6 E. Goldberg, Chairman: The Planning Board rneeting for Tuesday April 2, 2019 was called to order at 7 p.m.

8 CONTINUED PUBLIC HEARINGS
9 495 Main Street, Town of North Andover: Application for a Special Permit— Site Plan Review under sections 195-8.10
10 through 8.17 and 195-10.7 of the Town of North Andover Zoning 13ylaw. The Applicant proposes to construct a recreational
11 complex including athletic fields, tennis courts, picnic areas and associated parking areas, walkways and
12 emergency/maintenance access paths. The Property is located in the Residential 4(R4) Zoning District.
13 J. Enright: Site Plan Review opened January 22, 2019; in addition to hearings, there were two site visits. Revised plans were
14 submitted dated 3/19/19. Summarized plan changes. Waterfield Design Group has submitted comments in response to
15 comments made at the last meeting. Traffic study performed for the Kindergarten took into consideration the future
16 development of the field complex. A summary document and full study was included in the packet. Town Counsel submitted
17 a memo regarding Title 9 considerations and the recreational field complex Special Permit review. Several public comment
18 emails were received and included in the packet along with comments from the NA Fields Committee, NASA and NA
19 Booster Club. Delivery detail associated with a Town notification made on 5/1/17 regarding a public meeting held for the
20 recreation complex has been included in the packet as well. Lastly, draft decisions have been prepared for your review.
21 E. Goldberg: There will be no public comment this evening; all submissions received have become part of the record.
22 Suzanne Egan, Town Counsel: Discussed memorandum provided to the Board regarding Title 9.
23 Board: Discussed Title 9, lighting, turf infill, establishment of rules committee, and hours. Board reviewed and discussed the
24 draft Decisions.
25 MOTION: J. Simons made a motion to close the public hearing for Site Plan Review Special Permit for 495 Main Street-
26 Recreational Complex, Town of North Andover. A. Preston seconded. The vote was 5-0, unanimous in favor. MOTION: J.
27 Simons made a motion to approve the Site Plan Review Special Permit for 495 Main Street -Recreational Complex, Town of
28 North Andover, as amended, based on the discussion tonight authorizing the Planner to memorialize the discussion of the
29 Board and to be submitted to the Chair for review to ensure that it captures the will of the Board as discussed this evening P.
30 Boynton seconded.. The vote was 4-1 in favor, (L. Crane opposed).

32 495 Main Street, Town of North Andover: Application for Special Permits, Access Other Than Legal Frontage and
33 Common Driveway under sections 195-7.2.B and Section 195-2.2 of the North Andover Zoning By-law. The Applicant
34 proposes to develop a new recreation complex with access through existing driveways at the Early Childhood & Kindergarten
35 Schools and North Andover Middle School. The Property is located in the Residential 4(R4) Zoning District.
36 MOTION: J. Simons made a motion to close the public hearing for 495 Main Street, Special Permits, Access Other than
37 Legal Frontage and Common Driveway. A. Preston seconded. The vote was 5-0, unanimous in favor.
38 MOTION: P. Boynton made a motion to approve the 495 Main Street Special Permits, Access Other than Legal Frontage
39 and Common Driveway. A. Preston seconded the motion. The vote was 4-1 in favor, (L. Crane opposed).

41 100 Willow Street, Gourmet Specialty Foods: Application for a Special Permit - Site Plan Review Special Patna under
42 sections 195-8.8.D (8) & 195-8.11.A (3) of the North Andover Zoning Bylaw. The Applicant proposes to modifications to
43 the required screening/landscaping of off-street parking & for an existing facility requiring five or more additional parking
44 spaces. The property is located in the Industrial 1 (I-1) zoning district.
45 M. Gregoire: A revised Swept Path Analysis was approved. Conservation confirmed the wetlands delineation. All concerns
46 have been met; all work is to occur outside the 100 ft. buffer. Waiver request is to allow their engineer to sign the drawings.
47 Board: Reviewed and discussed draft decision.

54 Annual Town Meeting Zoning Bylaw/Map Amendment Articles:
55 Article X: To amend the Town's Zoning Map -Parcel 106.D-0045-0000.0 (1874 Turnpike Street) to be included within the
56 Business 2 zoning district. (Board recommended Favorable Action @ the 3/19/2019 Planning Board meeting)
57 Article X: To amend the Zoning Bylaw, Article 5 Earth Material Retnoval, to provide for exemptions from requirements for
58 certain activities. (Board recommended Favorable Action (i.p, the 3/19/2019 Planning Board meeting)
59 Article X: To amend the Zoning Bylaw, Article 16 Corridor Development District (CDD), permitted uses to allow for drive-
60 through facilities for banks with the CDD1 and CDD2 zoning districts by special permit and to arnend the dimensional
61 requirements within the CDD2 zoning district. (Board recommended Favorable Action (if; the 3/19/2019 Planning Board
62 meeting)
63 Article X: To amend the Zoning Bylaw, Article 6 Signs and Sign Lighting Regulations, requirements and permitting process
64 for certain signs and to delete sections of Article 6 that are inappropriately categorized as sign regulations.
65 MOTION: P. Boynton made a motion to recommend Favorable Action on Article X. J. Simons seconded. The vote was 5-
66 0, unanimous in favor.

70 Annual Town Meeting Zoning Bylaw Amendment Article:
71 Article X: Amend Zoning Bylaw' Chapter 195, Article 17: Osgood Smart Growth Overlay District (OSGOD) to see if the
72 Town will vote to repeal Chapter 195, Article 17 and any other reference to the Osgood Smart Growth Overlay District
73 contained in the Zoning Bylaw,
74 MOTION: J. Simons made a motion to recommend Favorable Action on Article X -Amend Zoning Bylaw -Chapter 195,
75 Article 17: Osgood Smart Growth Overlay District (OSGOD) to see if the Town will vote to repeal Chapter 195, Article 17
76 and any other reference to the Osgood Smart Growth Overlay District contained in the Zoning Bylaw. P. Boynton seconded.

81 31 Johnson Circle, Denise Favorat: Request to modify Watershed Special Permit Decision approved on September 6, 2018.
82 M. Gregoire: Applicant is requests waiver for the required as -built and letter confirming project compliance signed by an
83 architect or certified engineer. Submitting letter signed by a professional engineer stating the project is in compliance.
84 D,Favorat: Received signed off from Town Engineer regarding infiltration and financial hardship related to As-abuilt,
85, Board: Discussed waiver request for as -built plan.
86 MOTION: J. Simons made a motion to approve the request to modify the Decision for Watershed Special Permit fbr 31
87 Johnson Circle. P. Boynton seconded. The vote was 5-0, unanimous in favor.

89 102 South Bradford Street, Greg Penney: Watershed Special Permit waiver request to allow for the construction a 40'X12'
90 gravel driveway within the non -discharge zone.
91 M. Gregoire: Applicant requests waiver for secondary gravel driveway (has paved driveway). Town engineer reviewed plan
92 for runoff and requested the applicant clear the leaves and debris out of the town right of way, to allow the water to run to the
93 catch basin in front of the home. Work is outside of the 100 ft, buffer zone, no trees will be cut. Police had no concerns.
94 G. Penney: Explained project. No trees will be cut.

Gourmet Specialty Foods. P. Boynton seconded. The vote was 5-0, unanimous in favor.
MOTION: P. Boynton made a motion to approve the Site Plan Review Special Permit for 100 Willow Street, Permit,
Gourmet Specialty Foods, as amended to include the special conditions outlined this evening. A. Preston seconded.. The vote
was 5-0, unanimous in favor.

99 41 Bear Hill Road, Eric & Jennifer Jones: Waiver Request for a Watershed Special Permit under Sections 195-4.24 and,
100 10.7 of the North Andover Zoning Bylaw. The Applicant proposes to convert an existing 3 season screen in porch into
101 habitable living space within the Non -Disturbance Zone. The project is located within the Residential 1 (R-1) Zoning
102 District.
103 M. Gregoire: Waiver request to convert a pre-existing screened in porch to livable space; no change to topography. A
104 DiarnondPier load bearing foundation system will be used. Conservation will review this as a small project. The footprint will
1 05 not change and the roof will remain.
106 E. Jones: Explained project. Roof will remain the same.

111 Annual Town Meeting Warrant Article X: Petitioner John Smolak, Street Acceptance Wellington Way.
112 J. Enright: DPW requires final review regarding revised street layout plan and as -built plan; Conservation is addressing this at
113 their next meeting and will potentially issue a compliance. Town Counsel needs to weigh in. DPW has submitted
114 correspondence recommending the Board maintain bond funds until such a time that the street is accepted. Three outstanding
115 issues were detailed.
116 Stephanie Kiefer, Smolak & Vaughan: Messina Development has offered to set up a separate bond to confirm site
117 stabilization. Developer is making all efforts to ensure everything falls into place.
118 Board: Prefers to wait until the work is completed.

129 Essex County Greenbelt, Cyr Boardwalk part of the Bay Circuit Trail and the fire steamer restoration original to NA.
