HISTORY AND BACKGROUND On March 28, 2019,the applicants,Eric&Jennifer Jones,requested a Waiver of the Watershed Protection District Special Permit, in accordance with the North Andover Zoning Bylaw section 195-4.23, so as to allow the conversion of an existing 3 season screened in porch into habitable living space within the Non- Discharge Buffer Zone of the Watershed Protection Zone. FINDINGS OF FACT The Planning Board has made its decision based on the following findings: • A plan was submitted entitled,Plan of Land, dated November 7, 1984 which details the structure's location. • The proposed deck is located within 100' from a wetland resource area,thus located within the Non-Discharge area of the Watershed Protection Zone. • The wetland distance was confirmed by the Town of North Andover Conservation Administrator. • The project consists of the removal of existing screens, doors,wall and floor frame,removal of columns, installation of new post and footing. The existing deck frame,roof frame, finish and skylights will remain. • The structure will be supported by three(3)Diamond Pier DP-75 foundation supports which will be driven into the soil. • The Applicant has submitted a Small Project Application to the Conservation Commission. DECISION After discussion at the April 2,2019 Planning Board meeting,and upon a motion by J.Simons and seconded by P. Boynton,the Planning Board Approves the Watershed Special Permit—Waiver with conditions. A vote of 5-0 was made in Favor of the waiver request. CONDITIONS • The applicant is required to apply for a Watershed Special Permit for any additional construction of outbuilding or building additions. 41 Bear Hill Road Map 64,Parcel 78 Watershed Protection District Special Permit-Waiver Page 2 of 2 • The proper erosion controls must be in place before the start of the project. • The Planning Office will perform an inspection after the deck has been constructed.
