Regular Meeting & Hearings
The Board of Appeals held their regular meeting on Monday evening, April 8,
1963 at 7:30 P.M. in the Town Building. The following members were present and
voting: Dap_icl T. O'Leary, Ch~_~man; Robert J. Burke, Secretary; Henry E. ~und,
and Associate Members Arthur D~-..-,.ond and John J. Shields who sat in place of
regular members Howard Gilman and William Morton.
HEARING: Alice Lennon
Mr. O'Leary read the legal notice in the appeal of Alice Lemuon, requestt~ a
variation of Sec. 6, Para. 6.32 of the Zoning By-Law so as to permit the purchase
of area to the north of the south bound of the driveway, because the driveway was
placed across the lot owned by Ammon on the premises, located at the southwest side
of Ira Catty Circle, known as Lot ~2.

HEARING: Vincent & Louise Boylan
Mr. O~Leary read the legal notice in the appeal of Vincent & Louise Boylan requesting
a variation of Sec. 6, Para. 6.33 of the Zoning By-Law so as to permit the eredtion of
a house and barn on the premises, located at the northwest side of Foster Street;
2200 feet distnat from the corner of Salem Street.
There were appro~m~tely 18 people present for this hearing. Mr. Boylan
that he has approx. 13 acres of laud and that the only way to get in and out of
his property is through a 50 foot drive-way, which he owns. He bought the l~nd from
Mr. DeParis.
Atty. J. Albert Bradley represented most of the abutters present, in opposition to
the petition. He explained that ~11 of these people have new houses in the t~ediate
vicinity. The zoning law provides for 150 ft. frontage. The people 'have notht~g to
rely ou if zoning is not carried out. Mr. DeParis could have ~de up the lots
differently. This As a fraud on the people of the town and the people who have bought
and built there, to allow a lot with 50 ft. frontage. This _~hcqzld be denied. There
is no hardship. This must have been dons with subterfuge in mind to put it over o~
the Board.
Mr. Donald Smith spo~e in opposition. He is Just building right next to the right of
way. He said there is a h~t, off-center, to one side of the right of way, which
would require considerable expense to move.
Most of the abutters did not receive legal notice and upon checking the Assessor's
Y~ps it was found that the wrong abutters had been notified. The ~earing could not
be legally held. Mr. Lurid made a motion to held a mew hearing on Nay 13th. Mr.
Burke seconded the motion and the vote was
The Board will hold a special meetin~ on Monday, April 15th, in order to sig~ the
corrected plans of the Village Land Company.
The Board signed a b/il for Anna Donahue for services for the month of March. $~O. 00.
The meeting adjourned at 8:30 P.M.
