2. Acceptance of Minutes
Ellen P. McIntyre made a motion to accept the September 11, 2018 and January 8, 2019 minutes.
Ronn R. Faigen seconded the motion.
3. New Public Hearing re: 75 Waverly Road
The petition of Elizabeth Carlson for property at 75 Waverly Road (Map 018.0, Parcels 0061),
North Andover, MA 01845 in the R-4 Zoning District. The applicant is requesting a Special Permit
pursuant to Town of North Andover Zoning Bylaws, Section 195-4.3 (N)(4)(a) for conversion of a two
family home to a three family home in the R-4 Zoning District.
Elizabeth Carlson and Richard Berry are at the table discussing the project plans. The applicant has
lived in town for over 40 years and would like to convert her two family home to a three family home
for her retirement.
The front of the home will look like a single family home. The third family will be an addition behind
the two car garage and not visible from the street. The addition will be 1600 square feet with one

bedroom. The breezeway will be heated but not livable space. Each unit will have two spaces for
parking. No variance are needed for this project. It will be built on a pin foundation which allows for
no excavation and it is faster to build.
E. McIntyre is asking about the roof lines and does not think the plan is aesthetically pleasing. Too
many additions have been added and it looks more like a four family than a three with the new addition.
E. Carlson responded the architect has done a good job of pulling the home together and making it look
like a one family from the street. The roof lines will match with the garage.
There is discussion of the front porch and how that will be replaced during the project. They are not in
front of the board for the porch but wanted to include it in the architect plans.
The addition will have a privacy fence.
The board is discussing the plans with the applicant.
JY Realty represented by Richard Byers 83 Waverly Road
JY Realty trust put in a written request through their attorney Richard Byers requesting that a screening
of evergreens be placed alongside the property between them and the applicant. They want it to be
conditioned as part of the decision.
ZBA Board is deliberating
Ellen P. McIntrye made a motion to grant the Special Permit. Ronn R. Faigen seconded the motion with
the condition of planting evergreens or similar on the south side of JR Realty (83 Waverly Road)
extending to the fenced area in order to convert a two family home to a three family home pursuant to the
Town of North Andover Zoning Bylaws Section 195-4.3 (N)(4)(a) in the R-4 Zoning District in The vote
was a unanimous vote of 5-0.

(4) Applicant's Subject Property Photo Addendum
4. Extension re: 234 Dale Street
David Cronin 234 Dale Street (Map 064.0, Parcels 0028), North Andover, MA 01845 in the R1
Zoning District. Request for 6-Month Extension of the variances granted by the Board in connection
with the proposed construction of a second story addition, expansion of an existing structure,
construction of a porch and deck at the Property.

Brian Vaughan is at the table representing the applicant David Cronin. He is requesting a 6 month
extension to a decision that is going to expire in February. All variances and a special permit was
granted from the necessary boards which took many months. Mr. Cronin then had a baby, moved
to temporary housing, self employed and got called for grand jury. He is still considering doing
the renovations but is not sure with the rise of construction costs.
E. McIntyre does not see an issue with granting an extension.
Ellen P. McIntyre made a motion to grant the 6-month extension. Ronn R. Faigen seconded the
motion. The vote was a 5-0 unanimous vote.
5. Mylar
The board discussed a change to amend the Rules and Regulations of the Board. They voted there will
be no Mylar required for both the variance and special permit application. The vote was unanimous.
6. Elections
The board discussed elections and voted to keep the board positions as it currently is.
