HomeMy WebLinkAbout2019-06-03 Board of Selectmen Minutes BOARD OF SELECTMEN MINUTES June 3, 2019 CALL TO ORDER: Chairman Regina Kean called the meeting to order at 7:02PM in Board of Selectmen Meeting Room. The open session meeting was recorded. ATTENDANCE: The following were present: Chairman Regina Kean, Clerk Phil DeCologero, Licensing Chairman, Chris Nobile, Richard Vaillancourt, Rosemary Smedile, Acting Town Manager Lyne Savage, Deputy Town Manager, Denise Casey and Executive Assistant, Laurie Burzlaff. PLEDGE OF ALLEGIANCE PUBLIC COMMENT None APPROVAL OF MINUTES Chris Nobile made a MOTION, seconded by Rosemary Smedile to approve the Open Session Minutes of May 28, 2019. Motion approved 5-0. CONSENT ITEMS (taken out of order) Appointment of Amy Maxner, Conservation Administrator, as Project Manager to apply for LAND grant Program for the Glennie Woodlot property Amy Maxner has been hired as the new Conservation Administrator and will be starting next week. Vanessa Johnson Hall from Essex County Greenbelt will be present to answer any questions. If the town receives the grant, it will be reimbursed for 60% of the full purchase price of $250,000 which would equal $150,000. Richard Vaillancourt made a MOTION, seconded by Phil DeCologero that the Board of Selectmen appoint Amy Maxner as project manager to apply for the LAND grant for the Glennie Woodlot property. Motion approved 5-0. PUBLIC HEARING National Grid Pole Petition-3 Berkeley Road National Grid is requesting permission to lay underground conduits on Berkeley Road. All relevant departments, including Town Counsel, have reviewed the documents. Chris Wellington and David Boucher from National Grid were present to answer any questions regarding the petition. Rosemary Smedile made a MOTION, seconded by Chris Nobile to open the public hearing to receive comments on proposed National Grid Pole Petition for Berkeley Road. Motion approved 5- 0. June Coorey of Foss Road asked about the impact on Foss Road. Mr. Wellington stated there would be no impact to Foss Road. Rob Donovan of Rock Road asked about the width and depth of the trench and repairing driveways that have pavers and properties with irrigation systems. Mr. Wellington stated all properties will be restored to their present condition. Ashley Williams of Rock Road asked about power outages and mailboxes being replaced. Mr. Wellington stated that there should be no long term power outages but residents will be notified if an outage will be happening. Mr. Wellington also indicated that any mailboxes that need to be removed will be put back. Nancy Leaver of Rock Road stated that she is across from a retention pond and water puddles at the end of her driveway. Mr. Wellington stated this will have no impact on that. Wayne Gendron of Berkeley Road asked about connections to the house. Mr. Wellington stated there would not be doing anything with the connections to the house. Chris Nobile made a MOTION, seconded by Phil DeCologero to close the public hearing to receive comments on proposed National Grid Pole Petition for Berkeley Road. Motion approved 5-0. Phil DeCologero made a MOTION, seconded by Rosemary Smedile that the Board of Selectmen approve National Grid Pole Petition for Berkeley Road, as presented. Motion approved 5-0. CONSENT ITEMS (continued) Request of the North Andover Booster Club for permission to use Johnson, Abbot, Salem, Marbleridge, Milk, Chestnut and Andover Streets from 8:30AM to 10:30AM and to close Massachusetts Avenue from Osgood Street to the Andover from 6:00AM until 10:30AM for the 4th of July Road Race Board of Selectmen Minutes June 3, 2019 2 th Mark Cooperstein and Sean Daley from the Booster Club presented their request to hold the 4 of July Road Race and close Massachusetts Avenue from Osgood Street to the roundabout from 6:00AM until 10:30AM. All relevant departments reviewed the request and have no issues. Rosemary Smedile made a MOTION, seconded by Phil DeCologero that the Board of Selectmen th approve the request of the North Andover Booster Club to hold the annual 4 of July Road Race and close Massachusetts Avenue from Osgood Street to the roundabout from 6:00AM to 10:30AM, as presented. Motion approved 5-0. GOVERNMENTAL REPORTS Sale or lease of Stevens Estate Chairman Kean gave a brief overview of the timeline and process. John Royce from Elegant Banquets explained their proposal. Jim Lafond of Osgood Street stated the Town is putting the cart before the horse and the question as to whether we even want to sell the estate hasn’t been answered yet. Kathy Szyka, chair of the Historical Commission, stated their mission is to protect and preserve houses, landscape, etc. that are a value to the residents of North Andover. Ms. Szyka indicated that Massachusetts Historical Commission stated in writing they will not approve given the size of the addition. Selectmen DeCologero asked Ms. Syzka to provide a copy of the written opinion from Mass. Historical to the Board of Selectmen. Ms. Szyka stated that the Historical Commission voted to ask for the warrant articles to be removed. Cathy Keith of Osgood Street asked about protecting the property and traffic. Ms. Kean indicated that the 137 acres would be protected from development and that traffic would be the generally the same. David Brown of Old Farm Road asked for Elegant Banquets to provide market research. David Rand of Dale Street stated he will speak at Town Meeting opposing the sale. Adele Goldwater of Sandra Lane stated we should keep the building for town use. CONSENT ITEMS (continued) Town Meeting warrant article discussion and recommendations The Board discussed the articles and decided to wait until after Planning Board gave their recommendations before giving recommendations on Articles 1-3. Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen recommend favorable action on Article 4. Motion approved 5-0. Chris Nobile made a MOTION, seconded by Richard Vaillancourt that the Board of Selectmen recommend favorable action on Article 5. Motion approved 4-1. Ms. Smedile opposed. Phil DeCologero made a MOTION, seconded by Chris Nobile, that the Board of Selectmen make an amendment on the floor of Town Meeting to amend Article 6 to remove the language related to the sale of the estate amending the article to give permission to lease only. Motion approved 5-0. Phil DeCologero made a MOTION, seconded by Chris Nobile to recommend favorable action on Article 6 as amended. Motion approved 4-1. Ms. Smedile opposed. Waiver of all permit fees associated with the construction of the Senior Center and the Recreation Complex Phil DeCologero made a MOTION, seconded by Chris Nobile that the Board of Selectmen waive all permit fees associated with the construction of the Senior Center and the Recreation Complex. Motion approved 5-0. Request of Neurofibromatosis Northeast to use Salem, Ingalls, Forest, Boxford, Foster, Winter and Dale streets on September 14, 2019 for the Coast to the Cure bike ride starting at 7:00AM in Gloucester Included in the packet was a request from Neurofibromatosis Northeast for approval to use streets in North Andover for the annual Coast to the Cure Bike Ride on September 14, 2019. The three routes (24, 66 or 100 miles) will all start and finish at Stage Fort Park in Gloucester. The streets in North Andover that are on the route are: Salem, Ingalls, Forest, Boxford, Foster, Winter and Dale. All relevant departments reviewed and have no issues. Richard Vaillancourt made a MOTION, seconded by Chris Nobile that the Board of Selectmen approve the request of Neurofibromatosis Northeast, to use streets in North Andover for the Annual Coast to the Cure Bike Ride on September 14, 2019. Motion approved 5-0. Board of Selectmen Minutes June 3, 2019 3 LICENSING COMMISSIONERS Chris Nobile made a MOTION, seconded by Richard Vaillancourt to open a meeting of the North Andover Licensing Commission. Motion approved 5-0. Request of 1634 Meadery for a one day wine and malt license for a Father’s Day Celebration at the Stevens Coolidge Estate on June 16, 2019 from 4:00PM-7:00PM Richard Vaillancourt made a MOTION, seconded by Regina Kean that the Board of Selectmen, acting as Licensing Commissioners, approve the request of 1634 Meadery for a one day wine and malt license for a Father’s Day Bluegrass Bash on June 16, 2019 from 4:00PM-7:00PM. Motion approved 5-0. Request of Smolak Farms for a one day wine and malt license for a fundraiser on June 20, 2019 from 5:00PM-9:00PM Regina Kean made a MOTION, seconded by Phil DeCologero that the Board of Selectmen, acting as Licensing Commissioners, approve the request of Smolak Farms for a one day wine and malt license for a fundraiser on June 20, 2019 from 5:00PM-9:00PM. Motion approved 5-0. Regina Kean made a MOTION, seconded by Phil DeCologero to close a meeting of the North Andover Licensing Commission. Motion approved 5-0. OLD BUSINESS None NEW BUSINESS None TOWN MANAGER REPORT Acting Town Manager, Lyne Savage, explained that there would be a prescribed burn on Weir Hill and notices have gone out to the public. Ms. Savage also indicted that Standard & Poor reaffirmed the town’s AAA bond rating. SELECTMAN REPORT Regina Kean announced that the town received the Distinguished Budget award once again from the GFOA. Phil DeCologero announced that Laurie Burzlaff was chosen as an Unsung Heroine by the Massachusetts Commission on the Status of Women.
