Dear Mr. Kavanaugh:
The proposed wastewater system design plan for the above site dated May 3, 2019 and revised
June 3, 2019 has been reviewed. Unfortunately, the plan cannot be approved until the following
items are corrected. The specific section in Title 5: 3 10 C M 15.000, or North Andover
regulation that is not met by this design follows each item where applicable.
1. The plan indicates a variance is being requested for less than one test hole in the soil
absorption system area while an application was submitted for a Local Upgrade Approval
to have less than one test hole in the soil absorption system area. These two items have
different standards of review in the regulations. Clarify whether you are requesting a
variance or a Local Upgrade Approval. See 310 CMR 15.404 and 15.410 for the different
review standards
2. The Application for Local Upgrade Approval indicates in Section C. 1. that a system '
full compliance with Title 5 is not being provided because it is "cost prohibitive". It is
not evident how the lack of a test pit is cost prohibitive,nor has it been shown why
compliance with the regulation is not achieved. Provide clearer information
