To approve the Purchase and Sale Agreement between the Trust for Public Land as Seller and
the Town of North Andover as Buyer for the purchase of 160 Acres in Fee (the "Fee Parcel") and
a Conservation Restriction (the "CR") over approximately 26 Acres of land known as Windrush
Farm and shown on Assessor's Map 105A, Parcels 9, 10, 12, 14 and 16 and as also described in
a deed recorded at North Essex District Registry of Deeds in Book 940, Page 382, and in
Registered Land Certificate of Title Number 5096, Book 34, Page 385, but excluding the
property transferred by Marjorie M. Kittredge, Trustee, to Windrush Farm Therapeutic
Equitation ("WFTE") Inc., by deed dated August 26, 2005 and recorded as Registered Land
Document Number 90198;
To accept the deed from TPL or Marjorie M. Kittredge, Individually and as Trustee

As you know, we received a Leak Detection Grant from the Massachusetts Department of
Environmental Protection(MADEP) in the amount of$46,600. There is a matching Town share of
$35,000. This has been budgeted.
The scope of work is as follows:

losses in North Andover's water supply and distribution system. The Town intends to complete system-wide

also install water conservation retrofits for high consumption fixtures in eight municipal buildings as part of
their Water Management Act ACO.

PROPOSAL
PROJECT DESCRIPTION
CONCISE STATEMENT OF THE PROBLEM
The Town of North Andover, with a population of approximately 27,500, provides potable drinking water to its customers
from a water treatment plant(WTP) located at Lake Cochichewick. Lake Cochichewick is the Town's sole drinking water
source. The Town of North Andover is located within the Ipswich and Merrimack Watersheds. Attached to this proposal
is a map showing the water system's withdrawal point at Lake Cochichewick. Unaccounted-for water is estimated to be
approximately 18% of the total water pumped into the distribution system. The residential per capita water consumption
reported for 2008 was approximately 62 gpcd,
The purpose of this project is to identify and reduce the amount of water losses in the water supply and distribution system
by conducting a comprehensive leak detection survey and water audit. The Town intends to complete system-wide large
meter testing and calibration under the water audit portion of this project to determine percent error in meter reading
accuracy, potential volume of water losses, and estimated annual dollar value losses. The results of the leak detection
survey and water audit will identify the water losses in the system and help aid the Town in reducing the unaccounted-for
water from 16%to their future goal of less than 10%. As recommended in the Town's Water Conservation Program and
in accordance with the Town's Administrative Consent Order (ACO), the Town intends to install water conservation
devices in municipal facilities in accordance with the grant's water conservation retrofit option. All in-kind match shares
noted in this proposal shall be provided through the Town's Water Enterprise Fund.
PROJECT GOAL(s)
The goals of this project are to:
• Locate and repair leaks in the distribution system
• Identify potential sources of unaccounted-for water and recommend conservation alternatives to reduce the amount of
unaccounted-for water
• Complete a system-wide large meter testing and calibrating plan
• Install water conservation devices in municipal facilities to reduce water consumption and improve efficiency
The reduction in the amount of water lost from the distribution system and reduction in consumption in municipal
facilities will result in less water being withdrawn from the Town's sole source of water, Lake Cochichewick, which is
located in the Ipswich and Merrimack Watersheds. The reduction in the amount of water lost and consumption will also
reduce the amount of water requiring treatment and pumping at the WTP, effectively saving energy and chemical costs.
By quantifying the volume of identified water losses and calculating the pumping and treatment costs, the annual dollar
value due to unidentified water losses will be determined.
PROJECT STRATEGY
The Town will work with the subcontractors to complete a thorough water audit to identify where and how much water is
used in the system in conjunction with a leak detection survey of the entire water distribution system. The system-wide
testing and calibration of large meters (ranging in size from three-inch to eight-inch) will provide more accurate data for
completion of the water audit as the large meters in the system have not been calibrated in several years, almost certainly
effecting the unaccounted-for water and reducing revenue. Installation of water conservation devices in municipal
facilities will reduce the amount of water lost while also bringing the Town into compliance with the ACO. The proposed
project will support the Town's on-going Water Conservation Program and efforts which include:
• Achieved goal that 100%of the distribution system is metered and recorded, including municipal buildings
• Annual water meter replacement program (approximately 400 meters replaced annually), including installation of
automatic meter readers—the current meter replacement contract was awarded in July and included the replacement
of approximately 500 residential meters ranging in(sizes 5/8"to 2"),replacement of 10 large meters(sizes 3"to 6")
and evaluation of, including data logging and rightsizing,9 large meters(sizes 3"-6")
• Biannual testing and calibration of master meters at WTP
• Installation of water conservation devices in local schools
• Educational material distributed to customers in the annual consumer confidence report (CCR), water bills, local
newspapers,and brochures distributed to water customers
• Website links to CCR, conservation tips and suggestions, water conservation devices, rain sensors, 2008 water
consumption facts,and water use and irrigation bylaws

PROPOSAL
• Provision of water conservation and xeriscaping books for local libraries
• Educational outreach several times per year for water conservation and water cycle education talks and tours of the
treatment plant for local schools, Girl/Boy Scouts, and scheduled events open to the public including talks at the
local senior center
• Established and enforces the Town's Draught Management Plan,Emergency Management Plan, Water Use&Lawn
Irrigation Bylaws and Water Restriction Bylaws,
• Increasing block water rate system to promote water conservation
• Rain sensors installed at all municipally owned parks and ball fields
• All new irrigation systems required to be registered with the Town and fit with rain sensors
Specific project strategies for completing each project task are identified in the Scope of Services section of this proposal.
MILESTONES
The progress of the project will be tracked by the five major tasks. These tasks and project deliverables, include:
I. Completion of a leak detection survey, leak repair plan, and technical memo.
2. Completion of a water audit of the system, completion of a large meter testing and calibrating plan, and
preparation of water audit and reporting forms, large meter testing and calibration documentation, and technical
memo.
3. Installation of water conservation devices in municipal facilities and preparation of technical memo.
4. Submission of quarterly reports and project completion documentation as required by the program regulations.
5. Submission of a draft and final project report.
The schedule for completing the above referenced tasks is included in this proposal
ACTIVITIES

Weston & Sampson and their subcontractor, Denise D. Conry(WBE), will complete the project with the assistance of the
Town and the selected leak detection survey subcontractor and large meter testing and calibration subcontractor. The
scope of services for this project is as follows:

PROJECT EVALUATION
The Final Project Report will include a summary of the entire project, including methods, results, conclusions, and
recommendations to further reduce water losses. The report will also identify project effectiveness by calculating the
environmental results of the project and quantifying the water savings in both gallons of water and dollar value per year for
all leaks identified and repaired as a result of the leak detection survey and other conservation efforts established as a result of
this grant.

PROPOSAL
SCOPE OF SERVICES
TASK/OBJECTIVE# 1 : Leak Detection Survey&Repairs
This task will include completion of a leak detection survey of the entire water distribution system in Town (approximately
145 miles of pipeline). The survey will be completed using multi-point computer-based digital leak correlation equipment in
accordance with the grant program requirements. The Town intends to contact a minimum of three subcontractors specializing
in leak detection to request price quotations to complete the leak detection survey and associated documentation for
completion of a technical memo and final project report. A qualified subcontractor will be awarded the leak detection survey
project by the Town, Potential leaks in the distribution system will be identified and an estimate of the daily water loss per
leak will be calculated. Based on the daily water loss, a prioritized leak repair schedule will be established. The Town is
committed to repairing all leaks identified in the survey. Upon completion of the leak repairs, each repair location will be re-
surveyed to confirm leak repair. A report will be prepared identifying the means and methods for conducting the survey. The
report will also include a summary of the results of the survey, the leak repair plan, and the quantity of water lost versus the
annual cost savings. The Town intends to complete all leak repairs and Town office support as an in-kind match while the
leak detection survey and associated reporting will be funded through the grant.

TASK/OBJECTIVE# 2 : Water Audit and Large Meter Testing and Calibration Plan
This task will include completion of a comprehensive water audit of the water supply and distribution system and system-wide
large meter testing and calibration plan. The Town intends to contact a minimum of three subcontractors specializing in large
meter testing and calibration to request price quotations to complete the large meter testing and calibration plan and associated
documentation for completion of Form 5 of the Water Audit. In addition, standard operating procedures for testing,
calibrating, and/or eventual replacement of each meter addressed will be tabulated and documented in the technical memo. A
table will also be provided in the technical memo listing the location of all meters addressed, size of the meter, and make and
model number of the meter. A qualified subcontractor will be awarded the large meter testing and calibration project by the
Town. The large meter testing and calibration plan and Town office support will be funded by the Town as an in-kind match
and shall be completed prior to completion of the water audit. The water audit and associated reporting shall be funded
through the grant and will be completed in conjunction with the leak detection survey. The water audit will be completed
based on information from the past three years worth of data, in accordance with MassDEP guidelines,and will include:
• Description of supply and distribution system
• Volumes of water withdrawn from source and volumes delivered to customers
• Summary of leak detection survey, including estimate of volume of water lost
• Summary of leak repair work, including estimate of leakage eliminated and potential cost savings
• Review of production and sales records to compare water pumped versus water sold
• Review of operation and maintenance records and quantify the costs for pumping and treating the water
• Review of billing and accounting procedures, including water meter reading, printing of billing statements, and
calculation of total water use for sources of error—sales records will be adjusted to reflect any billing or accounting errors
• Complete an in-depth analysis of all quarterly residential water billing accounts (approximately 7,550 accounts) to
identify discrepancies between metered water and pumping records
• Review of master meter calibration test results and newly completed large system meter calibration and test results
• Analyze the water usage in the system including a water balance model and evaluation
• Determine the potential sources of water loss in the system, estimate of volume of water lost, and calculate potential
reductions in water losses as a result of the project and associated cost savings
• Provide recommendations for improvements to the system including billing and accounting procedures, maintenance
programs,and water use,both on a short-and long-term basis; estimate costs to implement recommendations

TASK/OBJECTIVE# 3 : Water Conservation Retrofit
This task will include installation of water conservation devices in eight municipal buildings. In 2000 the Town completed a
Water Audit of the WTP and Municipal Buildings as part of a Water Management Act ACO. All municipal buildings in town
were reviewed including public schools,youth and senior centers, public works facility, fire stations, police station, and the town
office building. A water use inventory was provided for each location. Currently, the Town has completed installation of water
conservation retrofits for the public schools. Under this project, the Town intends to install low flow faucet aerators, flush meter
orifices,flushometer valves,low flow shower heads,new faucets,and 1.6 gallon per flush toilets(to replace existing 5 gal/flush or
greater toilets) as recommended in the 2000 Water Audit. Retrofits with the WaterSense seal of approval will be purchased for
this project. Installation of retrofits will be carried out in a cost effective manner by implementing the easiest measures which
provide the greatest reduction in volume. The Town will cross-reference the Water Audit's Inventory Needs List versus potential
building plumbing renovation improvements prior to purchase of retrofits. A maximum of 59 faucets and 38 toilets will be
retrofitted under this project. The Town intends to fund the purchase of new faucets and toilets and associated reporting through
the grant and will complete the installation of the retrofits and office support as an in-kind match. In addition, all retrofits will be
purchased and installed at the beginning of this project in order to compare post-installation metering readings with past water
meter history to calculate the reduction in water losses and estimate annual cost savings as a result of project activities.
DELIVERABLES: Technical memo and draft water conservation brochure for MassDEP approval; final brochure

TASK/OBJECTIVE# 4 : Reporting and Project Administration
This task will include the administration of the project, including coordinating all personnel and submitting quarterly and final
status reports as required under the guidelines of the water conservation grant.

Subcontractors for the Town associated with the requested grant amount will be:
Weston & Sampson — Coordination, evaluation, and management of tasks and deliverables (including printings, CDs, and
mailings); evaluation of leak detection and meter testing and calibration quotes including cost benefits, company reference
checks, and compliance with water conservation grant requirements for equipment used, methods of operation, and reporting
deliverables; submittal of quarterly reports and project completion documentation; preparation of water audit and technical
memos for the leak detection survey, water audit, and water conservation retrofit; preparation and submittal of draft and final
project reports.
Denise D. Conry, WBE(Engineering Subconsultant for Weston&Sampson)-Assist with information gathering, preparation
of water balance model, evaluation of water billing data, and preparation of draft technical memos for the leak detection
survey and water audit. The value for tasks completed by Denise D. Conry will be $9,650, approximately twenty percent of
the subcontractual services. If selected for this grant, a waiver from MassDEP will be requested to allow the use of a WBE
consultant to meet the requirements of both WBE and MBE goals.
Potential Leak Detection Subcontractors: Liston Utility Services, Water & Waste Pipe Testing, Inc., Heath Consultants,
Prowler Water Conservation Systems(WBE pending)and Sarian Company, Inc. (WBE).
Potential Water Meter Testing and Calibration Subcontractors: Regan Supply and Testing Service, Toomey Water Services
Inc.,and USI Services, Inc.
Contractual Forms
The Town of North Andover does not currently have any documented Equal Employment Opportunity/Affirmative Action

This memo is in regard to the application to the Licensing Commission for the annual
renewal of Common Victualer Licenses for food establishments in the Town of North
Andover.
The Board of Health is in the process of renewing all Food Establishment Licenses that
expire December 31" of each year. Any pertinent food establishment issues are addressed
immediately through routine inspections, and administrative hearings at the Health
Department. Therefore, any current or ongoing issues are being addressed.
The Board has no objection to the renewal list provided as long as the food establishments
continue to comply with 105 CMR 590.000 of the State Sanitary Corte, and the Federal
Food Code.
If you have any questions please do not hesitate to contact me at the Health Department.

Thank you for sending the annual licensing Commission renewals to the Commission On Disability Issues for
access/ADA review. We continued our review of the list, as you requested during our meeting. By a unanimous
vote, we agreed to express the following two concerns at this time:
-The Stevens Estate should be requested to install 2 above ground designated accessible parking signs
(including one van). The existing signs are not at the proper height, they're too low, with a distinct possibility of
becoming snowbound. The Commission emphasized that it is especially important that the signs be installed at
this time due the oncoming winter, coupled with the issue that Stevens Estate staff still continue to park illegally
in the only two accessible spaces. This is also required as per Massachusetts AAB (521 CMR) regulations,
Section 23.6.4. -Such signs shall be permanently located at a height of not less than five feet(5'0), nor
more than eight feet (8'0) to the top of the sign.
-The Commission also voted to request a status update concerning when we can expect the $200. fine
warning signs. This is required as per Mass AAB 521 CMR sec 25.6. If funds are not available for the signs,

OLD BUSINESS:
Determination to conduct liquor violation hearing; Millennium Eatery Inc. d/b/a Beijing Restaurant
There have been three incidents of alleged over serving of patrons at the Beijing Restaurant in violation of the
Commissioners Rules and Regulations. The Board was requested, based on the contents of police reports
whether to conduct a liquor violation hearing.
Mr. Victor Ng, a new manager that has been with the restaurant for only three weeks spoke for the owners of
the Beijing Restaurant.
Richard Nardella said that since Mr. Ng had only been with the restaurant for a short time, the Commissioners
would allow him more time to familiarize himself with the security plan, surveillance and ways to improve
securing a safe environment by not over serving patrons for their own safety and the safety of all Town
residents.
The Commissioners said if there are any more infractions during the holidays there would be severe
consequences and a possible loss of license. Selectman Nardella requested that Mr. Ng and the restaurant
owners return on January 25, 2010. The Board would then determine whether to conduct a liquor violation
hearing.

TOWN OF NORTH ANDOVER
MOVIE AND FILM PRODUCTION POLICY
1.0 Policy Statement:
Commercial film companies and photographers may be permitted to use property
under the control of the Town of North Andover for approved filming projects.
2.0 Purpose:
The film industry can provide both direct and indirect economic benefit to the
town. Pre-approval of projects ensures that town property and the rights, safety
and privacy of the citizens of North Andover are protected, while supporting this
industry.
This policy identifies the application and approval processes for projects
utilizing Town facilities and/or Town roads, and the requirements which must be
met, including payment of applicable fees.
3.0 Administration:
This policy is administered by The Town Manager's Office. The Town Manager
or his designee shall be the initial contact for all filming projects and is
responsible for expediting requests. All requests for filming shall require the
approval of the Board of Selectmen.
4.0 Insurance Coverage:
An insurance certificate of general comprehensive liability naming the Town of
North Andover as additionally insured, for the duration of the production, must be
provided to the Town Manager's Office for all filming. The Town of North
Andover will retain the original insurance certificate.
The amount of insurance coverage required is:
• $5 million,for filming projects using Town facilities such as
Town Hall, Town schools, Stevens Library, Stevens Estate, etc.
• $2 million, for filming projects using Town parks or Town roads.
5.0 FILMING ON TOWN/PRIVATE PROPERTY
5.1 FILMING AT TOWN FACILITIES (INCLUDING PARKS)
Application Process:
Initial inquires for filming in Town facilities should be submitted, in writing,to
the Town Manager's Office no later than fifteen business days prior to the date of
anticipated filming. Permission may be denied if the request cannot be
accommodated within the available time frame.
The filming company must provide the following information:
• Proposed commencement and termination dates and times of scheduled
filming, including preparation and final clean-up;
• The name and telephone number of a contact person and his/her backup
who will be on-site during the filming;
• General outline of the action, including all set dressing and props,
approximate number of production vehicles, cast and crew members as
well as any stunts or special effects;
• Specific locations and proposed alterations to Town property, including
identification of any necessary facility services support.
Approval Process:
Once a filming request has been received by the Town,the appropriate staff will
be informed and a site meeting with the film company may be required to review
the request and complete a walk through to determine any concerns or special
requirements. At this time the appropriate fees and deposits will be provided to
the filming company. As well at this time the availability of the requested Town
facilities or Town parks will be determined. The Film Company will be requested
to include the Town of North Andover in the list of credits.
Affected residents and businesses determined by Staff must be notified in
advance of any filming. To ensure minimal disruption,this notification letter must
include the duration and location of the filming and any planned interference with
pedestrian or vehicular traffic. In the event of business interruption,there should
be consultation with the business associate(s) and/or individual businesses to
determine if any compensation is required.
Once all requirements have been fulfilled a Location Agreement will be prepared.
5.2 FILMING ON TOWN ROADS
Application Process:
A filming application must be submitted at least fifteen business days prior to the
date of anticipated filming. Should a road closure be requested,the film company
must allow adequate time to obtain proper town approval. Once the request is
approved, staff will notify all Emergency Services of the anticipated filming.
Approval Process:
The Film Company must receive additional approval from the Board of
Selectmen in cases involving the following:
• To allow filming on roads in residential areas on more than one
occasion per calendar year;
• To allow filming to proceed before 7:00 a.m. or after 7:00 p.m.,
or any time on Sundays or statutory holidays;
• To allow overnight parking of production vehicles;
• To allow equipment, including lighting and generators,to be
oriented toward neighboring residences;
• To allow for a road closure
In all cases, a letter must be distributed by the filming company to all
residents and businesses that will be affected by the filming or by the parking of
filming-related vehicles during the production. The letter must contain telephone
numbers for the filming company.
Production vehicles will be issued permits for parking privileges at or near the
film location. The town reserves the right to limit the number of and size of the
vehicles to ensure public safety. This permit does not provide permission for
parking of vehicles in prohibited areas or in contravention of any regulation of the
Massachusetts General Laws or North Andover By-laws/Ordinances,unless
specifically approved.
The services of paid-duty police officers may be required for the purpose of
traffic control,traffic stoppages, and permit compliance. If such services are
required,the Film Company is responsible for retaining the officers, and for
payment of all associated costs.
Once all of the required conditions have been met,the Town of North Andover
will issue a filming permit along with vehicle parking permits to the Film
Company.
Proper signage should be posted along the roadway well in advance of any
intermittent stoppages or road closure,to the satisfaction of the Town of North
Andover.
Monitoring:
The Film Company must keep a copy of all permits that have been issued by the
Town Manager's Office and/or the Commonwealth of Massachusetts on site for
the duration of the filming.
Vehicle permits must be displayed in the front window of all production vehicles.
The film company must place signs in public access areas to inform residents that
the facility is being used for filming and delays may occur.
Upon completion of filming,the Film Company is responsible for clean up and
repair of any damages. The facility will be inspected for clean up and damages
within 48 hours of completion of scheduled weekday events, or within 72 hours of
completion of weekend events. The Film Company will be given first opportunity
to repair any damages, within a reasonable time frame specified by the Town. If
the work is not completed to the satisfaction of the Town,the Town will complete
the work and the cost of repairs will be invoiced to the Film Company.
Special Circumstances:
Noise: All filming must comply with any Town by-laws, unless an exemption in
writing is granted by the Board of Selectmen.
Explosives/Fires/Pyrotechnics:
Should the filming involve explosives,the film company must obtain a letter of
understanding acknowledging that explosives may be used in the production. This
letter must be obtained from the Fire Chief, and shall be attached to the permit for
facility use. A copy of the letter will be forwarded to the Chief of Police.
All explosives are to be detonated in accordance with the Explosives Act of 2002.
A member of the North Andover Fire Department and North Andover Police
Department shall be in attendance if there are any fires or explosions to be
undertaken. All open air burning requires a burning permit.
Neither explosives nor fires shall be allowed within any town owned building.
Security Deposit:
A security deposit in the form of a letter of credit or acceptable alternative,
approved by the Town Manager's Office is required and will not be
released until the facility has passed inspection, and all outstanding
costs (repairs to damages, staff costs, additional rental time)have been paid by
the film company. The following is a guideline for security deposits. These
amounts may be adjusted based on the nature of the production:
• Town of North Andover Facilities - $5000.00
• Town Parks- $2000.00
• Town Roads - $2000.00
5.3 FILMING ON PRIVATE PROPERTY
In the event that filming is taking place on private property,to ensure the public
safety and welfare,the Town of North Andover shall be notified of the filming
within five business days of the commencement of the filming. The film
company will be required to advise area residents of their intent to film and
duration of the production. The Town Manager will advise the Members of
the Board of Selectmen of the filming.
The Town Manager's Office will advise the Film Company that they
must notify North Andover Fire Department and North Andover Police
Department if any special effects are going to be used. If required they must
obtain the necessary permits.
The Film Company will also be advised that all municipal by-laws must be
adhered to.
Facility and Permit Fees:
Fees for the use of town property for film production purposes shall be negotiated
between the town and the film company, and will be included in the location
agreement. Consideration will be given to what property is being used,the
duration of the use,and any potential inconvenience to town operations or the
public.

National Grid has requested the removal of 91 Town owned shade trees and trimming of 5 more on
Foster Street,Salem Street,Johnson Street,and Marbleridge Road. The actual locations,of the trees
are listed on the attached permit request. Our Tree Foreman,John Lavin,and an independent aibofist
have reviewed the trees in the equest and concur with the decision: Therefore,on Tuesday,December
15,2009 at 4:00 PM a Public Meeting was held here at the DPW. The Public Meeting Notice was
attached to each`tree,advertised in the local news paper,-and on the Town's Web Site.,.Only one
resident attended the meeting,Blake Adams. The sign in sheet is attached. Mr Adams' only concern --
was how he could receive some ofthe wood when the trees were cu down National grid keeps a list
of people who contact them for this wood and he is on the list.,
I have had no comments on the program from any other residents. 1t would benefit the Town if many,
of the trees are removed,therefore,I recommend approval of the permit request. If you concur I will
sign the attached permit request and National Grid will schedule-removal of the tree.s in January,
February,and March of 2010.
