HomeMy WebLinkAbout2019-04-23 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES April 23, 2019 CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:00PM in the Town Hall Meeting Room. The open session meeting was recorded. ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing Chairman, Chris Nobile, Richard Vaillancourt, Rosemary Smedile, Acting Town Manager Lyne Savage, Deputy Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff. PLEDGE OF ALLEGIANCE PUBLIC COMMENT David Rand of Dale Street spoke regarding the Stevens Estate and suggested a committee be formed to study the Stevens Estate. APPROVAL OF MINUTES Richard Vaillancourt made a MOTION, seconded by Phil DeCologero, to approve the Open Session Minutes of April 8, 2019. Motion approved 5-0. PUBLIC HEARING Layout of Wellington Way Richard Vaillancourt made a MOTION seconded by Rosemary Smedile to open the public hearing to receive comments on the proposed layout of Wellington Way. Stephanie Keifer from Smolak and Vaughan spoke on behalf of the applicant. Director of Planning, Jean Enright, indicated there are outstanding issues with stabilization. Dan McCue of 45 Wellington Way stated that grass has still not been established and there is a big mound of dirt in his back yard. He has been unable to grow grass for a year. Mr. McCue had the soil tested and said it was not good and doesn’t think he will ever be able to grow grass on his property. Rosemary Smedile made a MOTION seconded by Phil DeCologero to continue the public hearing to receive comments on the proposed layout of Wellington Way until the Board’s meeting before Town Meeting on May 14, 2019. Motion approved 5-0. LICENSING COMMISSIONERS Richard Vaillancourt made a MOTION, seconded by Phil DeCologero to open a meeting of the North Andover Licensing Commission. Motion approved 5-0. Request of Chris Buco for a one day wine and malt liquor license for a Craft Beer Festival on May 19, 2019 at 505 Sutton Street Tim Greene of 10 Lorraine Avenue explained the reason for the fundraiser. Chris Buco stated that they would have a live band. Mr. Vaillancourt informed Mr. Buco that he would need to apply for a one day entertainment license. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Chris Buco for a one day wine and malt license for a Craft Beer Festival on May 19, 2019 at 505 Sutton Street, subject to each brewer/server providing valid TIPS certification and food trucks being inspected prior to start of event. Motion approved 5-0. Request of St. Gregory’s Church for a one day all alcohol license on June 13, 2019 from 6:00PM- 11:30PM at 158 Main Street The police recommendation requires a police detail however, one has not been required for this event in the past. The applicant submitted a request to waive the requirement for a detail. Rosemary Smedile made a MOTION, seconded by Regina Kean that the Board of Selectmen, acting as Licensing Commissioners, approve the request of St. Gregory’s Church for a one day all alcohol license on June 13, 2019 from 6:00PM-11:30PM at 158 Main Street and to waive the application fee and waive the requirement for a police detail. Motion approved 5-0. Board of Selectmen Minutes April 23, 2019 2 Rosemary Smedile made a MOTION, seconded by Regina Kean to close a meeting of the North Andover Licensing Commission. Motion approved 5-0. CONSENT ITEMS Vote to approve transfer of $250,000 from the Special Education Stabilization Fund to the School Department’s operating budget Included in the packet was a request from the School Department to transfer $250,000 from the SPED stabilization fund to the School Department budget to cover unanticipated expenses. Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen approve the request of the School Department to transfer $250,000 from the SPED stabilization fund to the School Department Budget. Motion approved 5-0. Phil DeCologero recused himself and left the room. Vote to approve gift cards distributed to veterans for use at North Andover Farmers Market The Board is being asked to accept the donation from the Farmers Market to Veterans Services. Chris Allen and Hillary Stasonis explained the program and that the North Andover Merchants Association has provided the funding to the Farmers Market. Chris Nobile made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen accept the donation of gift cards to Veterans Services to be used at the Farmers Market. Motion approved 5-0. Mr. DeCologero returned to his seat. NEW BUSINESS (taken out of order) Presentation regarding 1600 Osgood John Smolak, attorney for Hillwood Development Corp., explained his client’s plan for 1600 Osgood Street. Hillwood has entered into an agreement to purchase the property with the exception of the main building. Hillwood’s client is an e-commerce company looking to put a distribution center there. They are under a nondisclosure agreement so cannot reveal the name of the company. Gary Frederick of Hillwood explained that they would be looking for the Board to hold a Special Town Meeting to change some zoning items. Chairwoman Kean asked Ms. Savage to talk to the state about the sewer line and also to look into hiring a consultant. GOVERNMENTAL REPORTS (taken out of order) Update from Community Support Coordinator Deanna Cruz, will give an update on her first eight months on the job. Update on Master Plan implementation IT Director, Chris McClure, gave an update regarding the Master Plan implementation web document he created to track progress. Update on The Stevens Estate Acting Town Manager, Lyne Savage, gave an update on the Stevens Estate. CONSENT ITEMS (continued) Request of the Patriotic Observance Committee for permission to close Massachusetts Avenue and Salem Street from the Town Common to Ridgewood Cemetery for the Memorial Day parade and ceremony on Monday, May 27, 2019 starting at 9:45AM Included in the packets was a request from the Patriotic Observance Committee to hold the annual Memorial Day Parade on Monday, May 27, 2019 starting at 9:45AM. All relevant departments reviewed the request and had no issues. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve the request of the Patriotic Observance Committee to hold the annual Memorial Day Parade on Monday, May 27, 2019 starting at 9:45AM. Motion approved 5-0. Board of Selectmen Minutes April 23, 2019 3 Vote maximum useful life of departmental equipment to be financed The 2018 Annual Town Meeting approved the Capital Improvement Plan for Fiscal Year 2019. By statute, the Board is required to establish the maximum useful life of equipment bonded for a period of more than five years. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen vote that the maximum useful life of the departmental equipment listed below to be financed with the proceeds of the $542,307 borrowing authorized by the vote of the Town passed May 15, 2018 (Article 10) is hereby determined pursuant to G.L. c.44, §7(1) to be as follows: Purpose Borrowing Amount Maximum Useful Life Police Radio Equipment $247,307 5 Years 6 Wheel Dump Truck $185,000 10 Years Backhoe $110,000 10 Years Motion approved 5-0. Warrant Article 8 amendment Chairman Kean asked the Board to vote to amend Warrant Article 8 on the floor of Town Meeting to include language making the sale subject to the historical preservation restriction and an access easement for the trails. Phil DeCologero made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen make a motion to amend Warrant Article 8 on the floor of Town Meeting, as presented. Motion approved 5-0. Vote to increase the membership size of the Council on Aging Selectman Nobile requested the board increase the membership of the Council on Aging to allow more people to volunteer on the council. Richard Vaillancourt made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen increase the membership size of the Council on Aging from 11 members to 13 members. Motion approved 5-0. Appointment of Quentara Costa, Tracy Shea and David VanArsdale and Lawrence Smith to Council on Aging The appointment subcommittee is recommending these appointments to the Council on Aging. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen appoint to the Council on Aging Quentara Costa for a term ending June 30, 2020, Tracy Shea for a term ending June 30, 2021, David VanArsdale for term ending June 30, 2020 and Lawrence Smith for a term ending June 30, 2019. Motion approved 5-0. OLD BUSINESS None TOWN MANAGER’S REPORT None SELECTMAN’S UPDATES/COMMENTS None ADJOURNMENT Phil DeCologero made a MOTION, seconded by Chris Nobile to adjourn the meeting at 9:15p.m. Motion approved 5-0.
