HISTORY AND BACKGROUND
On March 7, 2019, the Applicant, Greg Penney, requested a Waiver of the Watershed Protection District
Special Permit, in accordance with the North Andover Zoning Bylaw section 195-4.23, so as to allow the
construction of a 40X12 Ft. gravel driveway within the Non-Discharge Buffer Zone of the Watershed
Protection Zone.
FINDINGS OF FACT
The Planning Board has made its decision based on the following findings:
• A plan was submitted entitled, Site Plan of Land, dated May 2,2017 modified to show location of
the proposed gravel driveway.
• The proposed deck is located within 100' from a wetland resource area,thus located within the
Non-Discharge area of the Watershed Protection Zone.
• The Town Engineer has reviewed the proposed plan.
• The project consists of the construction of a 40'X12' Ft. gravel driveway. No trees will be
removed as part of this project.
DECISION
After discussion at the April 2,2019 Planning Board meeting,and upon a motion by J.Simons and seconded
by P. Boynton,the Planning Board approved the Watershed Special Permit—Waiver with conditions. A
vote of 5-0 was made in Favor of the waiver request.

CONDITIONS
• A small Swale must be constructed off the edge of the road from the gravel driveway directing
any possible runoff to the existing catch basin right in front of his house approximately 10-15 feet
from the proposed edge of the gravel driveway.
• The applicant is required to apply for a Watershed Special Permit for any additional construction
of outbuilding or building additions.
• The proper erosion controls must be in place before the start of the project.
• The Planning Office will perform an inspection after the deck has been constructed.
