HomeMy WebLinkAbout1963-03-11Monday - March 11, 1963 Regular Meeting & Hearings The Board of Appeals held their regular meeting on Monday evening, March 11, 1963at 7:30 P.M. in the Town B,~lding. The following members were present and voting: Daniel T. 0'~eary, Chairman; Henry E. Lund, Howard Gilman, W~l~4am Morton and A.M. Arthur Drummond who sat in place of Robert J. Burke. HEARING: Gene A. & Edith R. Minicucci. Mr. 0'Leary read the legal notice in the appeal of Gene & Edith M~,~cucci requesting a variation of See. 6.4, Para. 6.41 of the Zoning By.Law so as to permit the sale of a parcel of land 14,400 sc~,~re feet in area and to ratify a 1~61 subdivision; on th~ premises, located at Park Street, the corner of Main Street and Chickering Road. Atty. Ralph E. Finck represented the petitioner. He presented the plan~ and explained that in 1961 a portion of this parcel was sold ~o the Dairy q~ee~, leaving 14,400 sq. ft. but was not ratified at that +.~. It now has to be approved by the Board in order to sell the remaining ~ore R~ house and be recorded at the Registr7. The fellow that runs the store now wents to b~ the store and house tn order to live there and be near the store. There were no abutters present and there was no opposition. Mr. Gilman mede a motion to take the petition under advisement. Mr. Lund seconded the motion and the vote was ,,-~imous. HEARING: The Village Land Company Mr. O,I~ary read the legal notice in the appeal of The Vt~R~me Laud Oo~oa~y re- questing a variation of Sec. 6, Para. 6.62 of the ZomA~ By-Law so as to permit the construction of a single family dwelling on a 10,000 ft. lot on the premises located at the west side of Davis Street at the corner of Pleasant Street. Mr. Will/~ Rockwell was present to represent the Village Land Co. and explained that this lot has been vacant for ma_._ny years and that the house to be built there w~uld not detract from the neighborhood. One abutter was present; there was no opposition. The Board questioned whether or not to accept the plans sinee they were not prepared and stamped by a Certified Land ~rvayor. The at~w,p._ on the plans a~ ~Forbea Rockwell, Registered Professional Engineer". The Board questioned whether or not the Registry of Deeds would accept such a plan. Mr. 0'Leary c~ed Town Counsel Salisbury on the phone and requested a w~itten answer as to the disposition of the plans. Mr. Gi~ made a motion to take the petition under advisement. Mr. Lund secanded the motio~ and the vote was unanimous. An application was received for a hearing frc~ Atty. Ja~__s H. Eaton, III for Alice Lennon, Carry Circle. A letter will be sent to the Atty. advising him that the plan submitted is t~daquate and that proper plans must be presented. The he&x'Ing will be held on April 8th. The Board then proceeded to discuss and vote on the petitions. 1. Mr. Gilman made a motion to GRANT the petition subject to proper plans being presented after advice of Towm Counsel.
