("TBI") which operates a solid waste handling and recycling facility at 210 Holt Road,North Andover ("the facility").' The North Andover Board of Heath ("the Board") issued a site assignment decision for the facility on June 22, 2006 ("site assignment"). As counsel for TBI, I am familiar with the site assignment as well as the state regulations 310 Code Mass. Reg. §§ 16.00 (2018) governing the operation of the facility. I reviewed the Authorization to Operate Renewal of the Large Handling Facility recently submitted to MassDEP Northeast Region, which. includes the proposed modification that TBI now seeks from the Board, and the Operation Mortification Plan and Exterior Plan, dated December 18, 2018, prepared by Green Seal Environmental, Inc., and submitted to MassDEP on behalf of TBI. The proposed modification would add two temporary structures with one at each end of the facility. The temporary structures will not be used to process any materials and no unprocessed construction and demolition materials will be stored in the temporary structures. The temporary structure at the east end of the facility will be used to store clean, unpainted wood that has not been mixed with other construction debris (i.e. pallets, wooden boxes, and crates) before it is recycled along with processed wood awaiting shipment off-site for reuse. The proposed structure located on the west end of the facility will be used to temporarily store bailed post processed non-recyclable materials ready :for transport offsite and it will also afford protection from weather and the elements to residents stropping off materials at the facility. i I am also a curTertit resident of North Andover and former Member of the Board of Selectmen, Strategic Planning Coinrrlittee and Conservation Commission. As to various questions of fact, material to such opinion, I have, when relevant facts were trot iiidependently established, relied upon information furnished to ine by Jeff Thomson, President ofTB1 and based upon his communications with MassDl3'P. Based upon my familiarity with the requirements of the site assignment, the legal affairs of'1131, and my observations and knowledge of the facility from numerous visits to the site over the past I I years, I am of the opinion that the proposed modification would not present any danger to the health, safety, or wellness of the residents of North Andover. Applicant. ) DECISION The North Andover Board of Heath("the Board") hereby issues this preliminary and conditional approval of the proposed operational modification of Thomson Brother's Industries, Inc.'s (TBI) construction, demolition and recycling facility at 210 Holt Road, North Andover ("the facility") On June 22, 2006, the Board issued a site assignment decision for the facility ("site assignment"), The current proposal for installation of temporary structures for storage of clean and processed unpainted wood and the storage of post-processed and baled/bagged non-recyclable material does not require site assignment modification but merely approval by the Board in accordance with the provisions of the site assignment, and further approvals by other-Town of North.Andover Departments and the Mass,DEP before any installation may occur. On January 24, 2019, the Board held hearing, at its,regularly scheduled meeting, which was properly noticed and open to the public, regarding TBI's proposed operational modification to the facility. Jeff Thomson, President of TBI and a North Andover resident, appeared before the Board and provided testimony and documentary evidence. The Board reviewed, among other things, request for Authorization to Operate Renewal. and. Modification of a Large Handling Facility submitted to the MassDEP Northeast Region that included Exterior Plan, dated December 18, 2018, prepared by Green Seal lnvironmental, Inc., and submitted to MassDEP on behalf of TBI, and an opinion letter froin Attorney Kevin.P. Foley, counsel for TBI. The proposed operational modification would add two temporary structures to the facility. The proposed structures would not be used in processing any materials at the facility and will not expand the waste handling area. The proposed temporary structure located at the east end of the facility will be used to store clean and processed, unpainted wood awaiting shipment off-site for reuse. The proposed structure on the west end of the facility will be used to tcrnporarily store bailed post processed non-recyclable materials ready for traiispoft of'Esite and will afford protection from weather elements for residents (koppiiig oft'materials and items at the facility, The Board conditionally approves TBI's proposed modification to seek permits to add two (2) to the faci I ity, However, before any erection of these structures can occur, TBI must receive all approvals by all relevant and necessary Town of North Andover Boards and Departments and the Mass.DEP. In accordance with the provisions of the site assignment, it is understood that the Board has primary jurisdiction over all matters at the Facility related to the health, safety, and wellness of the residents of North Andover and dierefoi-c must approve of any modifications at the facility and on the site, 'Fhe Board preliminarily and conditionally approves TBI's proposed operational modification so thatT131 can seek those approvals by other Town of North Andover Boards and Departments. The department shall establish a State Action for Public Health 4 Excellence program to encourage boards of health and regional health districts to adopt practices 5 that will improve the efficiency and effectiveness of the delivery of local public health services, 6 in alignment with the recommendations of the Special Commission on Local and Regional 7 :Public Health, established in Chapter 3 of the Resolves of 2016. The program shall consist of the 8 activities described in this section. 9 (b). Subject to appropriation,the department shall provide the foundations of public 10 health course, or similar educational offering, no less than 4 times per year in diverse geographic 11 locations. The department shall provide such course free of charge to employees of boards of 12 health and regional health districts. i 2 of 5 13 (c). (1) Subject to appropriation,the department shall establish a State Action for Public 14 Health Excellence Incentive Fund. Funds shall be made available on a competitive basis and 15 shall support boards of health or regional health districts to engage in regional, inter-municipal 16 collaboration to increase efficiency and effectiveness in delivery of public health services 17 mandated by Massachusetts law. Funding shall supplement and not replace existing state, local, 18 private, or federal funding to boards of health. The department may offer grantees an option to 1.9 renew at the end of each grant year. 20 (2)To be eligible to receive funds an applicant must i) submit an application in manner 21 determined by department, ii) describe how it will increase the efficiency and effectiveness in the 22 delivery of public health services across two or more municipalities, iii) certify that it meets 23 workforce standards as determined by the department, consistent with the recommendations of 24 the Special Conunission on.Local and.Regional Public Health, iv) certify that it will submit. 25 written compliance data to the department at the end of the grant year, in a manner to be 26 prescribed by the department, including but not limited to food inspections, sanitary code reports, 27 and communicable disease reporting, and v) provide a plan for long-term sustainability of the 28 proposed shared services program. 29 (3)Hoards of health or regional health districts may apply for funding and technical 30 assistance to support i)planning and capacity building to organize regional collaboration in 31 alignment with recommendations of the Special Commission on Local and Regional.Public t 32 Health, or ii) implementation of regional. collaboration in..alignment with the recommendations 33 of the Special Commission on Local and Regional Public Health. The department shall adopt rules,regulations or guidelines for the administration and 35 enforcement of this section including,but not limited to, establishing applicant selection criteria, 1 i 36 funding priorities, application forms and procedures, grant distribution and other requirements, 37 provided,that not less than 33 per cent of the grants awarded shall go to cities and towns with a 38 median household income below the average of the commonwealth and with at least one 1 39 neighborhood designated as an environmental justice population as defined in Section 3 of 40 Chapter 2 1 A of the general laws. 41 (d). The Special Commission on Local and.Regional Public Health shall assess the 42 development of foundational public health services for:Massachusetts. For the purposes of this 43 subsection, foundational public health services shall mean a set of minimum standards for 44 municipal public health., including substantive areas of expertise and essential skills and 45 capacities needed to protect the community's health and achieve equitable health outcomes. In 46 doing so,the commission shall consider recommendations from the National Association of 47 County and City Health Officers,the Robert Wood Johnson Foundation,the Public Health. 48 Leadership Forum, and other relevant experts. No later than 2 years following passage of this 49 section, the commission shall submit a report to the house committee on ways and means,the 50 senate committee on ways and means, and the joint committee on public health.. The report shall 51 include an analysis of needs, opportunities, challenges, timeline, and cost analysis for the 52 implementation of foundational public health services. 53 (e). The department shall ai ually submit a report detailing the program's impact, 54 including but not limited to,the increase in the number of board of health eniployces that meet 55 workforce standards,the increase in boards of health that are compliant with data reporting 56 requirements, and the increase in the number of boards of health participating in regional 4 of 5 57 collaboration.
