11 M. Gyre: This applicant seeks to add a lot line,transferring ownership of part of his parcel.The new lot
12 exceeds the one acre stipulation and has frontage of 150 ft. meeting the minimum requirements for R2. There are
13 no wetlands on the new lot.The new lot being created will be sold as a single family home.
14 MOTION: A. Preston made a motion to approve the ANR and directed the staff planner to sign the mylar on
15 behalf of the Board for 2051 Salem Street,Ruth Richards Revocable Trust c/o Cleon Richards.J. Simons
16 seconded. The vote was 4-0,unanimous in favor.

18 234 Brentwood Circle Sara Goldsmith Schwartz&William Hannum: Waiver Request for a Watershed Special
19 Permit under Sections 195-4.136, 10.3 and 10.31 of the North Andover Zoning Bylaw. The Applicant proposes to
20 remove an in-ground swimming pool within the Non-Disturbance Zone. The project is located within the
21 Residential 1 (R-1)Zoning District. Was heard by Conservation and received approval.
22 M. Gregoire: This applicant is seeks to remove an in ground swimming pool in the watershed, restoring the
23 topography to grade and loaming and seeding the lot.This will require a pre-construction meeting and two site
24 visits.
25 Carol Robertson Applicant's representative: The pool was grandfathered in; it is quite old and crumbling.
26 Material will be taken off site and clean fill will be added.The liner will be removed.Erosion control will be t
27 provided on site. The liner will be removed,clean fill will be compacted on site.
28 MOTION: J. Simons made a motion to waive the Watershed Special Permit for 234 Brentwood Circle, Sara
29 Goldsmith Schwartz&William Hannum subject to the conditions outlined.A. Preston seconded. The vote was 4-

32 722 Great Pond Road Ronald W.Johnson Revocable Trust: Waiver Request for a Watershed Special.Permit under
33 Sections 195-4.136, 10.3 and 10.31 of the North.Andover Zoning Bylaw. The Applicant proposes replacing the
34 existing 2nd floor deck with a smaller footprint within the Non-Disturbance Zone. The project is located within `
35 the Residential 1 (R-1)Zoning District.
36 M. Gregoire: The applicant is looking to replace a cantilevered rotting deck using two helical piles as supports
37 having minimal impact;there is no change to the topography. This requires a pre-construction site meeting and
38 two site visits.
39 MOTION: J. Simons made a motion to waive the Watershed Special Permit for 722 Great Pond Road,Ronald W.
40 Johnson Revocable Trust subject to the conditions outlined.A. Preston seconded. The vote was 4-0, unanimous in

44 Bowdoin Capital Group,Alex Lath: Potential for a Zoning Map amendment article for a zoning district change
45 from Corridor Development District 2 (CDD2)to General Business(GB)for the following parcels of land located
46 at the corner of Hillside Road and Turnpike Street: 190 Hillside Road, 182 Hillside Road, and 582 Turnpike
47 Street located at the corner of Hillside Road and Turnpike Street.
48 J. Enrighf: The two uses proposed for the site area bank and caf6. At the last meeting you discussed decreasing the
49 minimum lot size in the CDD2 to one acre versus the required two acres. One acre is the requirement in CDD. The
50 existing use regulations have restrictions for both a bank and cafe with a drive through. Presented draft edits to the
51 bylaw in the CDD1 and CDD2 districts.
52 J. Simons: Inclination is not to allow a restaurant drive-through but okay with reduction in minimum area.
53 E. Goldberr;: Agreed; doesn't have a problem with a restaurant but a drive thru is problematic.
54 A. Preston: A traffic study is warranted and a special permit would allow for that data to be provided.
55 J. Simons: Requested info on the front to back depth of lots across the street.
56 J. Enright: Noted the draft edits eliminate Route 133 from the CDD district.
57 A. Loth Bowdoin Capital, 76 Innis St.: Would like to see consistency and flexibility between the restaurant
58 portion of CDD1 and 2 districts so that things get redeveloped within the zone; in CDD2 you have 400ft. from a
59 residence(5 acres)v. in CDDI you have (1 acre)250 ft. from the district and no lot size restriction other than the
60 zone. Suggested aligning the two zones. Suggested that if the lot size is reduced to an acre,the frontage should be
61 reduced as well to be consistent with the CDD2.
62 John Casey, abutter 84 Innis Street: Requested a summary of the current discussion. The proposed coffee shop is
63 considered a restaurant. Requested a two acre requirement be required for a drive through.
64 J. Zahoruika abutter 182 Hillside Road: Asked for clarification as to whether the 250 ft. lot frontage requirement
65 could be frontage on Hillside Road. Stated that this impacts his lot as it would stand to be an isolated home. The
66 only corner in the CDD2 zone is on Hillside. Asked if there is any way to prevent his home from becoming
67 isolated.
68 E. Goldberg:Not if this is voted on at Town Meeting it will allow MINCO to develop of the lot(s). A special
69 permit discussion at a later date would include curb cuts, police,traffic, fire access, etc.
70 A.Loth.Noted that if they don't purchase Mr. Zahoruiko's lot,the existing 15 ft. easement will give Mr. Casey's
71 lot more of a buffer.
72 J. Enright: Will provide information on the depth of CDD1 lots, existing frontage for each individual lot and
73 prepare a calendar leading to Town.Meeting.

86 MOTION: A. Preston made a motion to close the public hearing Cor Subdistrict A Definitive Master Plan Special
87 Permit for 4 High Street. P.Boynton seconded. The vote was 5-0, unanimous in favor.

91 Potential May 2019 Town Meeting Zonini Bylaw Amendments:
92 Tom Zahoruiko 1665 Great Pond Road: Potential amendment article to the Large Estate Condominium
93 Conversion Zoning Bylaw to allow for the potential for converting the existing structure located at 800 Mass.Ave.
94 to eight(8)residential condominiums.
95 T. Zahoruiko: Presented a revised proposal that does not require a zoning bylaw amendment;to subdivide the
96 property into three lots. This would create individual lots for the Historical Society,an Open Space Parcel along
97 Academy Rd. and the Rogers Building(800 Mass,Ave.). Displayed a Proof Plan of the 76,200 sq. ft. site; frontage
98 for all three lots complies with R3 zoning; assumes removal of the annex to the rear of the Rogers Building. This
99 demonstrates viability and proves the density under current zoning. The headquarters is compliant at 25K.sf.,the
100 Rogers Building may require a variance for a setback along the side/rear of the Historical Society. The preserved
101 Open Space lot establishes value.A Conservation Restriction and covenants could be placed on the Rogers
102 Building when sold;use is consistent with zoning.As we learned, commercial use wasn't well received;
103 presumably this would become a single family home. This eliminates traffic concerns;visually nothing will
104 change. Stated he is acting as an unpaid consultant and facilitator to the Historical Society.
105 E. Goldberg: This plan is elegant in its simplicity leaving the property for a single family home.
106 J. Simons: This protects the last piece of land on Academy Rd.You have enough frontage along Mass. Ave. which
107 is where the entry would presumably be.
108 Stan Limpert, Historical Society President: The Historical Society Board unanimously decided to sell the property
109 at a special meeting held last week. The membership will need to vote. We are very pleased we have gotten this
110 far.
111 Brad Wakeman, 140 Academy Road: This continues the legacy of preservation and preserves the Caroline Rogers
1.1.2 Building and Lot 2 as Open Space for the future.Displayed and reviewed protected land parcels in the vicinity
113 (Common to Weir Hill).
114 T. Zahoruiko: Requested to withdraw the original proposal to alter the zoning bylaw.

116 350 Great Pond Road Christopher Burt& Ellen Goodwin: Application for a Watershed Special Permit under
117 Sections 195-4.17 and 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes replanting of
118 landscaping in the Non-Discharge and Non-Disturbance Zones. The project is located within the Residential 1 (R-
119 1)Zoning District,
120 M. Gregoire: At the last meeting,we opened the hearing and the Board requested clarification from the applicant
121 as to what they wanted approval on. The application was only for an"after the fact",replanting plan,which was
122 discussed. During that hearing;the applicant asked for consideration of several patios on site; one existing and
123 one proposed. The proposed patio is a 10 ft. x 10 ft, slate patio. The applicant has not yet clarified with the
124 planner the full extent of the work. At the last meeting,the Board expressed it was acceptable to replant"like
125 number of trees" and native trees and shrubs in the Non-Disturbance zone. The landscape architect would be .
126 required to submit a new plan considering the original base plantings around the house contained non-native
1.27 plants; Conservation would need to review the overall planting plan.

128 P. Boynton: We also discussed comparative size of plantings. We weren't looking for a"shrub"to replace the
129 large trees that were taken down.
130 A. Preston: It's more of a soils structure issue. The roots holding the soils together, so you don't get the erosion.
131 J. Simons: This would be a little but higher than a 1:1 ratio if we are replacing 80 year old mature trees with
132 smaller trees. We want a robust root system in place so that the soil stays where it is.
133 Chris Burt, owner: We want to do Canadian Hemlocks,I don't want the lot to look bare.The goal is to restore it
134 back. I recall estimating 35 trees but this is a work in progress. Agreed to revise and clarify the plan and return to
135 the Board at the next meeting, Outlined location of additional slate patio and walkway.
136 B. Goldberg: Procedurally, I'm not sure this project has been advertised to include this. The best approach is to
137 approve the replanting permit and have a separate application for the patio. There's water discharge evaluation,
138 etc., it should be simple. Will this patio impact the lake?
139 M. Gregoire:Normally,we would review this with the town engineer. It can change the rain runoff, can it handle
140 1"rainfall, etc.? With ground disturbance, does it require a trench or a rain garden?
141 C. Burt: This patio is just going to be placed down slate. I'm reusing existing slate pavers near to the walkway. It's
142 not a huge project.
143 A. Preston: What was the area of the old walkway you removed v. the area of the proposed patio?
144 C. Burt: Approx, a 25 ft. x 3 ft.walkway from the driveway to the front door. I don't know what he's proposed
145 because we're not there yet. This isn't going to be an enormous patio,just a cookout area.
1.46 L. Crane: What happened with the old walkway is there plan to fill it in?
147 C. Burt: The dirt basically just settled.
148 M. Gregoire: That didn't require approval during construction. The construction application was only for the
149 rebuilding of the house and did not include anything involving a patio.
150 A. Preston: We have to split or amend the application if this has impact.
151 P.P. Boynton: This plan is only being used for reference. This isn't"the"plan?The plan reviewed at the last meeting
152 called for vista pruning?This plan is not final;what parts of this plan are you doing?
153 C. Burt: We want to snake it"the plan'; honestly, I don't know what"vista pruning" is. This is on the other side of
154 the house.
155 M. Gre oire: Presumably,vista pruning would be conditioned out;this plan is superimposed over a plan that
156 expired years ago.
1.57 Board: Reviewed application.
158 1. Enright: The application was specifically for replanting; the applicant has since requested a 10 x 10 patio which.
159 remains on grade.The topography or grade will not change. The pavers will typically be spaced up to an inch
160 apart;you can grade a patio slightly,there's landscaping around it. If this was a stand-alone project, we would
161 condition erosion control be placed around it during construction. This narrative didn't reference patios;there are
162 two existing brick re-lay areas, and a slate patio.
163 Board: Conditioned all replacement trees be of like quantity,type and size to the original (ratio to be a little more
164 than 1:1); Plantings in the Non Disturbance zone to be native species, large tree near the garage may be de-limbed
165 for safety v, being removed, reconstructed brick areas to occur in the same location and be similar to existing
166 grade and appropriately sloped to a pervious area,with erosion controls in place during construction; new slate
167 patio approx. with no changes in topography or grade will be appropriately sloped to a pervious area, with erosion
168 controls in place during construction; and Planning will perform a required field visit in a year; vista pruning is not

174 495 Main Street,Town of North Andover: Application for a Special Permit—Site Plan Review under sections
175 195-8.10 through 8.17 and 195-10.7 of the Town of North Andover Zoning Bylaw. The Applicant proposes to
176 construct a recreational complex including athletic fields,tennis courts,picnic areas and associated parking areas,
177 walkways and emergency/maintenance access paths. The Property is located in the Residential 4(R4)Zoning
178 District.
179 M. Gregoire: This application is being submitted on behalf of the flown. Several departments have reviewed the
180 project; Conservation opens 1/23/2019; Building and Fire have submitted comments; Health has yet to weigh in
181 and stormwater peer review has been submitted.
182 Craiv Miller, President-Waterfield Design Grou Civil En ineers &L.A&Jacob Murray,Lead Pro'ect
183 En�eer: Gave a general overview of the 16 acre project. Described underground drainage and topography;there
184 is no net increase in runoff created by the project. Described lighting and parking plans. Construction will begin
185 this summer starting from the back of the site working forward. There will be two construction seasons. Turf fields
186 will continue to be used for summer fireworks.
187 P. Boynton: Questioned the life span of the artificial turf and expense associated with replacement.
188 C. Miller: The product being considered has already been installed here-at the High School; lifespan is ten years or
189' so, It is less expensive to maintain turf than it is to manage grass. We will address traffic numbers in the coming
190 weeks.
191 L. Crane: Commented on the scale of the project,traffic congestion and parking issues adjacent to the expanded
192 kindergarten, lighting, congested and chaotic entry and egress queuing to and from the site.
193 Margaret Legal, abutter,26 Hemlock Street: As caretakers of the future, voiced concern for the artificial turf
194 material specified for the fields,the water table and safety for children playing on it.
195 P. Boynton: Perhaps we should pursue sound third party advice on the artificial turf. Our decisions reference"this
196 will not adversely impact". We should know what the trade-offs are; cost is one criteria, safety is another.
197 J. Simons: Suggested the town/Board seek input from the Board of Health on the safety of the artificial turf
198 product being considered versus grass. (air quality,concussions, general hazards, etc.)
199 Susan Faucher, abutter, 50 Parker Street: Concerned about parking on Parker Street&emergency vehicle access.
200 Parking occurs at the end of driveways as parents are walking children into the schools.
201 Kim Reardon abutter, 62 Parker Street: Concerned about parking, egress only on Parker Street; mornings and
202 afternoons are problematic; it is supposed to be evenings only,however people are entering and parking.
203 Numerous tall light poles will be bright; inquired when they will be turned off in the evening. Requested trees of
204 hardy caliper as children play on them.
205 Rick.Green, Chairman of the Recreational Complex Subcommittee: Although Parker St. is outside project limits,
206 we have committed to working with the DPW and Police to address neighbor's concerns.There will be no
2.07 trucking on the side roads and a direct egress will be designated directly to Route 125;the middle school gate will
208 be operated similarly and shut at the end of the evening.
209 Steve Faucher..abutter, 50 Parker Street: Voiced his dissatisfaction with the$8 million project,traffic and parking
210 along Parker, Faulkner and Hemlock Streets.

211 Steve&Emily Kennedy, abutters, 135 Beacon Hill Blvd.: Concern for loitering, construction, hours of use, heavy
212 equipment staging, fields drainage, dust,noise, dirt, etc, Their front lawn damaged by heavy equipment during the
213 construction of the kindergarten expansion. Because their home is so exposed,wants assurance that a full privacy
214 fence will be provided v. a chain link fence as a buffer, when tree growth is removed.
215 Jamal Saunders abutter,49 Parker Street: Expressed support for the project. Concerned for fields and drainage.
216 Wants assurance that a project manager will be available during construction in the event that abutters have critical
217 issues associated with the project.
