It is located in an R-4 zoning district. The building does not conform to the current zoning by-laws for the following reasons: (1) it is used as a four unit residential building; (2) lot area is 9,130 square feet (plus or minus) 12,500 square feet required; (3) frontage is 68.18 feet -100 feet required; (4) front setback is 10.7 feet-- 30 feet required; and, (5) right side setback (right side from the perspective of facing the house) 1.6 to 12 feet (plus or minus) — requirement is 15 feet. For (1) above, see Chapter 195, Attachment 2, Table 1: Summary of Use Regulations; and for (2) to (5) above, see Chapter 195, Attachment 3, Table 2: Dimensional Requirements. The house was severely damaged in the Columbia Gas fires. It is a total loss. This is a petition for a special permit under Article 9, Section 195 — 9.4 to rebuild the house. The plans submitted will show that the new structure will sit on the footprint of the existing foundation with one exception made necessary by the building code. That exception is shown on the plans as a 3 foot 6 inch "jog" on the left side of the building (left side from perspective of facing house from street). That jog is necessary as the house has a staircase that goes from the first to second floor and cuts through the width of the house. The stairs, in terms of both their rise (too high) and depth (too narrow) do not meet code. Bringing them up to code requires the house, at the point where the stairs are located, to be 3 feet, 6 inches wider— otherwise the stairs will not fit in the house. The jog is within the 15 feet setback on the left side of the house.
