BOARD OF SELECTMEN MINUTES January 28, 2019
CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:00PM in the Town Hall
Meeting Room. The open session meeting was recorded.
ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing
Chairman, Chris Nobile, Richard Vaillancourt, Rosemary Smedile, Town Manager Andrew Maylor, Deputy
Town Manager, Meghan Jop, Assistant Town Manager, Denise Casey and Executive Assistant, Laurie
Burzlaff.

APPROVAL OF MINUTES:
Chris Nobile made a MOTION, seconded by Richard Vaillancourt to approve the Executive Session
Minutes of December 27, 2019. Motion approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Chris Nobile to approve the Open Session
Minutes of January 14, 2019. Motion approved 5-0.
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero to approve the Open Session
Minutes of January 22, 2019. Motion approved 5-0.
GOVERNMENTAL REPORTS
Update on Recreation Complex
Assistant Town Manager, Denise Casey, gave an update regarding the Recreation Complex. The bid
should go out in mid-March with construction to begin in the spring.
Rick Green of 357 Rea Street and chair of the Middle School Fields Committee explained that the Middle
School Fields Committee has completed their charge so there will not be any further meetings. A
fundraising group will now be formed.
Update on Senior Center Project
Deputy Town Manager, Meghan Jop, gave an update on the Senior Center project. The project is in the
final stages of schematic design.
CONSENT ITEMS (taken out of order)
Request of North Andover Little League to close Main Street from Water Street to Waverly Road, Waverly
Road from Main Street to Dana Street and Dana Street on Saturday, May 4, 2019 from 8:15AM to
10:00AM for their annual Little League Parade
Marc Cooperstein of the North Andover Little League was present to explain the request to hold their
annual parade. All relevant departments reviewed the request and had no issues. The route is the same
as years past.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen approve the request of the North Andover Little League to close Main Street from
Water Street to Waverly Road, Waverly Road from Main Street to Dana Street and Dana Street on
Saturday, May 4, 2019 from 8:15AM to 10:00AM. Motion approved 5-0.
LICENSING COMMISSIONERS:
Phil DeCologero made a MOTION, seconded by Richard Vaillancourt to open a meeting of the
North Andover Licensing Commission. Motion approved 5-0.
Request from Merrimack College for three one day wine and malt licenses for concessions at the Rogers
Center on the following dates/times:
February 21, 2019 from 6:00PM-11:00PM
February 22, 2019 from 6:00PM-11:00PM
February 23, 2019 from 2:00PM-9:00PM

acting as Licensing Commissioners, approve the three one day wine & malt licenses for

Merrimack College for concessions at the Rogers Center on February 21, 22 and 23, 2019, as
presented. Motion approved 5-0.
Request from Smolak Farms for two one day wine and malt licenses for dinners at the farm stand from
5:30PM-9:00PM on February 14, 2019 and February 16, 2019
Regina Kean made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen,
acting as Licensing Commissioners, approve the two one day wine and malt licenses for dinners

at the farm stand at Smolak Farms from 5:30PM to 9:00PM on February 14 and February 16, 2019,
as presented. Motion approved 5-0.
Rosemary Smedile made a MOTION, seconded by Regina Kean to close a meeting of the North
Andover Licensing Commission. Motion approved 5-0.
CONSENT ITEMS (continued)
Accept grants from Commonwealth of Massachusetts Executive Office of Public Safety and Security in
the amount of $4,354.00 for Student Awareness of Fire Education (S.A.F.E) program and $2,600.00 for
the senior S.A.F.E. program
These are grants the Fire Department receives every year for fire safety education.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen accept the grants in the amount of $4,354 and $2,600 from the Commonwealth of
Massachusetts for the S.A.F.E. programs. Motion approved 5-0.
Accept grants from Commonwealth of Massachusetts Executive Office for Administration and Finance in
the amount of $25,000 for developing a Gap Assessment and for $32,500 to develop a Continuity of
Operations Plan
These two grants are a result of the Town entering into the second Community Compact with the Baker-
Polito Administration.
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
accept the grants in the amount of $25,000 and $32,500 from the Commonwealth of
Massachusetts for the development of a Gap Assessment and development of a Continuity of
Operations Plan. Motion approved 5-0.
Accept grant from the Lawrence Partnership in the $67,500 for marketing campaign
from the Municipal Discretionary Fund established to
support business recovery after the Columbia Gas disaster.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
accept the grant in the amount of $67,500 from the Lawrence Partnership for the business
marketing campaign. Motion approved 5-0.
Appointment of two members of the Board of Selectmen to the Utility Abatement Review Board
The Utility Abatement Review Board was established to hear appeals of water/sewer abatement requests
that have been denied by the Department of Public Works. The policy, which was adopted by the
Selectmen in 2015, requires 2 members of the Board of Selectmen to serve on the Board. There is
currently an appeal pending which must be heard no later than February 15, 2019.
Phil DeCologero made a MOTION seconded by Richard Vaillancourt that the Board of Selectmen
appoint Chris Nobile to serve on the Utility Abatement Review Board. Motion approved 5-0.

appoint Phil DeCologero to serve on the Utility Abatement Review Board. Motion approved 5-0.
Vote on scope of work for municipal management recruitment firm for the Town Manager search
Included in the packets was the Request for Quotes for an Executive Recruiting Consultant for the Town
Manager search. The Board asked for the scope to include defining the roles of the consultant and the
screening committee and educating the committee on their roles and responsibilities.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen accept
the Request for Quotes for an Executive Recruiting Consultant, as amended. Motion approved 5-0.

Chairwoman Kean informed the Board that Lyne Savage has accepted the appointment as Acting Town
Manager.

CALL TO ORDER: Chairman Regina Kean called the meeting to order at 5:00PM in the Town

EXECUTIVE SESSION
Executive session-M.G.L. Chapter 30A, §21(a) reason #2-to conduct contract negotiations with non-union
personnel
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen enter into Executive Session for Reason #2 under MGL Chapter 30A Section 21(a), to
conduct contract negotiations with non-union personnel not to return to open session. Roll call
vote- Vaillancourt-yes; Kean-yes; Smedile-yes; DeCologero-yes. Motion approved 5-0.
The Town Manager informed the Board that he is in the process of negotiating a position with the state.

Jeff Gartside was sworn in as Fire Lieutenant.
Retirement of Lieutenant Robert Bonenfant
Lieutenant Bonenfant retired after 32 years on the job. Chairwoman Kean presented Lieutenant
Bonenfant with a certificate of appreciation.
Distinguished Budget Presentation Award from Government Finance Officers Association
For the sixth year in a row, the Town received the Distinguished Budget Presentation Award from the
Government Finance Officers Association.
CONSENT ITEMS (taken out of order)
Vote to approve and sign the Fire Chief contract
The Town Manager recommended the contract with Fire Chief, William McCarthy be renewed. A copy of
the contract was included in the packets.
Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen
approve and sign the contract between the Town and Fire Chief William McCarthy. Motion
approved 5-0.
APPROVAL OF MINUTES
Richard Vaillancourt made a MOTION, seconded by Chris Nobile, to approve the Open Session
Minutes of December 17, 2018. Motion approved 5-0.
DONATIONS
Accept donation from Elizabeth Armstrong to the Fire Department in the amount of $500.00
For the past several years, Elizabeth Armstrong has generously donated to the Fire Department and the
Police Department.
Accept donation from Elizabeth Armstrong to the Police Department in the amount of $250.00
Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt that the Board of
Selectmen accept the donations from Elizabeth Armstrong of $500.00 to the Fire Department and
$250.00 the Police Department to the to be used for any needed services or materials for the
departments. Motion approved 5-0.
Accept donation from the Joseph N. Hermann Youth Center, Inc. to Youth and Recreation Services in the
amount of $8,700.00
The JNHYC raised funds at their annual auction for Youth Center memberships for families that do not
have the ability to pay for a membership.
Chris Nobile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen accept
the donation of $8,700.00 from the Joseph N. Hermann Youth Center, Inc. to Youth and Recreation
Services to be used for memberships. Motion approved 5-0.

Rosemary Smedile made a MOTION, seconded by Richard Vaillancourt to open a meeting of the
North Andover Licensing Commission. Motion approved 5-0.
Request for six one day wine and malt licenses for dinners at the farm stand at Smolak Farms on the
following dates/times:
January 18, 2019 from 6:00PM-10:00PM
February 2, 2018 from 5:30PM-9:00PM

Vote to approve and sign the Police Chief contract
Included in the packet was the renewal contract with the Police Chief. The Town Manager recommended
the Board sign the agreement.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen sign the contract between the Town and Police Chief Charles Gray. Motion approved 5-
0.

Process for assessing properties and requesting an abatement
The Town Manager explained the process for assessing properties and requesting an abatement. The
Town will be posting frequently asked questions and answers regarding the process. Chairwoman Regina

Vote to accept resignation of Town Manager, Andrew Maylor
Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept
the resignation of Town Manager, Andrew Maylor, effective February 17, 2019 and to authorize the
Chairman to enter discussions with Andrew Maylor regarding post resignation consulting
services. Motion approved 5-0.
Discussion regarding process for hiring new Town Manager
Report from previous screening committee chair
Jim Xenakis, chair of the screening committee that hired Mr. Maylor gave a report regarding the previous
screening process. The same process was used in hiring the last two town managers. Both times a
consultant was used. The search committee did not make a recommendation of who to hire, they just
forwarded the names of the finalists to the Board of Selectmen.
Vote on whether to hire a municipal management recruitment firm
Assistant Town Manager, Denise Casey, explained the advantages of using a consultant and gave a brief
timeline of the process.
Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of
Selectmen authorize Denise Casey to obtain proposals from at least 3 municipal management
recruitment firms. Motion approved 5-0.
Vote to appoint Acting Town Manager
Per Town Charter, Chapter 4, Section 11-1, the Board of Selectmen shall designate, within 10 days, a
Town employee or other person to exercise the rights and perform the duties of Town Manager during
any vacancy caused by the temporary absence or suspension, or removal, resignation, or death of the
Town Manager. The appointment shall be for a period not to exceed 90 days, and it may be renewed, in
the case of suspension, removal, resignation, or death only once for an additional period not to exceed 90
days. The appointee shall be ineligible for appointment as Town Manager.
Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen
appoint Lyne Savage as Acting Town Manager for a period not to exceed ninety days and to grant
Chairman Kean the authority to discuss compensation with Ms. Savage. Motion approved 5-0.

Vote on makeup of the search committee
Per Town Charter, Chapter 4, Section 1-2, the Board of Selectmen shall appoint a search committee of at
least three people, not to include any member of the Board of Selectmen, for the purpose of
recommending candidates for the position of Town Manager.
Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen create a
search committee consisting of 5 members, with each Selectman choosing one member, for the
purpose of recommending candidates for the position of the Town Manager. Motion approved 5-0.
