MEMORANDUM

RE: Affordable Unit Resale
DATE: June 23, 2011
CHAPA(Citizens' Housing and Planning Association), has notified the Town that the following affordable
unit is up for sale. CHAPA manages the resale of affordable units for Oakridge Village.

The Board of Selectmen has to determine if they want to exercise their right of first refusal. Our office
would recommend that the Board of Selectmen should not exercise their right of first refusal for the
affordable housing unit. If the Town chooses to exercise its right,then it would be the responsibility of
the Town to purchase the property or locate an individual to purchase the property.
CHAPA,which is the monitoring agent for the Town and several other communities, has better
resources to preserve the unit as affordable and has recently hired new staff to manage the marketing
of the units. The timeframe is 120 days to find an applicant that meets the affordable criteria.
Because the Town has been handling several affordable unit resale's during the past twelve months,our
office has been working more closely with the Housing Partnership Committee and North Andover
Housing Trust to ensure that the units stay affordable.
The deadline to act is July 10. If the Board does not act the right of first refusal is deemed authorized. It
is recommended that the Board of Selectmen not exercise their right of first refusal.

RE: WHEELABRATOR SETTLEMENT
Dear Members:
I spoke with Assistant Attorney General Betsy Harper after my letter to you
yesterday. She said that there would be no confirmatory letter between Wheelabrator and the
Attorney General's Office as I described in my June 21 letter to you. However, she said that
the documented history of the lengthy negotiations between Wheelabrator and the Attorney
General's Office is indicative that the parties intended that the Release does not cover all
contract disputes that have arisen or may arise between the municipality and Wheelabrator—
only those connected to environmental compliance as contained in the Consent Judgment.
She also said that if Wheelabrator at any time should take the position that the
Release extends beyond the Covered Matters in the Consent Judgment, then the Town should
contact her office because her office would take the position that Wheelabrator would then be
in violation of the Consent Judgment which was entered as an Order of the Court.

Hi Curt: over the winter we did an investigation and focused in on the Riverwalk Complex in
Lawrence - due to the low ridership at the Complex and by stopping on Merrimack Street, rather
than turning in, we will be able to free up the running time needed to proceed into the North
Andover Mall after leaving Peters Street - this should provide an opportunity to get to the North
Andover Mall - this trip can be done now but it does require riding Route 33 into Lawrence and
transferring - a more direct route would eliminate this transfer trip - the change would become
effective on Tuesday July Sth
Just to let you know that Senator Baddour will be at the Senior Center on Wednesday 6/28 at
10:00 a.m. to make this announcement - here is a draft description of the change - Thanks

Description of Route 33 Changes 6/22/2011
Present Route 33 North Andover Description
Route 33 North Andover presently leaves the Buckley Center in Lawrence, serves the McGovern
Transportation Center and Riverwalk Complex in Lawrence,then proceeds via Sutton Street to Main Street,
past the Senior Center and Town Hall,to Route 125,then to the Peters Street area,turns around and returns to
Main Street and then to Lawrence.
What Change is being made to Route 33 effective Tuesday July 5

Route 33 will be changed to serve the North Andover Mall on Route 114. The route would no longer turn into
the Riverwalk Complex but stop on Merrimack Street(both for the inbound and outbound trips)which will
allow for the extra time needed to add the North Andover Mall.After leaving the Peters Street Area the bus will
proceed along Route 114 to the North Andover Mall and then return to Main Street and Lawrence along the
same route. Service will continue on Route 33, Monday to Friday from 5:30 a.m. to 7:00 p.m. and Saturday
from 7:00 a.m.to 6:00 p.m.
