NOTICE OF DECISION
Watershed Special Permit - Waiver
Date of Decision: June 19,2013
Application of: Walter White
400 Dale St.
North Andover, MA 01845
Premises Affected: 400 Dale Street, North Andover, MA 01845, Map 64 Parcel 34,within
the R-1 zoning district.
HISTORY AND BACKGROUND
On June 18, 2013, the applicant, Walter White requested a Waiver of the Watershed Protection
District Special Permit, in accordance with the North Andover Zoning Bylaw section 4.136.8, so
as to allow the building of an 18' X 16' deck within the Non-Discharge Buffer Zone of the
Watershed Protection Zone.
FINDINGS OF FACT
On behalf of the Planning Board, the Town Planner has approved a Watershed Special Permit
Waiver based on the following findings:
• The proposed deck is more than 100' from a wetland resource area,thus located within
the non-discharge area of the Watershed Protection Zone.
• The deck will be 16' X 18' in size and will be 3' to 5' off the ground. It will be
constructed using wooden boards that will allow runoff to discharge to the ground under
the deck.
• The deck will be attached to an existing single family home and will not have a roof. It
will be supported by three support posts that will require approximately 1'square concrete
supports.
CONDITIONS
• The applicant is required to apply for a Watershed Special Permit for any additional
construction of outbuilding or building additions.
• The Planning Office will perform an inspection after the deck has been constructed.
