The Order does not grant any property rights or any exclusive privileges;it does not authorize any injury to private property or invasion of private rights. 3. Phis Order does not relieve the permittee or any other person of the necessity of complying with all other applicable federal,state,or local statutes,ordinances,bylaws,or regulations. 4. The work authot'ized hereunder shall be completed within three years from Elie date of this Order unless either of the fof lowing apply: a.the work is a maintenance dredging project as provided for in the Act;or b.the time for completion has been extended to a specified date more than three years,but less than five years,front the date of issuance.If this Order is intended to be valid for more than three years,the extension date and the special circumstances warranting the extended tirtte period are set forth as a special condition in this Order. 5. This Order may be extended by the issuing authority for one or more periods of up to three years each upon application to the issuing authority at least 30 days prior to the expiration date of the Ordcr. G. If this Order cunstitutes an Amended Order of Conditions,this Amended Order of Conditions does not exceed the issuance date of the original I=inal Order of Conditions. 7. Any Pill used in connection with this project shall be cleat fill.Any fill shall contain no trash,refuse,rubbish, or debris,including but not limited to lumber,bricks,plaster,wire,lath,paper,cardboard,pipe,tires,ashes, refrigerators,motor vehicles,or palls of any of the foregoing. S. This Order is not finial until all administrative appeal periods from this Order have elapsed,or if such an appeal has been taken,until all proceedings before the Department have been completed. 9. No work shall be undertaken until the Order has become final and then has been recorded in the Registry of Deeds or[lie Land Court for the district in which the land is located,within the chain of title of the affected property.In the case of recorded land,the Final Order shall also be noted in lire Registry's Grantor Index under the name of the owner of the land upon which the proposed work is to be done.In the case of the registered land,the Final Order shall also be noted on the Land Court Certificate of Title of the owner of the land upon which the proposed work is done.The recording information shall be submitted to the Conservation Commission on the form at the end of this Order,which forte roust be stamped by the Registry of Deeds,prior to the commencement of work.. A sign shall he displayed at the site not less then two square feet or more than three square feet in size bearing the words, "Massachusetts DeparitnentofEavironrnental Protection" [or'IulassDEP"] File Number:"242-1692" 11. Where the Department of Environmental Protection is requested to issue a Superseding Order,the Conservation Commission shall be a party to all agency proceedings and liearings before Mass DEP. 12. Upon completion of the work described herein,the applicant shall submit a Request for Certificate of Compliance(WPA Form 8A)to the Conservation Commission. 13. The work shall conform to the plans and special conditions referenced in this order. 14. Any change to the plans identified in Condition#13 above shall require the applicant to inquire of the Conservation Commission in writing whether the change is significant enough to require the filing,of a new Notice of Intent. 15. The Agent or rnentbcrs of the Conservation Commission and the Department of Environmental Protection shall have the right to enter and inspect the area subject to this Order atreasonable hours to evaluate compliance with the conditions stated in this Order,and may require the submittal of any data deemed necessary by the Conservation Commission or Dcpartnnent for that evaluation. 16. This Order of Conditions shall apply to any successor in biterest or successor in control of the properly subject to this Order and to any contractor or other person performing work conditioned by this Order. 1.7. Prior to the start of work,and if theproject involves work adjacent to a Bordering Vegetated Wetland,the boundary of the wetland in the vicinity of(lie proposed work area shall be marked by wooden stakes or f]agairtp. Once in place,the wetland boundary markers shall be maintained until a Certificate of Compliance has been issued by the Conservation Commission. 19. All sedimentation barriers shall be waintaincd in good repair until all disturbed areas have been fully stabilized with vegetation or other means.At no time shall sediments be dcposiled in a wetland or water body.During construction,the applicant or his/her designee shall inspect the erosion controls on a daily basis and shall remove accumulated sediments as needed.The applicant shall immediately control any erosion problems that occur at the site and shall also immediately notify the Conservation Commission,which reserves the right to require additional erosion andfor damage prevention controls it may deem necessary.Sedimentation barriers shall serve as the limit of work unless another limit of work line has been approved by this Order. NOTICE OF STORMWATER CONTROL AND 1VLkWI'ENANCE REQU112Eti1BNrS 19. the following conditions; a) All work,including site preparation,land disturbance,construction and redevelopment,shall be implemented in accordaacc with the construction period pollution prevention and erosion and sedimentation control plan and,if applicable,the Stormwater Pollution Prevention Plan required by the National Pollutant Discharge Elimination Systcrn Construction General Permit as required by Stormwater Standard 8.Construction period erosion,sedimentation and pollution control measures and best management practices(BMPs)shall remain in place snail the site is fully stabilized. b) No stormwater runoff may be discharged to the post-construction stormwaterBIAPs unless and until a Registered Professional Engineer provides a Certification that: i_all construction period BMPs another party has legally assumed responsibility for B v P maintenance.Prior to requesting a Certificate of Compliance,or Partial Certificate of Compliance,the responsible party(defined in General Condition 19(e))shall execute and submit to the issuing authority an Operation and it$aintenance Compliance Statement("O&M Statement") for the Stormwater BlvlPs identifying the party responsible for implementing the stormwater BLIP Operation and Maintenance Plan("O&M Plan")and certifying the following:i.)the ORM Plan is complete and will be implemented upon rQceipt of the Certificate of Compliance,and ii.)Elie future responsible parties shall be notified in writing of their ongoing legal responsibility to operate and maintain the stormwater management ZP NM?s and implement the Storntwaterl"ollntion Prevention Plan. d) Post-construction pollution prevention artd source control shall be implemented in accordance with the long- term pollution prevention plan section of the approved StormwaterRepurt and,if applicable, the Stormwater Pollution Prevention Plan regttired by the Nationat Pn(lwtant Discharge Eliminartiot System Multi-Sector Gencral Permit. e) Unless and until another party accepts responsibility,the landowner,or owner of any drainage easement, assumes responsibility for maintaining each BNfUl.To overcome this presumption,the landowner of the property must submit to the issuing authority a legally binding agreement of record,acceptable to the issuing authority,evidencing that another entity has accepted responsibility for maintaining the BIV111,and that file proposed responsible party sliall be treated as a permittee fur purposes of implementing the requirements of Conditions 19(f)through .19(k)with respect to that BVfP.Any failure of the proposed responsible party to implement the requirements of Conditions 19(f)through 19(k)with respect to that f3MP shall be a violation of the Order of Conditions or Certificate of Compliance.In the case of stormwater FAMPs that are serving more than one lot,the legally binding agreement shall also identify the lots that will he serviced by the stormwater B1P .A plan and easement deed that to the responsible party access to perform the requited operation and maintenance must be submitted along with the legally binding agreement, f) The responsible party shall operate and maintain all stormwater Bi IPs in accordance with the design plans, the O&M Plan,and the requirements of the Massachusetts Sto7nwater Handbook. g) The r'esponsiliie party shall: 1.Maintain an operation and maintenance log for the last three(3)consecutive calendar years of inspections,repairs,maintenance and/or replacement of the stormwater management system or any part thereof,and disposal(for disposal the log shall indicate the type of material and the disposal location); 2.Maim the maintenance loa available to MassDEP and the Conservation Commission("Commission") upon request;and 3.Allow members and agents of the MassDEP and the Commission to enter and inspect the site to evaluate and ensure that the responsible party is in compliance with the requirements for each B1vfP established in the O&M Playa approved by the issuing authority. Arty future project which proposes a wetland crossing in order to access certain portions of the property will not be qualified as a limited project roadway under 310 CMR 10.53(e). 32. The following wetland resource area is affected by the proposed work: Buffer Zone to Bordering Vegetated Wetland (BVVV). This resource area is significant to the interests of the Act and Town ByLaw as noted above and therein. The applicant has not attempted to overcome the presumption of significance of these resource areas to the identified interests. 33,The NACC agrees with the applicant's delineation of the wetland resource areas on the site as shown on the plarLs dated and referenced herein per the Order of Resource Area Delineation issued Linder DEP Pile #242-1686 on August 11,2016. 34. This Order of Conditions is issued in addition to that issued tinder DPP File #242- 1037. A Certificate of Connpliance was issued on August 9,2006. 35. The NACC finds that the interisive use of the upland areas and buffer zone proposed an this site will cause further alteration of the wetland resource areas. In order to prevent any alteration of wetland resource areas a twenty five foot (25') No- Dst«rbance Zone and a fifty foot(0') No-Construction Zone shall be established from the edge of the adjacent wetland resource area as shown on the plans referenced herein. The Conservation Adrninistrator and/or other agents of the NACC do not have the authority to waive these setbacl<s as established under the local bylaw. No disturbance of existing grade, soils or vegetation is permitted in the No-Disturbance zone, (See Section 3.4 &Appendix F of the local Reg lotions). 36. The applicant's Buffer Zone Restoration Proposal as shown on Sheet 6 of 31 is acceptable to the NACC. The area will be planted in accordance with the Proposed Buffer Zone Restoration Plantings table and Planting Notes shown on Sheet 6 of 31. Plantings will be monitored fall and spring for two years with a monitoring report, including photographs,submitted to the NACC by November 1 and June 1 of each year. Plants that die or are not thriving during the rnorutoring period shall be replaced. The owners of the project m-Ld their successors in title agree that the Order does not in itself impose upon the Town any responsibility to maintain the proposed drainage system and that said Town shall not be liable for any damage in the event of failure. By acceptance of this Order,the owners agree to indenu-tify and hold 1larudess to the Town and its residents for any damage attributable to alterations undertaken on this property pursuant to the Order. Issuance of these Conditions does not in any way imply or certify that the site or downstrearn areas will not be subject to flooding, storm damage or any other form of water damage. PRIOR TO CONSTRUCTION 39. No work shall be undertaken until all administrative appeal periods from this Order have elapsed or, if such an appeal has been filed, until all proceedings before the Department or Court have been completed. :10. This Order shall be recorded by the applicant at the Registry of Deeds irrunediately after the expiration of all appeal periods. No work shall be to-idertaken until the Final Order has been recorded in the Registry of Deeds or the Land Court for the district in v%rl-ich the land is located, within the chain of title of. the affected property. In the case of recorded land, the Final Order shall also be noted in the Registry's GiiiLor Index under the name of the owner of the land upon which the proposed work is to be done. In the case of registered land, the Final Order shall also be noted on the Land Curt Certificate of Title of the owner of the land upon which the proposed work is to be done. The recording information shall be submitted to the North Andover Conservation Commission on the forin at the end of this Order prior to commencement of the work. Any Order not recorded by the applicant before work cornm.ences may.be recorded by the NACC at the applicant's expense. 41. A sign shall be displayed at the site not less than two square feet or more than three square feet in size bearing the words "Massachusetts DEP, File Number 242-1692." 42. Any changes in the submitted plans caused by the applicant, Another Board's decision or resulting from this Order of Conditions must be submitted to the NACC for approval prior to implementation. If the NACC finds said changes to be 51grlifICcult, the NACC wil l call for another public hewing (at the expense of the applicant). Within 21. days of the close of said public hearing the NACC will issue an amended or new Order of Conditions. No work shall begin on a project mitil written approval has been ,anted by the NACC. 43, It is the responsibility of the applicant, owner, and/or successor(s) to ensure that all conditions of this Order of Conditions are complied with. The project engineer and contractors ate to be provided with a copy of this Order of Conditions and referenced documents before commencement of construction. 44. Prior to any work commencing on-site, the applicant shall meet with the site contractor, a sub-committee of the NACC, the NACC's stormwater peer consultant (at the applicant's expense) and the project-engineer/wetland scientist to discuss the construction sequence/phasing. In addition to updating;the Draft Stormwater Pollution.Prevention Plan and Construction Sequencing Plan,the applicant shall address when the permanent residential and commercial underground stormwater management system BMPs go on-line relative to the installation of pavement and building founda Lions, catch basins and related piping. Subsequently, the applicant shah submit to the NACC for approval, a detailed and dated sequence of construction, including the installation of sedimentation/erosion control devices,construction of temporary sedimentation basins and swales,retaining wall construction, drainage installation, building construction, mitigation plantings and all other work planned tl—ough final stabilization.Any changes to the approved sequencing plan shall be approved by the NACC or its designated agent. 45. At least 30 days prior to the start of land disturbing activities, the Applicants shall provide to the NACC or its designated Agent for review and comment a copy of its Stormwater Pollution Prevention Platt(SWPPP) prepared in consultation with the Applicants' site contractor(s) and project engineers. The SWP.PP shall be prepared in accordance with the U.S Environmental Protection Agency's Stormwater Construction General Permit(USEPA, 2012) and related guidance document entitled "Developing Your Stormwater Pollution Prevention rian: A Guide for Construction Operators". The SWPPP shall build upon the Draft Stormwater Pollution Prevention Plan and Construction Sequencing Plan referenced herein and the approved sequence of construction referenced in Condition#44 above. 46.Wetland flagging shall be checked prior to start of construction and shall be re- established where missing. All wetland flagging shall remain visible and enumerated per the approved plaxt(s) throughout the life of the project and until a Certificate of Compliance is issued so that erosion control measures can be properly placed and wetland impacts can be monitored. The proposed limit of work shall be shall be clearly marked with erosion controls or temporary fencing;and shall be confirmed by the NACC. Such barriers shall be checked and replaced as necessary and shall be maintained until all construction is complete. Workers should be informed that no use of machinery, storage of machinery or materials, stockpiling of soil, or construction activity is to occur beyond this line at any time. 242-1692, 1210Osgood Street-Special Conditions 6 NTACC 1/t2l2017 Bk 15491 Pg262 #12047 lli:P FILE #242—1.692 47. Prior to construction and as part of the SWPPP referenced in Condition#45 above,the Applicant(s) shall submit a final revised set of site plans,for approval by the Conservation Department, depicting sedimentation &erosion control barriers along the approved limit of work line that incorporates trenched wire backed siltation fence and staked haybales or trenched wire backed siltation fence and 18-inch diameter staked compost filter socks (biodegradable,no plastic netting with the exception of Filtrexx Soxx). Straw wattles are prohibited as a primary perimeter erosion control device. Moreover, the referenced site plans shall be updated to depict these erosion control barriers in a continuous line along the entire limit of work begirming at the property line at the south/southeast corner of the site near wetland series #1 (wetland flags 1.-1 through 1-12) to the property line at the northeast corner of the site. 48.Prior to the start of construction, approved erosion controls skull be installed between all construction areas and wetlands. The erosion control barriers will be survey staked and properly installed and placed as shown on the plans approved and referenced herein and shall be inspected and approved by the NACC or its agent prior to the start of construction and shall remain intact until all disturbed areas have been permanently stabilized to prevent erosion. All erosion prevention and sedimentation protection measures foLuzd necessary during construction shall be implemented at the direction of the NACC or its agent. The NACC reserves the right to impose additional conditions on portions of this project to irdtigate any impacts which could result fiom site erosion, or any noticeable degradation of surface eater quality discharging from the site. For example, installation of erosion control measures may be required in areas not shown on the plan(s) referenced in this Order of Conditions. Should such installation be required by the NACC, they shall be installed within 48 hours of the Commission.s request. 49. The applicant shall have on hared at the start of any soli disturbance, removal or stockpiling, a nunirnum of 50 hay bales and sufficient stakes for staking these bales, 150 feet of silt fence, and an adequate supply of emergency erosion controls including crushed stone, silt sacks, flock blocks,jute matting and any other erosion controls that may be required as part of the Stornzwater Management Report and Storinwater Pollution Prevention Plan(SWPPP), and the herein referenced plans. Said supplies shall be used only for the control of emergency erosion problems and shall not be used for the normal control of erosion. 50. A check payable to the Town of North Andover shall be provided in the amount of $30,000 which shall be in all respects satisfactory to Town Counsel,Town Treasurer, and the NACC, and shall be posted with the North Andover Town Treasurer through the NACC before commencement of work. Said deposit of money shall be conditioned on the completion of all conditions hereof, shall be signed by a party or parties satisfactory to the NACC, and Town Counsel, and shall be released after completion of the project, provided that provisions, satisfactory to the NACC,have been made for performance of any conditions which are of continuing nature. The applicant may propose a monetary release schedule keyed to completion of specific 242-1692, 1210 Osgood Strect-Special Conditions 7 NACC l/12/2017 Bk 15491 Pg263 #12047 DE FILE#242—1692 portions of the project for the NACC's review and approval. This condition is issued under the authority of the local ByLaw. 51. The applicant shall designate a Wetland Scientist (or other environmental professional as approved by the NACC or its agent) as an"Erosion Control Monitor" to oversee any emergency placement of controls and regular inspection or replacement of sedimentation control devices. The name and phone number of the erosion control monitor must be provided to the NACC in the event that this person has to be contacted, due to an emergency at the site, during any 24-hour period, including weekends. Proof of the retained monitor must be submitted to the Conservation Department on letterhead by the retained consulting firm. This person shall be given the authority to stop construction for erosion control purposes. The Environmental Professional will in-unediately notify the Conservation agent of any matter that requires attention by the Coirunission or the agent. The erosion control monitor will be required to inspect all such devices and oversee cleaning and the proper disposal of waste products. Cleaning shall include removal of any entrapped silt. 52. At least once during each week in which construction activities occur on-site and for as long thereafter as gLound remains unstabilized, the applicant shall submit a written report with photos from the"Erosion Control Monitor" to the NACC certifying that, to the best of his/her knowledge and belief based on a careful site inspection, all work is being performed in compliance with this Order of Conditions and that approved setbacks are being adhered to. The erosion control monitor must visually inspect all sedimentation/erosion control measures and assume responsibility for their maintenance on a weekly basis and that they are functioning as intended. In addition, all wetland resource areas must be visually inspected for siltation,turbidity,and/or other water quality impacts. The Erosion Control Monitor shall be on site during and/or following a major storm event of 1/2" inch of rain or greater(24 hour event) to ensure that soils remain stable, and erosion controls are adequate and secure. 53. Prior to construction, the applicant shall permanently mark the edge of the "25' No- Disturbance Zone" on all delineated wetlands with signs or markers spaced evenly every 35 feet incorporating the following text: "Protected Wetland Resource Area" and the associated rules (1 square for every 3 round markers). This will designate their sensitivity and assure no further inadvertent encroachment into the wetland. These permanent markers are subject to review and approval by the NACC. The applicant shall instruct all agents to explain these markers to buyers/lessees/landscapers acid all persons taking over the property from the applicant. These markers shall remain posted and be replaced as necessary in perpetuity. Markers may be obtained at the Conservation Department($2 round/$3 square). 54. The applicant and/or the legal owner of that portion of land upon which these Orders of Conditions have been placed shall provide to the NACC prior to transferring, or assigning any portion of said land to another party, subject to said Orders of 242-1692, 1210 Osgood Street-Special Condi(ions 8 NACC 1/12/2017 Bk 15491 Pg264 #12047 DEP FILE 9 242-1692 Conditions, the"Compliance Certification Form Affidavit" attached via"Appendix A" signed under the pains and penalties of perjury, stating that said applicant and/or owner has read these Orders of Conditions and is in compliance with each and every condition. This document shall apply to each of the conditions referenced herein and shall be provided to the Conservation Department at least five (5) business days prior to the closing of said land transaction. 55, Once these above mentioned pre-construction requirements are complete, the applicant shall contact the Conservation Office prior to site preparation or construction and shall arrange an on-site conference with an NACC representative, the contractor, the erosion control monitor, project engineer and the applicant to ensure that all of the Conditions of this Order are-understood. This Order shall be included in all construction contracts, subcontracts, and specifications dealing with the work proposed and shall supersede any conflicting contract requirennnnts. The applicant shall assure that all contractors,subcontractors and other personnel performing the permitted work are fully aware of the permit's terms and conditions. Thereafter, the contractor will be held jointly liable for any violation of this Order of Conditions resulting from failure to con-ply with its conditions. The applicant or contractor shall notify the NACC in writing of the identity of the on-site construction supervisor lured to coordinate construction and to ensure compli�zce with this Order. A reasonable period of time shalt be provided as notice Of the pre-construction meeting (e.g. 72 hour's). JISTORMWATER MANAGEMENT CONDITIONS SCn. All construction and post-construction stormwater management shall be conducted in accordance with supporting documents submitted with the Notice of Intent and as part of the public hearing process, the Department of Environ1-rental Protection Stormwater Management Policy and as approved by the NACC in this Order of Conditions. 57. There shall be:no increase in the post develolDment discharges from the storin drainage System or any other changes in post developmetnt conditions that alter the post development watershed boundaries as cu rrentty depicted in the Notice of Intent and approved by this Order of Conditions, unless specifically approved in writing by the Commission. 58, Erosion control measures shall be implemented and maintained in accordance with the Stormwater Report and Long Term Stormwater Operations cued Maintenance Plan (0&1V1) referenced herein or as required in this Order. 59. Water duality in down gradient BVW's shall not differ significantly following completion of the project from the pre-development condition. There shall be no 2424692, 1210 Osgood Street-Special Conditions 9 NACC 1/12/2017 Bk 15491 Pg265 #12047 DFP TILL 9 242—1692 sedimentation into wetlands or water bodies from discharge pipes or surface runoff leaving the site. 60. All new catch basins shall contain oil/grease traps, and it shall be a continuing condition of this order, even after a Certificate of Compliance is issued, that the oil/grease traps in the catch basins be maintained. All catch basins shall be free of all accumulated silt and debris before a Certificate of Compliance is issued and the owner or his/her agent shall so specify in the request for Compliance. 61. Prior to the issuance of the Certificate of Compliance, the applicant shall be responsible for cleaning all stormwater structures, in accordance with the approved O&M attached herein and the associated stormwater management conditions mandated herein. 62. The maintenance of the stormwater management system Bayfilter runts shall be conducted by a Baysaver Technologies certified maintenance contractor(e.g., Stormwater Compliance, LLC or equivalent) for the life of the system. In addition, the Applicants' shall provide the NACC with a copy of a 5-year maintenance contract / agreement entered into with the certified maintenance contractor of the Bayfilter system. The maintenance contract and the qualifications / credentials of the certified maintenance contractor shall be provided to the NACC for its files prior to putting the stormwater management system on-line. This special condition, including ongoing renewals of the maintenance contract by qualifier personnel,shall survive the issuance of a Certificate of Compliance(COC) for the project. Upon request, the Applicant shall provide the Commission with copies of subsequent renewals of the maintenance contract following the initial 5-year period referenced herein. 63. The Bayfilter inspections shall be conducted in accordance with the fugal approved Operations and Maintenance Plan referenced herein. More specifically, the Bayfilter inspections shall be conducted twice per year and at least once per year they shall be inspected within 48 houl's of a rain event of one inch or more. The vaults shall be cleaned a minimum of once per year using a vacuum truck and the cartridges shall be replaced once every three years or whenever the system,up-gradient of the filter is not drainirig down completely within 24 to 48 hours following a storm event, whichever is sooner. The drain-down time shall be an adequate indicator as to when the cartridge is "spent" with regard to oil & grease removal as well as the sediments. This special condition shall survive the issuance of a COC for the project. 64. No later than December 15 of any given year, the Applicants shall provide the NACC or its designated Agent with a written report and photo-documentation confirming that the stormwater management system is being maintained as per the approved O&M referenced herein. If required by the NACC, the Applicants and the Applicants' stormwater management contractor shall appear before the NACC at a public sleeting to present the results of its inspection and maintenance program and to answer any questions the NACC i-nay have regarding the overall function of the stormwater 242-1692, 1210 Osgood Street-special conditinns 10 NACC 1/12/2017 Bk 15491 Pg266 #12047 DEP FILE#242---1692 management systetnl. This special condition shall survive the issuance of a COC for the project. 65. The applicants, owners, and their successors and assignees, shall maintain,in perpetuity all swzles, bioretention areas, outlet structures,subsu_face storage areas, and other elements of the drainage system, in order to avoid blockages and siltation wluch might cause failure of the system and/or detrimental impacts to on-site or off- site resource areas,and shall maintain the integrity of vegetative cover on the site. DURING CONSTRUCTION 66. Upon beginning work,the applicant shall submit written weekly progress reports detailitn;what work has been clone in or near resource areas, and what work is anticipated to be done over the next period. This will update the construction sequence. Reports shall be submitted in as part of the weekly ernvirom-Mental monitoring report(see condition #52). 67. The Applicant(s) shall provide the Commission or its designated Agent an as-built plan signed and stamped by a Licensed Professional Land Surveyor and Civil Engineer of the Commonwealth depicting the locations of the retaining walls and outlet structures located in close proximity to the 50 foot No-Build Zone including the seginent of Wall R2 located behind Building D; the segment of Wall R1 located behind Building l; the segzneznt of Wall R2 located adjacent to the parking lot between Buildings D and E; and the segment- of wall R5 located behind the proposed swimming pool and clubhouse; outlets to DUIH 14 and DMH 24A. The as-built phm(s) shall indicate the distance of the wall(s)/outlets from the nearest wetland flag(s). The as-built plan(s) shall be provided to the Commission or its designated Agent for review after the first 2 or 3 coa-uses of the referenced wall segment(s) are installed and prior to initiating Phase 2 work,as described in the Draft Construction Sequencing Plan provided with the N01 and as may be revised iin the SWPPP. In addition immediately upon completion of building foundations within the buffer zone, and prior to further construction activilies associated with the site,the applicant shall connplete a plan (per above) which accurately depicts the.foundation location and its proximity to wetland resource areas as approved under this Order of Conditions. During the placement of engineered fill, the project engineer shall inspect and submit reports confirming that the engineered slopes and fill are built in accordance with the plans approved and referenced herein. Copies of compaction reports and other related inforinatiorn shall be provided to the NACC. As documented during stormwater }peer review, construction of the drainage system will require a great deal of precision. Any disparities or circumstances requiring adjustments of the design before or during construction should be brought to the attention of the NACC or its designees for review and approval prior to actual construction of the revised design. 70. Dewatering activities are not proposed as part of the filing. No discharge of water is allowed directly into an area subject to jurisdiction of the Wetlands Protection Act and/or the North Andover Wetland Bylaw. If emergency de-watering requirements arise, the applicant shall submit a contingency plan to the Cormnission for approval, wlvch provides for the pumped water to be contained in a settling basin, to reduce turbidity prior to discharge into a resource area. 71. Stone shall be replaced as necessary to prevent sediment tracking onto paved areas. 72. Associated pavement and roadways shall be swept at least weekly or as directed by the Erosion Control monitor, the Site Supervisor,Project Manager, or Conservation staff for as long as the site remains exposed and uri-stabilized. If material is tracked beyond the construction entrance onto the adjacent roadway,it will be swept up daily. 73. Any fill used in connection with this project shall be clean fill, containing no trash, refuse, rubbish or debris, including but not limited to lumber, bricks, plaster,wire, Iath,paper,cardboard, pipe, tires, ashes,refrigerators,motor vehicles or parts on any of the foregoing. 74. All exposed soil finish grade surfaces shall be irnznediately landscaped (native plantings/seed mixes) and stabilized, or loarnec1, seeded and mulched,with a layer of mulch hay or matting (natUral fibers only). All disturbed areas must be graded, loamed and seeded prior to November. 1st of each year. Outside of the growing season, exposed soil finish grade surfaces shall be stabilized with a layer of mulch hay or matting until climate conditions allow for seeding, During construction, any area of exposed soils that will be left idle for:more than 30 days shall be stabilized with a layer of mulch hay or other means approved by the NACC. 75. There shall be no stockpiling of soil or other materials within fifty (50) feet of any resource area. Washings.front concrete trucks, or surplus concrete, shall not be directed to any drainage system or wetland resource area. If truck washing is to be done on site an area shall be designated and approved by the Conservation Department. 78. Once online, all catch basins and any other storanwater inlets on the site or within 100 feet of the project shall be protected by silt sacks to prevent sediment from entering the drainage system except as approved in the construction sequence/SWPPP. Silt sacks shall be maintained and regularly clew-tied of sediments until all areas associated with the work permitted by this order have been permanently stabilized and the NACC or its agent has formally approved their removal. 79. All waste generated by, or associated with,the construction activity shall be contained within the Iimit of work, and away from any wetland resource area. There shall be no burying of spent construction materials or disposal of waste on the site by any other means. The applicant shall maintain dtunnpsters (or other suitable means) at the site for the storage and. removal of such spent construction materials off-site. However, no trash dwripsters will be allowed within 50' of areas subject to protection under the Act or local ByLaw. 80. Accepted engineering anti construction standards and procedures shall be followed in the completion of the project. 81. During and after work on this project, there shall be no discharge or spillage of fuel, or other pollutcnnts into arty wetland resource area. If there is a spill or discharge of any pollutant during any phase of construction the NACC shall be notified by the applicant within one (1) business day. No construction vehicles are to be stored within 100 feet of wetland resource areas, and no vehicle refueling, equipment lubrication, or maintenance is to be done within 100 feet of a resource area. UAFER CONSTRUCTION 82. No underground storage of fuel oils shall be allowed on any lot within one-hundred (100) feet of any wetland resource area. A non-backwashing, cartridge style filter will be installed for the pool. Draining of pool water is not permitted directly into an area subject to jurisdiction of the Wetlands Protection Act and/or the North Andover Wetland Bylaw (including catch basins). STORMWATER SYSTEMS The permanent Princeton at North Andover Apartment Homes and Forgetta Retail/Commercial Center private stormwater systems are proven, reliable and affective stormwater treatment, storage and infiltration practices. The site is strategically graded to mimic the pre-development natural drainage patterns and therefore maintains several individual and separate drainage systems. In general,all the clean roof runoff will be collected,stored and infiltrated through underground chamber systems, each with emergency overflows directing excess stormwater in the same locations as naturally occurred prior to development. The associated site access and parking areas are largely conventional bituminous pavement with various curbing types, all promoting gutter line surface flow into deep sum catch basins with outlet hoods. The project's main stormwater practices are underground storage systems, using the "Stormtech" proprietary chamber system and ADS N-12 watertight closed pipe systems. However, due to product knowledge,training and specialty maintenance equipment required,it is strongly recommended by the design engineer of record,the property manager secure and maintain a long term third party contract with an industry specific trained &licensed professional capable of operating, inspecting and maintaining the system. In general, good housekeeping, common sense responsible site operations and timely maintenance include the Following activities: Site. Maintenance: The site and all its components shall be kept in a neat,orderly and clean fashion. Routine upkeep shall be performed by either Owner's representatives, Property Management Staff and/or their assigned, depending on the project's status. Typical site maintenance activities shall include, but not be limited to responsible construction practices,parking lot sweeping using a vacuum sweeper, landscape management including intensive spring and fall season cleaning and building maintenance. Trash Disposal: All common household waste materials will be collected and stored in a securely lidded metal dumpsters housed within lockable enclosure(s), maintained on site by a third party refuse collection agent. All incidental(small)site trash and debris will be deposited in the dumpster by the property manage or their assigned ogent(s). The dumpster will he emptied on a regular schedule,prior to being overfilled. Ail residents and property management personnel will be instructed on proper onsite waste disposal practices. In addition to onsite signage all residents will receive specific onsite disposal services, including recycling if applicable within their lease agreement documentation. Spill Control&Containment: Good housekeeping and spill control practices will be followed to minimize storm water contamination from petroleum products, paints, and cleaning products. All resident vehicles will be routinely monitored for leaks with written notices distributed as required by property management staff. Stormwater Management System Maintenance Deep Sump Hooded Catch Basins(33 Total) The actual removal of sediments and associated pollutants and trash occurs only when inlets or sumps are cleaned out; therefore, regular maintenance is required. The more frequent the cleaning, the less likely sediments will be resuspended and subsequently discharged. In addition,frequent cleaning also results in more volume available for future storms and enhances the overall performance, At a minimum, water quality inlets and deep sumps should be inspected monthly for general function and four times per year for sediment levels. Each of the thirty-three (33) catch basins on site are equipped with a four(4)foot deep sump (the area in the catch basin below the elevation of the pipe leaving the basin).The pipe is not visible as it is equipped with a gas/oil hoods but the constant water level in the catch basin generally indicates this elevation.A tape measure can be used to measure the depth from the rim grate to the water level,then the depth of the water can be measured and compared to the four feet.The distance short of four feet equals the sediment level. Catch basins must be pumped when the sediment level exceeds one (1) foot through the use of a vacuum extractor or once every year. Disposal of the accumulated sediment and hydrocarbons must be in accordance with applicable local, state, and federal guidelines and regulations. Bay Filter Treatment Units(4 total) When BayFilters are initially installed,we recommend that an inspection be performed on the system in the first six(6) months. After that, the inspection cycle shall be semi-annual (twice a year). Easy access assures unobstructed and effortless on-the-spat inspection of any BayFilter system. The vaults shall be cleaned a minimum of once per year using a vacuum truck.The cartridges should be replaced once every three years or whenever the system up gradient of the filter is not draining down completely within 24 to 48 hours following a storm event,whichever is sooner.The drain-down time shall be tracked at least once per year following a storm of one inch or more.The drain down time can be used as an indicator as to when the cartridge is "spent"with regard to oil& grease retnovaf as well as the sediments. The maintenance cycle of the BayFilter system is driven mainly by the actual solids load on the filter. inspection must be performed twice a year to be certain it is operating correctly. When BayFilter exhibits flows below design levels, the system should be inspected and maintained as soon as practical, The threshold for cartridge replacement should be when that volume is not draining down within 24-45 hours.An estimated replacement frequency of once every three years. Procedure: 1. Remove the manhole covers and open all access hatches. 2. Before entering the system make sure the air is safe per OSHA Standards or use a breathing apparatus.Use low 02,high CO,or other applicable warning devices per regulatory requirements. 3. Using a vacuum truck, remove any liquid and sediments that can be removed prior to entry. 4. Using a small lift or the boom of the vacuum truck, remove the used cartridges by lifting them out. 5. Any cartridges that cannot be readily lifted can be easily slid along the floor to a location they can be lifted via a boom lift. 6, When all the cartridges have been removed, it is now practical to remove the balance of the solids and water. Loosen the stainless clamps on the Fernco couplings for the manifold and remove the drainpipes as well. Carefully cap the manifold and the Fernco's and rinse the floor, washing away the balance of any remaining collected solids. 7. Clean the manifold pipes,inspect, and reinstall. S. Install the exchange cartridges and close all covers. 9. The used cartridges must be sent back to BaySaver Technologies for exchange/recycling and credit on undamaged units. AIDS Solid Pipe Watertight Closed Underground Detention Systems(S total) i Maintenance is required for the proper operation of underground detention areas despite the measures implemented "up stream" of these facilities.Subsurface storage/infiltration systems should be inspected at least once a year following a storm of one inch or more to ensure that they are fully drained within 72 hours. If they are not,corrective action must be taken. ➢ Underground detention systems shall be inspected at least once per year to ensure that the systems are operating as intended. Inspections should be at all inlet manhole inspection ports, at the outlet manholes and system interior inspection ports. y Sediment should be removed from the pipes at the inlet ports,system interior inspection ports and outlet manholes as necessary,and at least once every 5 years. During inspections, changes to the detention system or the contributing watershed should be noted, as these may affect basin performance. STORMTECH ISOLATOR ROW(6 TOTAL) Routine inspection schedule needs to be established for each individual location based upon site specific variables.The type of land use (Le. industrial,commercial, residential),anticipated pollutant load, percent imperviousness, climate,etc.all play a critical role in determining the actual frequency of inspection and maintenance practices.At a minimum the StormTech system shall be inspected twice a year. Initially,the Isolator Row should be inspected every 3 months for the first year of operation.For sub sequent years, the inspection should be adjusted based upon previous observation of sediment deposition.The Isolator Row incorporates a combination of standard manhole(s)and strategically located inspection ports(as needed).The inspection ports allow for easy access to the system from the surface, eliminating the need to perform a confined space entry for inspection purposes. If upon visual inspection it is found that sediment has accumulated,a stadia rod should be inserted to determine the depth of sediment.When the average depth of sediment exceeds 3 inches throughout the length of the Isolator Row,clean-out should be performed. The Isolator Row was designed to reduce the cost of periodic maintenance. By"isolating"sediments to just one row,costs are dramatically reduced by eliminating the need to clean out each row of the entire storage bed. If inspection indicates the potential need for maintenance, access is provided via a manhole(s) located on the end(s) of the row for cleanout. If entry into the manhole is required,please follow local and OSHA rules for a confined space entries. Maintenance is accomplished with the JetVac process.The JetVac process utilizes a high pressure water nozzle to propel itself down the Isolator Row while scouring and suspending sediments.As the nozzle is retrieved,the captured pollutants are flushed back into the manhole for vacuuming. Most sewer and pipe maintenance companies have vacuum/JetVac combination vehicles.Selection of an appropriate JetVac nozzle will improve maintenance efficiency. Fixed nozzles designed for culverts or large diameter pipe cleaning are preferable.Rear facing jets with an effective spread of at least 45"are best. Follow OSHA regulations for confined space entry if entering manhole Riprap Aprons(3 total) The areas of stone at pipe outlets are critical to reducing stonnwater velocity and preventing scouring and erosion in the sensitive wetland buffers where they are located. Snow storage areas are designed specifically to trap and store sand, sediment and debris found in snow melt that if allowed to flow into the wetland could be detrimental to wetland vegetation. Use of sodium based de-icing chemicals is prohibited within 100 feet of wetlands on site. Signage in these areas shall be clearly posted, Sanding and the de-icing chemicals such as magnesium chloride or potassium chloride should be used sparingly in these areas. Before the start of winter, snow storage areas shall be prepared and maintained so that the sites maximize their effectiveness. The following maintenance measures shall be undertaken within the designated snow storage areas: • The natural vegetative buffer strip shall be maintained during the growth season between the disposal site and adjacent wetland. • Debris shall be cleared from the site prior to using the site for snow disposal. • Debris shall be cleared from the site and properly disposed of at the end of the snow season and no later than May 15. The amount of snow disposal capacity has been estimated to insure an adequate number of upland areas have been selected and prepared. As snow storage areas are exhausted, snow shall be removed from the site and disposed of properly in accordance with applicable local, state and federal guidelines.
