NOTICE OF DECISION
Watershed Special Permit-Waiver
Date of Decision: August 5,2014
Application of: Lynette Kelly

Premises Affected: 240 Dale Street, North Andover, MA 01845, Map 64 Parcel 19, within
the R-1 zoning district.
BACKGROUND
On July 30, 2014, the applicant, Lynette Kelly, requested a Waiver of the Watershed Protection
District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so
as to allow the extension of a walkway and a 12' x 20' turn-around within the Non-Discharge
Buffer Zone of the Watershed Protection Zone.
FINDINGS OF FACT
On behalf of the Planning Board,the Community Development Director, Curt Bellavance,has
approved a Watershed Special Permit Waiver based on the following findings:
• The walkway and turn-around area is more than 100' from a wetland resource area, thus
located within the Non-Discharge area of the Watershed Protection Zone.
• The extension of the walkway and new turn-around area will be constructed with
pervious paves that will allow runoff to discharge to the ground and are approximately
250' from a wetland resource area.
• There will be no re-grading and excavation will be limited to that required for installation
of new pavers.
• Sedimentation control will be installed prior to any work being performed.
CONDITIONS
• The applicant is required to apply for a Watershed Special Permit for any additional
construction of outbuilding or building additions.
• The proper erosion controls must be in place before the start of the project.
• The Planning Office will perform an inspection after the deck has been constructed.
