking" overlaid on a plan entitled "Conservation As-Built for 707 Turnpike Street" dated April 24, 2012 which details parking for 12 vehicles on 1/4 bluestone gravel driveway; • The project maintains the current gravel driveway and includes the creation of three (3) angled parking spaces in an area currently grassed area. Gravel or permeable pavers will be used as the base material for these parking spaces; • The prospective occupant intends to use the premises in"as is" condition initially, and will obtain a building permit for any future modifications to this building's interior space; • Field staff will swap out personal vehicles for company vans during operating hours; • Vans will remain parked onsite overnight; • The hours of operation are 6:30 am—6:30 pm. All loading and preparation for trucks will take place during the afternoon. 707 Turnpike Street Map 98.1),Parcel 47 Site Plan Review Special Permit-Waiver Page 2 of 2 FINDINGS OF FACT The proposed use has been determined to be minor and can be completed without further review by the Planning Board, according to the following: The proposed change falls into the category as defined in Section 195-8.11.C.L, which states that the change "...will not have a significant impact both within the site and in relation to adjacent properties and streets." DECISION After discussion at the January 8, 2018 Planning Board meeting, and upon a motion by J. Simons and seconded by A. Preston, the Planning Board Approves the Site Plan Review Special Permit wavier with conditions. A vote of 5-0 was made in Favor of the waiver request. CONDITIONS 1. The applicant must file an application with the Town of North Andover Conservation commission and provide the Planning Board with an approval. 2. The parking spaces shall be clearly delineated. 3. Vans shall be parked behind the building overnight. 4. A report and photographs of the site detailing the work done in the driveway and parking areas must be submitted one year from the decision date. If The Board determines that conditions have deteriorated, the applicant will be required to file with Planning for stormwater review. 5. Should the need to change the materials or pave the driveway and or parking areas arise, The Applicant shall file a Site Plan Review Special Permit Application for review of the Site and Stormwater Management Requirements.
