Goldberg, Chairman: The Planning Board meeting for `Tuesday, April 16, 2019 was called to order at 7 p.m. 7 8 ANR 9 800 Massachusetts Avenue 10 M. Gregoire: New application was submitted 3/29/19; the previous application was denied to allow time to confirm the 11 wetland line. Revised plan was presented showing three lots with required frontage. Lot 2 may require a variance from the 12 ZBA for Contiguous Buildable Area. 13 MOTION: J. Simons made a motion to direct the Planner to sign the ANR. A. Preston seconded. The vote was 4-0, 14 unanimous in favor. 15 16 CONTINUED PUBLIC HEARINGS 17 0 Great Pond Road, LRC Builders, LLC c/o Robert Innis: Application for a Watershed Special Permit under Part 5. 18 Watershed Protection District and Section 195-10.7 of the Town of North Andover Bylaw. Applicant seeks to construct a 19 new single family dwelling with improvements to existing driveway and connection to existing utility services within the 20 Residential 1 zoning district with work within the Non -Disturbance Buffer Zone of Lake Cochichewick 21 MOTION: J. Simons made a motion to accept the applicant's request to withdraw without prejudice for 0 Great Pond 22 Road, LRC Builders, LLC c/o Robert Innis. A. Preston seconded. The vote was 4-0, unanimous in favor. 23 24 Annual Town Meeting Zoning Bvlaw/Map Amendment Articles: 25 Article X: To amend the Town's Zoning Map -Parcel 106.D-0045-0000.0 (1874 Turnpike Street) to be included 26 within the Business 2 zoning district. 27 Article X: To amend the Zoning Bylaw, Article 5 Earth Material Removal, to provide for exemptions from 28 requirements for certain activities. 29 Article X: To amend the Zoning Bylaw, Article 16 Corridor Development District (CDD), permitted uses to allow 30 for drive-through facilities for banks with the CDD1 and CDD2 zoning districts by special permit and to amend the 31 dimensional requirements within the CDD2 zoning district. 32 Article X: To amend the Zoning Bylaw, Article 6 Signs and Sign Lighting Regulations, requirements and permitting 33 process for certain signs and to delete sections of Article 6 that are inappropriately categorized as sign regulations. 34 35 Annual Town Meeting Zoning Bylaw Amendment Article: 36 Article X: Amend Zoning Bylaw — Chanter 195, Article 17: Osgood Smart Growth Overlay District (OSGOD) to see 37 if the Town will vote to repeal Chanter 195, Article 17 and any other reference to the Osgood Smart Growth Overlay 38 District contained in the Zoning Bylaw. 39 [Articles to remain open until Planning Board meeting prior to May 14, 2019 Annual Town Meeting] 40 41 NEW PUBLIC HEARINGS 42 247 Chickering Road, Enterprise Bank: Application for a Special Permit - Site Plan Review Special Permit under 195-8.10 43 - 8.17 and 195-10.7 of the North Andover Zoning Bylaw. Applicant proposes construction of a 3,250 sq.ft. bank branch 44 office with drive -up window. Property is located in the General Business (GB) zoning district, 45 M. Gregoire: Department comments have been submitted; peer review is ongoing, We are waiting on the applicant responses 46 to these comments. MA 01845 47 Atty. Mark Johnson: Provided overview of project noting zoning history of the adjacent property which resulted in the 48 applicant appearing before Zoning for setbacks. There are no wetlands on this property. 49 Patrick McLaughlin. P.E. MHF Design: Reviewed site plan. Property is located adjacent to the Ninety Nine Restaurant. One 50 story bank branch is to be 3,250 sf., with a drive through on north side of the bank. Outlined parking locations and quantities 51 (18 spaces required; 20 will be provided), greenspace areas, buffering and fencing. Trip comparison letter will be provided to 52 the Board. Driveways require MADOT permits. Reviewed lighting on site; (5) 20 ft. LED tall light poles (cut off/dark sky 53 compliant) provided at perimeter of property in addition to surface mounted building lighting. Two catch basins will be 54 located on south side of building. Existing 6 ft. fencing along the rear to remain. Building materials to be New England 55 colonial style building, brick facades on all elevations, white trim, asphalt shingled roof. 56 Craig Core, 143 Thistle Road: Questioned safety of single vehicle entrance (south) and separate (north) exit onto 125/133. 57 Jeffrey Sheehy. abutter, 35 Copley Circle: Neighbor concerns have been addressed, lighting, dumpster location, fencing, etc. 58 Anticipates branch bank will be an improved use to the neighborhood due to limited hours of operation. 59 [Continued to the May 21, 2019 Planning Board meeting/ 60 1725 Turnpike Street, A.L. Prime Energy Consultant, Inc.: Application for Special .Permit — Site Plan Review under 61 sections 195-8.10 — 8,17 and 195-10.7 of the North Andover Zoning Bylaw. The Applicant proposes to replace the existing 62 convenience store with a new, relocated 1,605 sf, building and expand the associated canopy within the General Business (G- 63 13) Zoning District. 64 M. Gregoire: We received a revised plan and ZBA approval. This has been reviewed by various Town Departments; we are 65 waiting for responses from NAPD and Conservation. Stormwater and civil are under review. 66 Anthony Guba, P.E.: Described the improved configuration and history of site. Driveways, dimensional setbacks, grading and 67 traffic flow will be similar to existing. Reviewed proposed parking. Convenience store increased to 1600 sf. Site will be 68 repaved due to changes. Existing septic to be removed to accommodate new store; project to connect to sewer. New canopies 69 to be installed over new dispensers; piping will be replaced. Stormwater will be improved by infiltrating 15'canopies and 70 store roof. Reviewed screened area for trash to rear of site and generator located along 114; lighting and photometric plan. 71 Hours of operation are 5 a.m.-10 p.m, Architecture to be New England style wooden clapboards, trim and shutters. Store roof 72 designed to disguise rooftop mechanical units. Applicant is adding additional hydrant at intersection of 114 and Colonial 73 Avenue. 74 Caroline Costaldo, abutter. 85 Colonial Drive (on behalf of C. Carter abutter, 15 Colonial Ave. & D. Gill, abutter, 10 Colonial 75 Ave,: Voiced unfavorable concerns for project, location of store perpendicular to 114 creates visual obstruction for those 76 exiting Colonial Avenue, footprint appears shoe -horned in, lighting impacts to Mr. Carter's residence, deceleration of vehicles 77 to gas station needs to be addressed on 114, and asked why station has to double in size. Questioned overall conformity of 78 site. 79 John Kendrick, abutter, 20 Colonial Ave.: Expressed concern for increased traffic to residential neighborhood. 80 [Continued to the May 21, 2019 Planning Board meeting% 81 45 Woodberry Lane, Lisa Torbin-Shaw: Application for a Watershed Special Permit under Part 5. Watershed Protection 82 District and section 195-10.7 of the North Andover Zoning Bylaw. Project involves the construction of a 17' x 21' two story 83 addition in the 325 foot Non -Discharge Zone. The project is located within the Residential 3 (R-3) Zoning District. 84 Jack Sullivan, P.E.: Described the project; one of the furthest homes in the watershed, lot established in 1976 predates 1994 85 establishment of watershed protection district, two story addition in the non -discharge zone. Dry well on site will be 86 established to mitigate drainage; grading to match existing. 87 M. Enrivht: The Board has not made a recommendation on the Article yet. Conservation issued a Certificate of Compliance. 108 BOH and Building Commissioner have signed off leaving Planning, DPW and Town Counsel as outstanding. Stabilization 109 along the roadway remains outstanding. 110 M. Gregoire: Cul-de-sac was designed as a rock filled detention basin -landscaping was not ,considered in the original design. 111 The basin failed and the town engineer approved a subsurface infiltration system that appears to be functioning as designed. 112 Board: Reviewed and discussed current stabilization of site via photos, DPW memos regarding incomplete items and site 113 visits; concurred site is not stabilized yet. Street layout requirement occurs prior to street acceptance at Town Meeting. 114 S. Kiefer: At the last meeting, we discussed the seeding and repair work to the berm. Limited issues remain. 115 E. Goldberg: We can approve and set a bond, vote unfavorable action or wait until Town Meeting. 116 MOTION: J. Princeton Properties: Request for Insubstantial Change to allow for a Certificate of Occupancy for the leasing office and model unit, development status update and projected timeline. Andrew Chaban. Princeton Properties: The Clubhouse building will be ready for temporary occupancy with an anticipated date of 5/14/2019 and one model unit in the adjacent residential building. Project compliance is driving this request for an insubstantial Change to sustain leasing activities. J. Enriaht: The Building Inspector emphasized life safety issues be met with regard to parking, site access and construction vehicle access. Board: Agreed to condition providing binder coat be established on the roadway, adequate compliant parking be in place and construction vehicle parking be separated and clearly identified on site. MOTION: J. Simons made a motion to approve the Insubstantial Change for 1210 Osgood Street, Princeton Properties, as conditioned. A. Preston seconded.
